HERE'S THE UPDATE IN BRIEF FOR TODAY:
  • Massive pro-amnesty pressure this week has failed to get a single new YES vote. Congratulatons to all of you who have been phoning with practical and rational comments about the DREAM amnesty. Just as last week, we would beat that amnesty if the vote were held in the Senate today. But we can't stop phoning because Senate leaders are trying to give pro-amnesty advocates every moment possible to find the last of the 60 votes they need.
  • No. 2 Senate Majority Leader Reid (D-Nev.) now is pushing the DREAM Act amnesty vote out of this week and he says likely early next week. Nonetheless, he continues to claim that the amnesty vote is a higher priority for the Senate leadership than all but three or four of the long wish list they have before Christmas.
  • Reid also indicates that if amnesty doesn't pass before Christmas he may bring Senate back between Christmas and New Year's. He also has suggested he might bring the old Senate back on Monday and Tuesday after New Year's for the final two days before the Congress that was elected in November takes over. He knows that an amnesty has zero chance of passing in the newly elected Congress, so he seems intent on holding the old Congress around as long as he needs to get an amnesty to the President's desk.
  • Danger of hiding amnesty inside larger bill during the Lame Duck? The ILW.com website for immigration lawyers carried some fascinating comments this week about the desperation among pro-amnesty advocates. In giving three reasons why the nation's attorneys should support the DREAM amnesty was: "a not-insignificant fraction of DREAM beneficiaries will need legal counsel, one of the few bright spots on the horizon for law firms suffering from the Great Recession." While noting that Reid still doesn't have the votes to pass the DREAM amnesty on its own, "If DREAM passage is to be ensured, the sure-fire method is to attach it to a must-pass bill. Two such bills are currently in play and DREAM could conceivably be attached to either. The bills are of course, the tax cut bill and the Continuing Resolution for Appropriations for FY 2011. . . even serious discussion about attaching DREAM to the must-pass bills would go a long way to getting the 60 votes on the stand-alone bill."

    Sen. Murkowski (R)
    No statement on her web site and no media quotes. Daily Kos says multiple whips counts have her as a likely supporter. Most of the PRO-amnesty groups are counting her as a YES.

    Sen. Landrieu (D)
    She indicates that the House bill needs to be considered because it has some changes (suggesting that she will claim the House bill closes loopholes). She talks of major concern for the "children."

    MICHIGAN
    Sen. Stabenow (D)
    She was a certain YES on cloture to start debate. But she has not indicated whether she would vote YES to end debate and thus pass the bill. She is up for re-election in 2012 in a state that turned sharply Republican in the 2010 elections. Now (as noted above), we are facing only a cloture vote to END debate. PRO-amnesty forces count her as theirs. But I don't think she has to be at all.

    MISSOURI
    Sen. McCaskill (D)
    McCaskill has a wide-ranging interview on her web site. Appears to be leaning toward yes but its non-committal. She says (1) we have never punished children, (2) this is a different bill than the one I voted against, and (3) if this bill is more narrowly drawn, I will take a serious look at it. She needs to be reminded that any amnesty support will certainly show up when she tries to be re-elected in 2012 by a state that went sharply Republican in the 2010 elections.

    NORTH DAKOTA
    Sen. Dorgan (D)
    He was a certain YES on cloture to start debate. But he has not indicated whether he would vote YES to end debate and thus pass the bill. Now (as noted above), we are facing only a cloture vote to END debate. In the past, he has been one of our most reliable NO votes on amnesty. But he is retiring and acting squishy. PRO-amnesty forces are counting him as theirs. I don't think that has to be true at all.

    LEANING NO BUT PROBABLY NEED MORE ENCOURAGEMENT

    These Senators' staff continually tell our members that they will vote NO. But based on past performance, on current pressure from PRO-amnesty forces in their states, etc., our Hill Team believes they need lots more phone calls thanking them for their expected NO vote and reminding them why they are taking the ethically and practically correct position.

