The Georgia citizens arrest statute will be key to the defense. My understanding is that a felony under Georgia law would have had to have been committed for a citizens arrest to be attempted. The opinions I have seen indicate walking through a house under construction is not a felony in Georgia. If that is the case, and the McMichaels were wrong in their attempt, they are fucked.
