Voters in the eastern Nebraska city of Fremont on Monday approved a ban on hiring or renting property to illegal immigrants.

The special election in Fremont was the latest proposal in a series of immigration regulations taken up by communities around the country. About 57 percent of voters supported the measure, which is expected to be challenged in court.
Supporters say the measure is needed to make up for what they see as lax federal law enforcement. Opponents fear it could fuel discrimination.
Freemont's Hispanic population has surged in the past two decades, largely due to jobs at two nearby meatpacking plants. That increase is largely because they were recruited to work for the Fremont Beef and Hormel plants, and the city maintains an enviably low unemployment rate.
Across the nation, people have been outraged by — and demanded action against — the poor enforcement of federal laws to prevent illegal immigration. A law recently introduced in Arizona requires police to question people on their immigration status if there's a "reasonable suspicion" they are illegal. Immigration is one of the issues likely to be a factor in this November's midterm congressional elections.
A man who helped write the Arizona law helped to fight for the ordinance in Fremont.
Residents worry that jobs are going to illegal immigrants who they fear could drain community resources.
Clint Walraven, who has lived in Fremont all his 51 years, said the jobs should go to legal residents who are unemployed — something he believes the ordinance would help fix. Discussions on the issue can get heated, he said, particularly if racism is mentioned.
"It has nothing to do with being racist," Walraven said. "We all have to play by the same rules. ... If you want to stay here, get legal."

From about 165 Hispanics — both legal and illegal — living in Fremont in 1990, the total surged to 1,085 in 2000, according to census expert David Drozd at the University of Nebraska at Omaha. He said an estimated 2,060 Hispanics lived there last year. In May, Fremont recorded just 4.9 percent unemployment, in line with the statewide rate and significantly lower than the national average of 9.7 percent.
The measure would require potential renters to apply for a license to rent. The application process will force Fremont officials to check if the renters are in the country legally. If they are found to be illegal, they will not be issued a license allowing them to rent.
The ordinance also requires businesses to use the federal E-Verify database to ensure employees are allowed to work.
Supporters of the proposal say it's needed to make up for what they see as lax federal law enforcement. Opponents say it could fuel discrimination.
Employers Have Some Concerns
Ron Tillery, executive director of the Fremont Chamber of Commerce, which opposes the measure, said businesses are concerned the E-Verify system isn't reliable and that they would be subject to fines if forced to rely on it. He pointed out that the main targets of the ordinance — the Fremont Beef and Hormel plants — would not be covered by it anyway because they are located outside the city.
Walraven said the measure is necessary because workers send their salaries to family in Mexico instead of spending it in the city.
"I understand supporting your family," he said, "but it's very much at our expense. We're footing the bill. Those costs include spending on education and medical care, said Jerry Hart, a Fremont resident who petitioned for the vote. He said the ordinance would help curb that spending and protect jobs. He said it would also end the divisiveness that's taken over.
The Fremont Tribune has reported several instances of legal Hispanic residents being told to return to Mexico, including a woman who was shoved and yelled at by an elderly white man in a grocery store. Hart said he's been called a Nazi.
"Fear is kind of guiding," said Kristin Ostrom, who helps oversee a campaign against the measure, adding that frustration about immigration issues nationwide ignites a misconception that all Hispanic immigrants in Fremont are illegal.
Sandra Leffler, 69, who owns a downtown antique store with her husband, Marv, said she knows not all Hispanics are illegal immigrants, but that it's hard not to think that way. She said she scrutinizes her Hispanic customers.
"I have to admit, when I see them come into the store ... I can't help wondering if I'm profiling someone who's completely honest," she said.
Lawsuit Is Likely
The Fremont City Council narrowly rejected a policy similar to the proposed ordinance in 2008, but proponents got it to a public vote and the state Supreme Court refused to block it.
The Nebraska chapter of the American Civil Liberties Union has threatened a lawsuit, and the city worries about the cost of defending the policy. The city has estimated the legal action would cost $1 million per year to fight — costs that would have to be covered by property tax increases and city job cuts.
Kansas City, Mo.-based attorney Kris Kobach, who worked on the Arizona law and has been in legal battles over local ordinances elsewhere, said Valley Park, Mo. paid between $250,000 and $300,000 in legal fees in a similar case. Valley Park, like Fremont, is covered by the 8th Circuit.
State Sen. Charlie Janssen of Fremont, who has said he may introduce an Arizona-style bill in the Nebraska legislature next session, said it's unfortunate residents have to decide how to vote amid threats of a lawsuit. He has declined to give his position on the ordinance, saying residents need to decide on their own.
"A vote for or against the ordinance does not make you more or less patriotic," he said in a posting on his legislative blog. "Just as a vote for or against the ordinance does not make you racist or not.''

