By law in that state, they were allowed to try & detain suspect, in which video & witnesses prove him to be, until authorities arrive.

The suspect took it upon himself to attack & try to take the gun away from the citizen attempting to detain him.

The suspect is the only one who broke the law here, and on more than one instance.

Was it right in some people's eyes the way the 2 men went about this?

No.

But it's not for us to say based on the law in that particular state, and the 2 men did nothing wrong based on that.

Personally think both get convicted of nothing - the only thing that could swing the case against these two is the guy filming - he appears to be the only eye witness - worried they are gonna threaten to charge him if he doesn't tell the story they want to hear - good thing is - he has stated what happened immediately following altercation - and u can rest assure it helps these two - so he would be changing his story and lose all credibility

No.

I do not think they will get off...

The son is doing time for sure...

The father will serve some sort of time as well...

You may be right, but if they go to prison, then the state clearly isn't sticking to their own rulebook.

Because based on those laws, they did nothing wrong.

Morally maybe, but not legally.

Come on Hache, I'm as pro-cop as anyone here but had they not pulled up on that kid with guns out, he'd be alive today. The driver is guilty of something. The dad should walk free.

Doesn't their state law state citizens can make an arrest in such an instance?

They had the gun but did not just gun the guy down.

The guy tried to take it from them.

It's not really complicated.

Unfortunately for those 2 men, like most jurors do, they won't abide by the laws of the land and 'without a reasonable doubt' rule.

Common sense and real life experience would point to the fact that people walk through houses under construction all the time with no criminal intent. Curiosity is what is common, not crime.

A) I don't really know what the Georgia State Law stipulates you're allowed/not allowed to do in regards to a citizen's arrest. That will help me understand.

B) If two guys pulled up on me quickly and one guy jumped out with a long rifle, I'd be pretty nervous and act accordingly. I wouldn't necessarily run at the shooter but he reacted differently that I would have.

I find it odd you're literally in this thread arguing with other posters but you want to talk to me about arguing? Very ironic indeed but I digress.

If you think it's normal for random people to just enter under construction homes for whatever reason, you live in a very different world than me.

By the way, entering an under construction home is trespassing. You know doing that isn't routine. We waste our time when we entertain these types of things.

We don't know what the father and son witnessed exactly that allowed them to enact a citizens arrest in their minds. We know what the media has said but I want to see the evidence.

The Georgia citizens arrest statute will be key to the defense. My understanding is that a felony under Georgia law would have had to have been committed for a citizens arrest to be attempted. The opinions I have seen indicate walking through a house under construction is not a felony in Georgia. If that is the case, and the McMichaels were wrong in their attempt, they are fucked.
