i think its 50/50. the blogs and boards seem to heavily favor the cop, but the blogs and boards heavily favored mccain and look what happened.

i dont think anyone would admit with a straight face racial profiling doesnt exist.

i do think guys like MJ/PPP would say this is government taking over, cops going wild taking a man out of his home and arresting him if gates was white since they play the obama angle with everything. the whole they can come for me, im going to defend my home right angle.

like i said, im 50/50 on it, lean to gates though.

I don't see the problem here. The man proved he was in his own home. What did the man do wrong?

The cop WAS stupid. End of story. You'd say the same if it were your friend being hauled off to jail for doing nothing wrong.

Here are the police reports detailing the confrontation last week between Harvard professor Henry Louis Gates, Jr. and Cambridge cops, who were condemned last night by President Barack Obama for acting "stupidly" in arresting the African-American scholar. Cops responded to Gates's house after neighbor Lucia Whalen reported spotting "two black males with backpacks" trying to gain entry to the home (Gates, returning home from a trip overseas, and his driver were contending with a stuck front door). The Cambridge Police Department reports, authored by Sergeant James Crowley and Officer James Figueroa, quote an incensed Gates yelling, "This is what happens to black men in America!," and, when asked by Crowley to speak with him outside the residence, Gates replied, "ya, I'll speak with your mama outside." A disorderly conduct rap was filed against Gates,

collect what. the professor is a millionaire with a home in marthas vineyard. that wasnt even his house, it was a house harvard gave to him for rental.

i still believe that MJ, road reeler, ppp, would be up in arms if this happened to a white guy. they are the same people saying if something like this ever happens to me i'll force them to pry my fingers off my gun, im protecting my house.

then they turn around and lay down for the cop. lol.

and thats if the cop is even telling the truth. police lie on reports sometimes.

You have a painful misunderstanding of the 4th Amendment.

Having a passerby claim that people inside a house don't belong there is wholly insufficient PC to justify police entry into a private dwelling.

Police cannot enter a private dwelling unless they have such PC

Besides the obvious glaring error in Crowley's police report where he purports the "disorderly conduct" occurred in a "public place" (in fact it was on private property), is there anyone who thinks it possible that Crowley included other misleading information in his report?

I have not been arrested since 1991.

And prior to this past January 31, I spent the previous six years working 15-20 hours a week with active duty and retired police officers as part of my paid work reforming public drug policies.

As you might imagine, both the First and Fourth Amendments are the most likely to be involved with police and the enforcement of drug laws. I have been taught in great detail what constitutes both reasonable cause (for a traffic stop) and probable cause (for a search or entry into private property).

If police have appropriate PC, it's best to let them in without resistance.

However, if they do not have appropriate PC (most commonly represented with a legal warrant), it's usually best to peaceably deny them entrance into your private property.

Lest any one or more of us here in the RxPoliticoPub get too ramped up bantering this topic with only the two conflicting accounts from Officer Crowley and Professor Gates, it's likely a good place to wrap by noting that Gates did not get charged and that's good news.

If you're willing to set aside the alleged racial attitudes and components to this story, it also provides us with yet another stark example of how a person with decent money and decent influence is more able to overcome bogus arrests by police.

Far too many other Americans without decent money and or decent influence in the community can suffer tremendous damage when arrested on bogus charges.

Thus the urgent need for us to carefully scrutinize ALL arrests for people of any color which come under challenge