    KEY MESSAGES IN ALL PHONE CALLS TO SENATORS WHO ARE SYMPATHETIC TO THE DREAM ACT POSTER CHILDREN

    Keep this in mind about Senators who are Undeclared, or who say they will vote NO but are squishy, or who say they will vote YES but are potentially movable to NO:

    They all are sympathetic to the poster children of the DREAM Act -- those are the minority of potential amnesty recipients who were brought to the U.S. by their parents when they were infants or toddlers and who are now good high school or college students.

    You will gain nothing with the Senators we are trying to reach today by being negative about these students.

    Instead, you have to approach these Senators on the basis of practicality. Perhaps the poster children do deserve consideration in the future but not before the enforcement is put in place to stop future illegal immigration. Your argument is that it is not possible in this rushed Lame Duck session to create and pass an amnesty that is limited to the deserving and which will stop future unfair illegal labor competition to unemployed Americans.

    My thought is that it would be helpful today for every phone call to make the same pitches to Senators who are sympathetic to the poster children of the DREAM amnesty:
    • No matter how sympathetic these students may be, you can't give out another mass amnesty without fixing the weak enforcement that allowed their parents to bring them here and keep them here for years and years. DREAM has ZERO enforcement.
    • The DREAM Act amnesty includes no requirement that jobs be shut off to the millions of future illegal aliens who will bring THEIR children and put them in this exact same predicament that DREAM puports to resolve. It is totally irresponsible to the 22 million unemployed Americans to give out a big amnesty without requiring mandatory verification to keep illegal aliens from holding jobs.

      This is the line in the sand you are asking every Senator to draw . . .

      . . . . . The line is that whatever one's feelings about the merits of some illegal aliens for an amnesty, no amnesty should be even talked about until the border is secure against continued mass illegal immigration and our jobs are secure from illegal aliens being able to take them from Americans.

You have fought for principles dear to you, and dear to the future of our country.

Now, there is nothing else you can do but watch to see how our 100 U.S. Senators end up voting.

But thanks to your constant efforts for 24 months of this now-waning Congress, our prospects for tomorrow continue to look very good.

The biggest amnesty vote since 2007 is scheduled to be the first order of business after the Senate convenes tomorrow morning (Saturday the 18th).

EVERY YEAR FOR 10 YEARS, NumbersUSA's ARMY OF CITIZENS HAS FOUGHT AGAINST MAJOR AMNESTY EFFORTS.

We've lost occasionally (the Senate in 2006 and the House just last week, for example).

BUT NO AMNESTY HAS EVER MADE IT TO THE PRESIDENT'S DESK.

There is no logical political reason for these Senators to vote YES on amnesty . . . if the people of their states know what they are doing. All three of these have good tendencies in our direction on amnesty in the past. But they are acting like this amnesty is somehow different.

Senator Reid Thursday evening filed cloture on the House version of the DREAM Act (H.R.5281) and immediately announced that he would bring the bill up for a vote Saturday--most likely Saturday morning. If the Senate passes the DREAM Act, it will go straight to the President’s desk and become law. We therefore have about 36 hours to make sure all 100 Senators know that the American people overwhelmingly reject the DREAM Act!

The DREAM Act has been one of the key items in the special-interest agenda Democratic Leadership has been desperately trying to pass in the waning days of the 111th Congress. I am beginning to wonder if the Democrats put up such an atrocious piece of legislation that they knew it would fail so they would at least have a chance in the 2010 elections. If it had passed, they knew they would be voted out en mass in 2012.