Several Senators have learned of a possible plan by the Obama Administration that would provide a mass Amnesty for the nation's 11-18 million illegal aliens. Led by Sen. Chuck Grassley (R-Iowa), eight Senators addressed a letter to the President asking for answers to questions about a plan that would allow DHS Secretary Janet Napolitano to provide an amnesty if they can't secure enough votes for a bill in the Senate.
The letter that was sent to Pres. Obama earlier today asks the President for clarification on the use of deferred action or parole for illegal aliens. The executive actions are typically used in special cases and are evaluated on a case-by-case basis, but if 60 votes can't be secured in the Senate to pass a mass Amnesty, the Administration may use the discretionary actions as an alternative.
Here is the text of the letter signed by Sens. Grassley, Hatch (R-Utah), Vitter (R-La.), Bunning (R-Ky.), Chambliss (R-Ga.), Isakson (R-Ga.), Inhofe (R-Okla.), and Cochran (R-Miss.).

We understand that there’s a push for your Administration to develop a plan to unilaterally extend either deferred action or parole to millions of illegal aliens in the United States. We understand that the Administration may include aliens who have willfully overstayed their visas or filed for benefits knowing that they will not be eligible for a status for years to come. We understand that deferred action and parole are discretionary actions reserved for individual cases that present unusual, emergent or humanitarian circumstances. Deferred action and parole were not intended to be used to confer a status or offer protection to large groups of illegal aliens, even if the agency claims that they look at each case on a “case-by-case” basis.
While we agree our immigration laws need to be fixed, we are deeply concerned about the potential expansion of deferred action or parole for a large illegal alien population. While deferred action and parole are Executive Branch authorities, they should not be used to circumvent Congress’ constitutional authority to legislate immigration policy, particularly as it relates to the illegal population in the United States.
The Administration would be wise to abandon any plans for deferred action or parole for the illegal population. Such a move would further erode the American public’s confidence in the federal government and its commitment to securing the borders and enforcing the laws already on the books.
We would appreciate receiving a commitment that the Administration has no plans to use either authority to change the current position of a large group of illegal aliens already in the United States, and ask that you respond to us about this matter as soon as possible.

Thousands of Acres in Arizona Deemed by Feds as Unsafe for Visitors

PHOENIX – Governor Jan Brewer today condemned the federal government’s continued failure to secure our international border and announced the unveiling of www.keepazsafe.com, a website created to collect contributions for those wishing to donate to the Governor’s Border Security and Immigration Legal Defense Fund, originally established by Executive Order on May 26, 2010.

“It appears from recent media reports that some federal agencies are warning U.S. citizens to avoid potential illegal immigration danger from visits to federal public lands in Arizona,” said Governor Brewer. “How much more evidence of the border security crisis is necessary for the federal government to act on my border security proposals? Important natural recreational destinations in Arizona have been determined by federal authorities as dangerous. This will not be resolved until our international border is secured in a sustainable fashion by the federal government. Signs do not protect our border. Let’s protect Americans, not just warn them.”

