In GA, one can be charged with felony assault simply by approaching another individual with a deadly weapon in hand that causes the other individual to have a reasonable presumption that they can face bodily harm. The charges can range from misdemeanor to felony based on the DA overseeing the case. There are some justification type defenses to this.

He was standing in the back of the pickup truck. He literally didn’t do anything related to the guy dying.
It doesn’t matter. Under a felony murder charge all parties to the crime would be convicted since the act of committing the felony has a foreseeable risk of death. He would be treated the same as a getting away driver in a robbery that led to someone’s death, although not intentional, it’s a foreseeable outcome of the situation.

Until I started reading here about I really thought he was out jogging
imagine that, I believed the media. Pathetic
I was skeptical on the guy was just out jogging and was "hunted" down from the beginning...I felt there was more to the story...Until I started reading here about I really thought he was out jogging

The video of the guy in the house proved to me he was not "just out jogging".
After watching the last video exploited posted there was for sure a history with the parties involved...
However I firmly believe like anything in life the choices you make have consequences.
I still firmly believe all three parties involved made bad choices and have to pay for those choices...
It is pretty simple really...the guy should have never gone into the house under construction...And the two other guys should have never followed the guy, they should have just called the police and given them the info on who they thought the guy was in the house and then given the police the video from inside the house...that's it.
