THE SENATE HEALTH CARE BILL CONTAINS ILLEGAL ALIEN LOOPHOLES

Help FAIR Ensure That Illegal Aliens
Won't Be Able to Access Taxpayer-Funded Benefits!
The Senate is currently considering the health care reform bill (H.R. 3590). As FAIR's Legislative Analysis concludes:
  1. The Senate bill contains a loophole to allow illegal aliens to access taxpayer-funded health care benefits;
  2. The Senate bill fails to effectively prevent illegal aliens from accessing the taxpayer-subsidized "exchange" marketplace; and
  3. In a radical departure from current law, the Senate bill circumvents long-standing policies that would require legal immigrants to wait five years before accessing federal health care benefits.
As a result, the Senate health care bill promotes poor immigration policy and fails to protect the interests of the American taxpayers.
In addition, the Senate bill raises a new issue. Under the bill, low-income American citizens – those with income below 100% of federal poverty (FPL) – have only one option for their health insurance: Medicaid. At the same time, the bill gives similarly-situated legal aliens more health care choices than the American citizen. Legal aliens can receive the taxpayer-subsidy to choose whatever health insurance they want. This is fundamentally unfair. It treats immigrants better than American citizens.
But despite these issues, the Senate has not debated these provisions on the Senate floor. Fortunately, these problems and inequities can still be fixed.
FAIR has been working with two true immigration reformers in the Senate who intend to offer amendments to fix these problems.
Senator Jeff Sessions (R-AL) will file an amendment that would:
  • Require the use of a meaningful and effective verification system to ensure that illegal aliens will notbe able to access taxpayer-funded tax subsidies created by the bill;
  • Prevent illegal aliens from accessing the taxpayer-funded exchange to buy insurance; and
  • Maintain the 5-year waiting period in current law so that immigrants must pay into the system before they are able to receive taxpayer-funded health benefits. The 5-year waiting period is critical because it embodies the principle that immigrants should not become a public charge – or burden – to the American people.
In addition, Senator John Ensign (R-NV) has filed an amendment (Amdt. No. 3016) to ensure that American citizens would have the same choices for their health care as the bill gives legal immigrants. This will guarantee citizens are not treated unfairly.
These Senators need our help to ensure that:
  • Senate leadership will allow debate on these critical amendments; and
  • That each of these critical amendments will get a vote on the Senate floor.

  • I support any amendment that would prohibit illegal aliens from receiving taxpayer-subsidized health care benefits. The Senate bill does not include effective verification!!
  • I support the Sessions verification amendment to the health care bill. The Senate must allow a fair up-or-down vote on the Sessions amendment!
  • I support the Ensign amendment (No. 3016). Low-income Americans deserve the same freedom and flexibility regarding their health care choices as the Senate bill gives legal immigrants.
  • I oppose any effort to shut off debate over these issues, and oppose any effort to end debate on the bill, until the amendments get the up-or-down vote they deserve!

3. The NC Community College Board has announced a public hearing on the decision to allow illegal aliens into our community colleges. Unfortunately, they are doing this the weekend before Christmas.

Gutierrez said he was introducing the bill before the holiday recess so "there is no excuse for inaction in the New Year." Apparently, the Congressman's Christmas gift to unemployed Americans is the permanent disappearance of their jobs.

Those idiots running ALIPAC are now excoriating Lou Dobbs for suggesting that there cannot be a path to citizenship until the borders are secure. Lou has out flanked the left wing open borders crowd. They will not accept this rational compromise and so will appear very unreasonable. Lou knows this. A secure border means no illegals get through, something that will never happen. Lou knows this as well.

This is a no brainer, unless you are with ALIPAC.

The Immigration Nationality Act of 1996 prohibits access to in-state tuition benefits by undocumented students (section 8 USC 1623) It reads “…an alien who is not lawfully present in the United States shall not be eligible on the basis of residence within a State for any postsecondary education benefit unless a citizen or national of the United States is eligible for such a benefit…”
Several states have taken it upon themselves to override this provision by offering in-state tuition to illegal aliens. Conversely, three states have passed laws preventing these benefits.

Proposition 300 is a referendum approved by Arizona voters in November 2006. Proposition 300 provides that university students who are not U.S. citizens or permanent residents, or who do not have lawful immigration status, are not eligible for in-state tuition status or financial aid that is funded or subsidized by state monies.

Senate Bill 799 would allow children of undocumented immigrants to attend state universities at in-state tuition rates. The bill requires students to have graduated from a high school in Arkansas with at least three years of attendance. On March 25, 2009, the bill passed conference committee and was sent to the Senate floor. Gov. Beebe opposes the measure.