Signs erected, both new and old, by the federal government in southern Arizona verify Governor Brewer’s border security crisis concerns – concerns that she has been warning the federal government of since her first weeks in office. The signs state, in part, “DANGER – PUBLIC WARNING…TRAVEL NOT RECOMMENDED”.

On May 25, 2010, Governor Brewer announced the hiring of outside legal counsel to defend SB 1070 as well as mechanisms to pay for the legal defense of the lawsuits. Senate Bill 1070 authorizes the Governor to “direct counsel other than the attorney general to appear on behalf of this state to defend any challenge” relating to Senate Bill 1070.

“It’s amazing to see just how many folks across the country are supportive of Arizona’s passage and signing of SB 1070,” said Governor Brewer. “The pouring in of hundreds of unsolicited donations since the end of April, speaks volumes about how important securing our border is to citizens across America. Arizona is showing that it is not afraid to stand up and uphold the law in absence of the federal government fulfilling its obligation.”

As of June 10, a total of 437 supporters of the law have donated nearly $20,000 to the state. Donations have come from 46 states, plus the District of Columbia.

Your great success in keeping Congress from voting on a mass amnesty this year has stirred up a new threat.

Seeing that most Members of Congress are scared to death to vote for an amnesty in an election year, Administration officials are working on ways to do a de facto amnesty without involving Congress.

We at NumbersUSA have been hearing about this behind the scenes for a few weeks now but haven't had solid enough evidence to mount a national mobilization against. They then said they had better not say any more about it.

Friends, U.S. Presidents have proven whether Republican or Democrat that they are capable of doing almost anything they please until they come up for re-election. Only an incredible outburst of outrage from the public can stop the Administration from doing a de facto amnesty all by itself.

Your faxing today is just the first part of the outburst that we are mobilizing.

We need all 535 Members of Congress to know about the De Facto Amnesty Plot -- and to know that you know. We want Democrats in Congress to begin to tell their Leaders and the White House that even the hint that this amnesty could happen will hurt their chances of winning in the fall. RALEIGH -- Three young women who came to this country as children and are now illegal immigrants are staging a hunger strike in an attempt to convince U.S. Sen. Kay Hagan to back a bill that could make them legal residents.
The women – Rosario Lopez, 25, Viridiana Martinez, 23, and Loida Silva, 22 – have set up tents across the street from the state legislative building in downtown Raleigh and subsisted on water, Pedialtye and Gatorade since June 14.
They have lost 23 pounds collectively and said they're growing weaker by the day but plan on continuing the hunger strike and camping out in the impromptu protest site they've secured near the state Legislature.

"If we don't do it, no one else is going to," Silva said in an earlier interview about the hunger strike. "Our parents broke the law, we didn't have a say in that."
Silva and Martinez arrived with their families when they were children on legitimate travel visas, but overstayed those visas after their families were unable to get permanent residency. Lopez was 13 when she, her mother and two siblings were smuggled across the Mexican border to join their father, who was already living in the Triangle. Lopez said the family was starving because her mother couldn't make enough to feed the family and her father had been injured during his own trip to the United States and unable to work.
They held a press conference this afternoon in front of Hagan's New Bern Avenue office in the federal courthouse.
All three women freely admit they are living in the country illegally and are angry and frustrated at the barriers in the U.S. immigration laws that leave them with slim chances of going on to college or getting jobs other under-the-table work.
The trio are trying to pressure Hagan, North Carolina’s Democratic senator, to sign on to what’s being called the DREAM Act (Development, Relief and Education of Alien Minors Act). The federal legislation, which has floated around Congress for years, would give children who came to the U.S. illegally a chance to get permanent resident status if they attend college or join the military. It would also open up chances to take out federal student loans and enable them to pay in-state tuition for their home states.
Hagan, who is in Washington today, announced Tuesday afternoon she would not sign on to become a co-sponsor. U.S. Sen. Richard Burr is also not backing the bill.
Critics of the bill have said it would be rewarding immigrants who come to the country illegally, encourage more foreign-parents to smuggle their children and would be unfair to those who wait years to come to the country legally.
"It's a slippery slope and for a lot of Americans, it's a Bad Dream Act," said Ron Woodard of NC Listen, an advocacy group pushing for more immigration enforcement. "It's going to encourage more illegal immigration."

