I leave it to my accountant who has been in that business for over 45 years, I picked up over $27K in the LVH and got almost half written off between losing Las Vegas Tickets and some scratch offs. I couldn't tell you what they did, but I will trust them as I claim all Legal gambling that I do. ( LV , AC & Bahamas )
I have had both 1099's & W2-G's . and I just hand them in and let them do the work.
I'm not going to say I disagree with you on the 1099 vs. W2-G, because I don't know. But as long as they can figure out a way to offset some of the winnings... or losses I'm fine with it.[/
In all likelihood your accountant deducted gambling losses from your 1099-misc winnings not knowing they could not do that OR deciding they would do it anyway against the 1099-misc and take a chance.
Twenty plus years ago I did the same with my 1099-misc gambling related winnings from certain things, which is, writing off gambling losses against 1099-misc not knowing that was not legal to do such in the eyes of the IRS, nothing occurred from doing such, of course, was not audited in that timeframe.
The LVH by using a 1099-misc instead of a W2-g is basically slapping every contestant in the face by saying this is just like a random drawing where everyone throws $1500 into the pot and involves no gambling AND/OR skill.
Hopefully this year will be the year the LVH changes their stance on this......wish more people would complain to them on this topic.