In 2001, California passed AB 540 allowing illegal aliens access to in-state tuition rates. Requirements: Attend a California high school for three or more years, Graduate from a California high school or receive a GED from California, and Provide an affidavit stating the student will apply for legalization once he/she is eligible to do so.

Effective July 13, 2006, Nebraska Legislative Bill 239 allows illegal aliens to access in-state tuition rates. Requirements: Reside in Nebraska for at least three years prior to high school graduation/obtaining a GED, Graduate from a Nebraska public or private high school or obtain a GED, Live with a parent or guardian while attending high school, Be registered as an entering college student not earlier than the 2006 fall semester, Provide an affidavit stating their intention to become a permanent resident at their earliest opportunity. Oklahoma passed HB1804 in 2008 which prohibits illegal aliens from receiving in-state tuition, but it allows the state's Board of Regents to award in-state tuition to illegal aliens who have attended an Oklahoma high school for at least two years and graduated. Americans for Legal Immigration PAC (ALIPAC) is thanking their national supporters for their donations of time and funds to the Scott Brown for U.S. Senate campaign and pointing out that this historic win may destroy the chances of amnesty for illegal aliens passing in 2010.

"The Brown victory not only breaks the Democratic 60 vote hold on the U.S. Senate needed for cloture votes, but it sends a clear message that voters prefer pro-enforcement candidates instead of pro-amnesty candidates." said William Gheen, president of ALIPAC. "We will be working hard to defeat the Amnesty legislation filed in Congress and to repeat the Brown-Coakley scenario in hundreds of races this November."

Illegal immigration became a top issue in the Massachusetts Senate campaign, with Scott Brown issuing a statement that he opposed amnesty and taxpayer benefits for illegal immigrants and favored tougher enforcement measures. Brown had a background opposing illegal alien amnesty measures as a state Senator.


Martha Coakley gave voters a clear contrast on the issue as she indicated her support for Comprehensive Immigration Reform Amnesty, which most people in the nation consider a sneaky form of Amnesty dubbed Shamnesty. Coakley also admitted that she created a sanctuary state in Massachusetts by turning a blind eye to the immigration status of those charged with crimes in her state, while she served as attorney general.

"The national and local polls are clear." said Gheen. "Illegal immigration is not the lone issue that decides races, but it remains a top priority among voters and the voters overwhelmingly demand that our borders be secured, our existing immigration laws be enforced and the Obama, Gutierrez, Schumer, McCain and Graham Amnesty legislation be abandoned or defeated."

In 2007, a version in the Senate proposed by Senators John McCain and Ted Kennedy with support from Pres. Bush failed to reach a cloture vote. The grassroots effort from NumbersUSA members was a major reason why the amnesty failed.

The pro-enforcement, anti-amnesty Senatorial candidate, Scott Brown (R-Mass.), has defeated Martha Coakley for the seat left vacant by the passing of Edward Kennedy. Brown has taken a strong stance on immigration enforcement and puts the Administration's hopes for a mass amnesty at risk.
Brown has stated on his campaign website that the nation needs to better secure its borders and use a national workplace verification system to ensure that jobs go to American workers. He also opposes rewards to illegal aliens like driver's licenses and in-state tuition.
According to Brown's campaign website...
I recognize that our strength as a nation is built on the immigrant experience in America. I welcome legal immigration to this country. However, we are also a nation of laws and government should not adopt policies that encourage illegal immigration. Providing driver’s licenses and in-state tuition to illegal immigrant families will act as a magnet in drawing more people here in violation of the law and it will impose new costs on taxpayers. I oppose amnesty, and I believe we ought to strengthen our border enforcement and institute an employment verification system with penalties for companies that hire illegal immigrants.

Coakley built a large lead in the Democratic stronghold in the weeks leading to the election, but Brown quickly narrowed the gap. Late last week, polls had the race as a toss-up, and Brown pulled ahead over the weekend. With more than 90% of the vote in, Brown held a 52-47 advantage over Coakley. Brown's election reduces the number of Senate Democrats to 59, putting an end to the filibuster-proof Senate.
Coakley was quoted in the Boston Globe as a supporter of a mass amnesty for the nation's estimated 12 million illegal aliens.

