Yes it does. There's a huge difference between just banging without knowing but actually one of the two knowing and not disclosing the information or not caring.

I was raised by believing you can put yourself in harms way and you should take responsibility for your actions. Lie the drug addict who OD's because he bought a bad dose of drugs. Or the person who buys stolen goods. Or just having gang members as friends. You may be doing the lesser of two evils but your actions have consequences.

I dont find rape funny at all, but if I have sex with my girlfriend wife without beating her up or tying her down then it is not rape. Rape is when you grab a a person and force them to have sex with someone they dont want to have sex with. Distributing the video was wrong, the act was perverted but not rape.
If your wife passes out from dehydration and you have sex with her on a video (or no video it doesn't matter) without her consent you are raping her. That does not meet any of the criteria you've mentioned above but you would be charged with rape.
Try it out and video tape it and give it to the cops and see what they do.