Loophole closed for illegal immigrants accused of serious crimes

They are accused child rapists, drug dealers and thieves. And because of major reforms in the justice system — spurred by a News 8 investigation — those people now face prosecution.
As recently as November, because of a loophole in the law, many would have simply been set free without ever going to trial.
Until it was fixed, the loophole allowed for the deportation of accused criminals — and a breakdown in the justice system.
We introduced you to "Sylvia" back in November. While she is an American citizen, her husband, Jose Salvador Tinajero, is Mexican.
He had just been deported instead of prosecuted for molesting her two children.
"There is no justice," Sylvia said last year, "especially for my girls, my family. There is none."
Today, she is simply overwhelmed at the progress that's been made.
News 8 first broke the story that more than 1,000 illegal immigrants who were charged with serious crimes like murder had been deported before their cases ever went to trial.
Many were bused back to Mexico and simply set free across the border.
In November, we spoke to Sgt. Ernesto Fierro, an investigator for the Dallas County District Attorney's office. At the time, little was being done to fix the problem, and Fierro said he was "furious" about it.
Buena Valentin is a Mexican citizen charged with raping his girlfriend's seven-year-old daughter. After the attack on the girl — and her sister — they immediately ran to church for help.
"She looked really bad. Very bad," said Eleuterio Cabrera of Templo de Dios. "She was crying. The girls were very, very, very bad. It was horrible."
What was the problem?
After an arrest, the district attorney's office was usually not notified until a case had been in the system for several weeks. In that gap of time, the accused paid his bond.
Then — because the suspect was in the U.S. illegally — he was turned over to ICE, Immigration and Customs Enforcement. The job of that agency is to deport, regardless of pending charges.
Now, however, because of News 8 reports, those holes in the system are all plugged, and Sgt. Ernesto Fierro has a new, full-time assignment: Keeping people like Buena Valentin in jail.
"I feel great; I feel really good," Fierro said. "I feel like I've really done something here."
And the 90 crime suspects in Fierro's book will remain incarcerated in the Dallas County jail until their cases are settled.
"Many of them would've been on the bus back to their home country," Fierro said, without the changes to the system.

Two big fixes are:
  • A mandatory $100,000 bond for anyone who is a flight risk due to possible deportation. In some cases, that's a 20-fold increase.
  • Improved communication and cooperation between Dallas County and ICE.
"I appreciate you guys highlighting," said Nuria Prendes, the top ICE agent in Dallas. "If we're not made aware of things, there's no way we can fix them."
ICE and the county are now in daily contact, keeping accused criminals in jail — and off the southbound bus.
"It's worked incredibly well," said Anthony Robinson, the Dallas County District Attorney's chief investigator. "I would really like to see it be a model in other cities."
Federal officials say one in four felony defendants are in the U.S. illegally. News 8 has attempted to find out how many are deported before trial, but no government agency tracks the issue, and privacy rules have impeded our efforts to learn more.
Still, there is strong evidence the loophole does exists nationwide. We found cases in Florida, Massachusetts and New York.
Is there an opportunity to use the Dallas experience as a model for other parts of the country?
"It has been shared," Prendes said. "What we're doing in Dallas has been shared with headquarters, and they are looking at it. They are putting some procedures in place so that everyone is on the same sheet of music."
For a problem that few in Dallas County even knew existed eight months ago, the reforms here have been quick — and the results are tangible, and certainly worth emulating — for the sake of justice, and for the sake of victims.