ABC News’ Matthew Jaffe reports:
Senate Republicans today shot down the DREAM Act, an immigration measure that would have helped undocumented students who came to the US before age 16 to become legal residents after five years by completing higher education or military service.
The final tally of today’s procedural vote was 55-41, but the measure needed 60 votes to advance.
Senate Republicans argued that the bill amounted to amnesty, that it would impede the enforcement of immigration laws and that it failed to address the larger problem of border security. “Here we are in the final days of a lame-duck, some say dead-duck Congress, considering a bill that would create a major problem to the effective enforcement of immigration laws. People are not happy with us,” Sen. Jeff Sessions, R-Ala., said this morning on the Senate floor.
“This bill is a law that at its fundamental core is a reward for illegal activity,” he said.
Sen. Lindsey Graham, R-S.C., claimed that Senate Democrats were only pushing the bill so late in this session of Congress for their own political gain. “To those who are bringing this bill up today, I know why you're doing it. You're not doing it to advance the issue. You're doing it to advance your situation politically,” Graham said. “It is not appreciated. You're making it harder. You care more about politics in the last two weeks than you care about governing the country. This will not help America do the things America does.”
Ultimately, the numerous pleas from across the aisle -- such as from the Senate’s number-two Democrat Dick Durbin -- fell on deaf ears. Durbin emphasized that the measure would have helped millions of young immigrants.
“This is the only country they have ever known and all they’re asking for is a chance to serve this nation -- that is what the DREAM Act is all about,” said Durbin. “To say that we’re pushing and rushing a vote for them -- it can’t come too soon! Their lives hang in the balance.”
The bill passed the House earlier this month, making today’s vote in the Senate a last-ditch effort by Democrats to pass the measure before Republicans take control of the House and gain seats in the Senate come January.
Three Republicans backed the bill today: Sens. Dick Lugar of Indiana, Lisa Murkowski of Alaska and Robert Bennett of Utah. But five Democrats voted against it: Sens. Mark Pryor of Arkansas, Jon Tester of Montana, Ben Nelson of Nebraska, Max Baucus of Montana and Kay Hagan of North Carolina. Four senators did not vote: Sens. Jim Bunning of Kentucky, Judd Gregg of New Hampshire, Orrin Hatch of Utah and Joe Manchin of West Virginia.

Befitting the key role that NumbersUSA's activists played in yet again defeating an amnesty, NumbersUSA played a prominent role in the news reports this afternoon.


We don't often get a chance to read fun and celebratory stories about immigration in the mainstream media, so I'm going to provide you with several excerpts that will hopefully make you smile.

It also is a quick way for you to see how we at NumbersUSA see the fight once January and the new Congress arrive.

I apologize if this seems self-promoting since I am the one being quoted. But I hope you realize that the only reason any media care what I have to say is because of all the work that all of you do.

Most of these are excerpts. But I've included the whole news flash story from The Hill, which is one of the authoritative publications that covers Congress intensely and is followed closely by political junkies nationwide. The Hill jumped out with this story almost immediately after the vote.

Pro-immigration groups decry 'shameful' vote;
Enforcement groups vow new push

An anti-illegal immigration group said after Saturday's defeat of the DREAM Act in the Senate that "we look forward to moving aggressively to offense."

"Now, the next Congress can start to put unemployed Americans back to work by eliminating the ability for illegal aliens to hold jobs and by reducing the number of unnecessary permanent foreign workers we currently bring in legally every month," Roy Beck, president and founder of NumbersUSA, said in a statement minutes after the Senate voted 55-41 to end debate on the measure, not clearing the 60-vote filibuster threshold.

Beck lauded a decade of "perfect defense" against "amnesty" initiatives.

"Now, we look forward to moving aggressively to offense," Beck said. "The next Congress has the strongest pro-enforcement membership since 1995 and probably since 1924."


But the National Hispanic Leadership Agenda decried senators' "shameful" failure to pass the DREAM Act.

"Todays failed vote is an indication that an ugly current of nativism is alive and active in the U.S. Senate, said Lillian Rodrguez-Lpez, chairwoman of the National Hispanic Leadership Agenda, in a statement.

"It would be an outrageous ploy if a yes vote on this bill was withheld for partisan gain in the next Congress," she said. "To those Senators who denied the American dream to so many worthy young people, we will not forget."

Opponents of Illegal Immigration Claim Victory With Repeat DREAM Act Failure

By a vote of 55 to 41, the bill -- the Development, Relief and Education for Alien Minors, or DREAM Act -- failed to win the 60 votes needed to break a GOP filibuster, even though the measure passed the House last week.

The defeat was the second for the legislation since 2007, when it last was brought to the Senate floor. Opponents have argued that the bill amounted to an "amnesty" that could cost taxpayers and encourage continued illegal immigration.

