the fact that obama said as much as he did only makes me think that he will make race a bigger issue as his tenure wears on. could it be possible that his good friend gates set this whole thing up to get things rolling?:toast:

It seems both sides overreacted. The problem with that is that it will still open the police up to a civil suit, which they will most likely lose.

I think that most cops are arrogant, power hungry dickheads. However, I lean slightly to the side of the police here.

most cops are respectable, honest men who have no desire but to serve. some cops are scum sure, but most are honorable. we just don't like it when they enforce laws that we think suck.

Obama lost all his steam today...the health care talk was a disaster for him.

1) Disorderly conduct. Such a vague law. I know several people (all white, by the way) arrested for disorderly conduct. It doesn't take much, especially on a Friday/Saturday night.

2) Public/private property. Once again, can be vague. Drinking a beer in your backyard? Guess what, your neighbors can see you. Could be considered public.

The Gates incident yesterday indicates that we as a nation still have the same old problems. It also demonstrates that teachers, espeically distringuished educators from Harvard should demonstrate by example the kind of behavior they teach about. I have read the biography on Gates in Wikipedia and I have read the police report and several other commentaries. This was preventable. Gates could have thanked the officer for checking on his house, which could have been invaded, but chose to back himself into a corner and play the racial trump card. In my opinion if asked by any officer for any reason to provide some type of identification I do it without question. Period. The reason is respect for the law. You have to practice what you preach and apparently Gates' trump card was ego ("do you know who you are dealing with here)" . If you have seen a picture of Gates coming down the stairs in handcuffs he has obviously lost not only his composure but the respect of his fellow professors and students who expected better of him. That should have been a non-incident. Now he wants an apology. Well I do not think the police officer owes him one, but I will give him one anyway. I am sorry Mr. Gates, sorry that you just don't get it. Sorry that in America, black or white, it is not about who you are dealing with, and that the immediate circumstances of that incident could and should have been avoided by extending the policeman the dignity due him and for knowing who you were dealing with. I am also sorry that you picked the wrong cop, could not have picked a worse police officer who has gained a certain amount of respect by his peers, including a black police commissioner who has already commented that Crowley "followed procedure." I am also sorry that the president doesn't get it either but that is a another story. I think your behavior and Obama's comment will be in the history books someday as "one step backward for mankind".

The White House today said that President Obama "regrets" the furor his remarks on the arrest of his friend Henry Louis Gates Jr. have caused, as the lawyer for the cop who arrested the black Harvard University professor said the officer may sue Gates for defamation.

"I think he would regret if he realized how much of a overall distraction and obsession it would be," White House Press Secretary Robert Gibbs told reporters.

When asked if the president would apologize to the officer, as some police unions have demanded, Gibbs would only say that the president understands that the job police officers do is hard and that he has great respect for them.
Gibbs added that he did not expect Obama to have anything else to say about the incident.

"I think he's said most of what he's going to say on it," Gibbs said.

I beg to differ with Gibbs. He should be deeply concerned.

After that, it's on the officer or other complaintants to demonstrate he is not legally within the residence.

If the officer(s) still believe a crime "might" be in progress, it is incumbent upon them to determine who owns the home and to proceed from that basis. They do not have the right to enter the home without clear probable cause to believe a crime is being committed.

If the police knock on your door today, you are not required to respond. If they can see you through glass and demand identification, you are not required to provide it. It is first incumbent upon them to determine that there is a crime being committed within the house before they can enter.

The 4th Amendment, along with the 1st Amendment, easily make up perhaps our two most tremendous and fundamental constitutional liberties.

So when a cop responds to a possible home invasion, the only thing the person who answers the door needs to say is "this is my home, everything is fine", and then the cop should just walk away.