It seems to me that in looking back at all that has come down recently that something may have occured that really bothers me. I would be willing to bet that Obama told the visting Pres of Mexico that Obama was going to sue the state of Arizona over the immigration issue. However, it is obvious that the Gov of Arizona came away from her meeting with Obama without a clue of impending litgation much less any encouragement that Obama would improve the border control.. Only the slip from Hillary aired the issue and of course another incident that embarrassed everyone concerned except Obama and his staff. Meanwhile, Mexico sues Arizona in an Arizona court no less. So Obama was cordial and heads up with the Pres of Mexico and distant and mum with the Gov of a U.S. state. That is completely unpresidential (per usual) and underhanded for someone who represents the state he (and his ally) are conspiring against. I think conspire applies in this case. This is dangerous behavior on Obama's part and he continues to act as though he is the Czar of the U.S.. He is not a leader and someone who represents the best interests of his citizenry.
It is all about politics and agenda in the WH and all obstacles are avoided and/or ignored.

2 Riverside County cities vote to support Arizona's anti-illegal immigration law

The city councils of Hemet and Lake Elsinore, both in Riverside County, approved proclamations Tuesday in support of Arizona’s controversial anti-illegal immigration law.
The Yorba Linda City Council in Orange County approved a similar resolution earlier this month, countering actions taken by leaders in cities such as Los Angeles, who voted to boycott doing business with Arizona companies in protest of the law.
The law tells police officers to check the immigration status of people they have stopped for another reason and reasonably suspect are in the U.S. illegally.
The Hemet City Council unanimously approved the measure, proposed by Mayor Eric McBride. Dozens of residents testified throughout the evening, with supporters praising the council for taking a stand against illegal immigration and for the rule of law, and opponents accusing the council of fostering racial profiling and discrimination. Residents on both sides criticized the White House and Congress for failing to address the issue.
“It may not be perfect, I’m sure it’s not,” Councilman Robert Youssef said of the Arizona law. “But it’s a step in the right direction.”
In Lake Elsinore, a 28-mile drive west of Hemet on Highway 74, a similar scene played out before that city’s council, which approved a resolution in favor of the Arizona law 4 to 1.

2 Riverside County cities vote to support Arizona's anti-illegal immigration law

The city councils of Hemet and Lake Elsinore, both in Riverside County, approved proclamations Tuesday in support of Arizona’s controversial anti-illegal immigration law.
The Yorba Linda City Council in Orange County approved a similar resolution earlier this month, countering actions taken by leaders in cities such as Los Angeles, who voted to boycott doing business with Arizona companies in protest of the law.
The law tells police officers to check the immigration status of people they have stopped for another reason and reasonably suspect are in the U.S. illegally.
The Hemet City Council unanimously approved the measure, proposed by Mayor Eric McBride. Dozens of residents testified throughout the evening, with supporters praising the council for taking a stand against illegal immigration and for the rule of law, and opponents accusing the council of fostering racial profiling and discrimination. Residents on both sides criticized the White House and Congress for failing to address the issue.
“It may not be perfect, I’m sure it’s not,” Councilman Robert Youssef said of the Arizona law. “But it’s a step in the right direction.”
In Lake Elsinore, a 28-mile drive west of Hemet on Highway 74, a similar scene played out before that city’s council, which approved a resolution in favor of the Arizona law 4 to 1.

So I think it’s a good time now to be proposing a more sensible policy than what we’ve seen in any country.” Becker also suggests raising the retirement age (to reduce entitlement spending) and believes that “the center of economic gravity is gradually moving to Asia.”

I don't think Obama will sign an Executive Order granting blanket amnesty to all illegals anytime soon, especially right before the November elections, though he may do it on his last day in office in January, 2013. This would precipitate an unbelievable amount of bloodshed around the country.

On the other hand, it is good that this information leaked out now. All pro-amnesty politicians up for re-election will have to say whether or not they support the Executive Order route to amnesty. Unfortunately, you will see a lot of waffling and most will not answer directly.