"We are declaring a 10-year victory," said Roy Beck, president of Numbers USA, an advocacy group that has lobbied against the DREAM Act. "Since 2001, there has been an attempt to pass giant amnesties every year. And we have been on defense, we have fought every single year. And now there's not going to be any amnesty in this new Congress. It's over."

President Obama said in a statement that he was "incredibly disappointed" by the vote.

"It is disappointing that common sense did not prevail today," he said. "But my administration will not give up on the DREAM Act, or on the important business of fixing our broken immigration system."

"There are some compelling cases out there that deserve to be considered. But there are also 22 million Americans who have compelling cases, who want a job and can't find a job," Beck said. "What the DREAM Act does is add at least a couple million more workers to legally compete against the 22 million unemployed Americans."

"I realize these kids did not personally decide to break the law. Nonetheless, they represent law-breaking. How do you keep parents from doing this to their kids in the future? The DREAM Act does nothing about that," he said.

Immigration Vote Leaves Obama Policy in Disarray

The vote by the Senate on Saturday to block a bill to grant legal status to hundreds of thousands of illegal immigrant students was a painful setback to an emerging movement of young immigrants and also appeared to leave the immigration policy of the Obama administration, which has supported the bill and the movement, in disarray.

The bill, known as the Dream Act, gained 55 votes in favor with 41 against, a tally that fell short of the 60 votes needed to bring it to the floor for debate. Five Democrats broke ranks to vote against the bill while only three Republicans voted for it. The defeat in the Senate came after the House of Representatives passed the bill last week.

The result, though not unexpected, was still a rebuff to President Obama by newly empowered Republicans in Congress on an issue he has called one of his priorities.

Groups favoring reduced immigration cheered the vote on the student bill as a watershed victory that they said marks the end of a period they have spent on the defensive.

An immigration bill that would blaze a trail to legal status for hundreds of thousands of undocumented students went down in flames in the Senate on Saturday, delivering a critical blow to Democrats and Hispanic activists.

Both sides, which have fought tooth and nail over the bill immediately reacted to Saturday's vote.

"Now, the next Congress can start to put unemployed Americans back to work by eliminating the ability for illegal aliens to hold jobs and by reducing the number of unnecessary permanent foreign workers we currently bring in legally every month," said Roy Beck, president and founder of NumbersUSA.


Rea Carey, executive director of the National Gay and Lesbian Task Force, said, "It is deeply disappointing that the Senate today refused to even allow a vote on the bill."

House Democrats vowed the fight was not over.

"Though disappointed by the result of today's DREAM Act vote in the Senate, we are not deterred in our determination to continue advocating for this critical legislation," House Speaker Nancy Pelosi said in a statement.

We didn't have any of the country's blocs of elites helping us. All we had was individual citizens who banded together in an internet grassroots mobilization to defeat an amnesty for the 10th year in a row.

P.S. I do not celebrate the dashed hopes of the thousands of illegal-alien students who worked so hard to pass the DREAM Act amnesty that would have given them work permits and legal residency. As I have often been quoted in the media saying, many of these young adults have a compelling story.

But those compelling students hitched their wagons to cynical politicians who sought to use their "compellingness" to first pass a massive blanket amnesty (CIR) and then this loophole-filled, fraud-prone DREAM Act amnesty that showed zero concern for the compelling stories of 22 million unemployed Americans and their kids. A national community has an ethical and constitutional obligation to put those compelling stories of its own fellow citizens at the front of the line for any redress.

CASA GRANDE, Ariz. -- Pinal County sheriff's deputies say they've have arrested five suspected illegal immigrants who attempted to hide in a pile of cow manure.
A sheriff's deputy tried to stop a speeding vehicle Thursday morning in Casa Grande, but lost sight of it after a brief pursuit. The vehicle was later found abandoned and authorities say evidence found inside indicated it had been used to smuggle illegal immigrants.
Deputies tracked the vehicle's occupants to a dairy about two miles away, where they found a woman and four men that had tried to conceal themselves in cow manure. The five have been turned over to the Border Patrol.
They say the vehicle's alleged driver — 48-year-old Gerardo Garcia of Eloy — was found hiding in brush near the dairy. He's been booked into the Pinal County Adult Detention Center on a fraud warrant out of Maricopa County.
