I wouldn't just assume the old rules count right now. we've never had every state and US-run territory under a declared emergency which absolutely gives the Executive office and the Federal govt additional powers. I don't know what those powers are but neither do you. My guess is (and it is truly a guess) that when you declare your state in Emergency you're handing over some local and state's rights by doing so