Senator Brown,Welcome to the world of reality! We cannot continue allowing illegals to occupy our jobs while more than 15 Million remain unemployed. It also costs everybody else when illegals go to the E.R., as Obama admitted! The costs to states are in the Billions and to also continue anchor babies is another insane law. It has proven to work when you take away reasons for illegals to come here. As far the illegals that are here, they need to leave and apply like everybody else. As a volunteer for Scott Brown's campaign I truly believe he will listen and respond to the practical and sensible ideas of groups like NumbersUSA on issues involving illegal immigration. At the very least, his historic victory in the most liberal state in the Union will give pause to the entire Democratic Party. We cannot wait for the amnesty bill to come up. We all need to be on the offense right now. We need to let all Senators and Reps. know way ahead of time that we will not stand for amnesty. But that is not enough. We must push for inforcement. Total inforcement. Huge fines on employers and also round ups of the illegal aliens themselves. Afterall they are not blameless. They entered this country illegally of their own free will. But the main thing we need to do is push to end birthright citizenship. Let's get busy. Very busy. Right now while we have momentum. This special election for filling the Senate seat for Massachusetts was an effort of people from all over the country.Scott Brown’s win is proof of the fact that IF IF IF the people speak loudly enough and work hard enough anything is possible. As someone who has pwersonally intervieed Scott Brown on the subject of immigration policy I find his election a preferable not a perfect choice. He has switched hiis position since the beginning of his campaign from onre influenced by McCain to one influenced more by Romney. He wishes to have the illegal aliens register for a period above ground similar to schheduled departure but longer then leave to reapply for reentry behind the existing caseloasd of legal immigrants. This is a great day for citizens and a defeat for the reconquista movement behind the Pro Amnesty crowd. Obama will try to spin it to suit his agenda instead bending to the will of our people but as more and more politicians are defeated because they do not support "we the people" they will eventually get the message. DHS Making Plans to Entice Haitians to Risk Illegal Boat Effort Into U.S.?

We are getting conflicting stories out of the Department of Homeland Security that it may be preparing to entice hundreds of thousands of Haitians to try to illegally enter the U.S. and then grant them some kind of legal status and work permits. Here is what we are hearing . . .
A source from within DHS is hearing of an effort to gather all French and Creole speakers in DHS to move to our Gitmo base in Cuba. This is where Haitian boat people trying to illegally enter the U.S. would be taken after being intercepted on the seas. At Gitmo, according to this DHS source, the boat people would be processed and then allowed to enter the U.S. for some undetermined amount of time with work permits.
Another source says DHS Chief Janet Napolitano was asked about this plan by a journalist and has denied it. I was certainly pleased to see her over the weekend trying to send a message to Haiti that people should not take risks to take a boat to the U.S. and in warning people contemplating it that they would be picked up and taken back to Haiti. But it could be that internally there are fears that a flotilla will emerge anyway and the floaters really won't be repatriated.
At this point, I am not weighing in on the credibility of any of the information.
But I do want to point out that it would be incredibly cruel to the Haitian people for the Obama Administration to provide any sign whatsoever that Haitians who try to enter the U.S. illegally would be allowed to stay and work.
Even without a devastating earthquake, Haitians for decades have shown a willingness to drop everything and risk their lives on leaky boats to try to get to the U.S. when they thought they might have a chance to settle illegally.
Many of you may remember that thousands of Haitians took to the seas just before Pres. Clinton was first inaugurated because they thought from some of his campaign comments that he would allow them to sneak into the country. Many Haitians drowned in the process. The first act of the Clinton Administration was to intercept the Haitian boats and make it clear that taking to sea was fruitless because the boats would not be allowed to land in Florida and illegal aliens who evaded the Coast Guard would be sent back to Haiti when caught on land.
In short, the first time that Haitians try to illegally enter the U.S. and are allowed to stay legally, we can expect to see a massive flotilla of rickety boats heading here from Haiti, and hundreds or thousands of Haitians will die in the process.
For now, we can hope that if DHS is setting up a processing center at Gitmo, it will be for the purpose of moving Haitians rescued from their boats back to Haiti.
The whole world is committed at this moment to assisting the 8 million Haitians who are in their home country. The Haitians are suffering from a momentous tragedy. Since there is no indication that the vast majority of them will be accepted for resettlement in other countries, it only makes sense to put all resources into rebuilding their own country for their habitation, rather than allowing a small fraction to move to the U.S. and further exacerbate the unemployment and economic distress of our own most vulnerable Americans.
We must watch very carefully to make sure that the humanitarian efforts for the Haitians are the most effective for the largest number, rather than helping a few move to the U.S. and enticing far more to risk their lives to get the same treatment.
