Congressional Representatives Howard Berman (CA) and Adam Putnam (FL) have tendered companion legislation in the House.

The Agricultural Job Opportunities and Benefits and Security Act, S 1038/HR 2414, would create a five-year program to legalize the immigration status of illegal alien workers who have been in the United States over the past two years. Illegal alien workers would be eligible for a "blue card" if they have worked in agriculture for only 863 hours over the previous two years! The blue cardholder would be eligible for a green card, and permanent legal resident status in three years.

A key Democratic Senator in the health care overhaul says illegal aliens can't be covered under whatever emerges. Open-borders advocates are howling. Here's the big question for national Democratic leaders: If they recognize that national health insurance for illegal aliens is too expensive, can they see that an amnesty essentially locks in the cost by qualifying 12-20 million illegal aliens for the health care -- plus millions of their relatives who will follow?
We’re not going to cover undocumented aliens, undocumented workers.

A story by Jim Landers of the Dallas Morning News quoted Baucus who is the Senate Finance Committee chairman. He said that health care reforms that aim to insure every American won’t provide insurance for illegal immigrants and may not address the cost to state and local governments for providing medical care to this large group of the uninsured.
Baucus recognizes that illegal immigrants comprise 15-22% of the estimated 47 million U.S. residents without health insurance.
It is the growth among the uninsured that is helping drive the political effort to change the health care system. Previous studies have shown that illegal aliens account for nearly all of the growth in the uninsured in recent years.
So, what to do with them in the national health care solution is a big elephant in the room.
Leaders of various open-borders groups cried out that the health care reform has to provide full medical coverage to all illegal aliens. While illegal aliens get all kinds of free medical care already, primarily through emergency rooms and the like, including them in national health insurance would cost the equivalent of a bank bailout.
One of the reasons open-borders advocates would rather push an amnesty through Congress before health care legislation is that the publicized cost of the amnesty would be far less if national health coverage isn't included.
But it will be important to remind leaders that granting amnesty to 12-20 million illegal aliens would add incredible costs if they are guaranteed a high level of health care under a new national medical system.
I think Sen. Baucus understands. Baucus was one of 14 Democratic Senators who voted against the giant amnesty in 2007, defying his Party leaders.
Interestingly, Sen. Baucus emphasized on Thursday that any talk of giving this kind of health benefits to illegal aliens would be politically explosive.
The national health solution debate will be explosive enough by itself. Imagine adding illegal aliens to it.
Baucus' comment, though, is yet another confirmation that the constant resistance of ordinary Americans to amnesties and rewards for illegal immigration are having a positive effect on Congress. Grassroots opposition is just what the doctor ordered.

No one that is not a bonafied citizen of the United States should get ANY free medical care. We, as taxpayers, are angry that the welfare rolls continue to increase, the medicaid rolls continue to increase, and illegal aliens (of any country) are getting, not only free medical aid, but all of the above. Our government's mindset is totally off base. My grandchildren will have to work all their lives to pay for these foolish expenditures. Why do you think we have so many illegal aliens and deadbeats in America? It is because we are a nation of giving to those that have not earned anything and never will as long as they can get it for free.

I support comprehensive health care reform; many families are uninsured and without vital services until the emergency room becomes the only option for treatment-- this situation is very costly (emergency room care is way more expensive than preventative care in the long run).
The United States in my opinion should encourage other nations such as Mexico to implement comprehensive health care reforms for their citizens as well. That would be a much better alternative than yet another U. S. immigration amnesty in my opinion because our national infrastructure cannot be an effective substitute for the health care delivery systems of other countries without injuring health care delivery on both sides of the border.

My son almost died of a bleeding ucler when he was 14 because the emergency room was overflowing with immigrants. By the time they helped him he had no pulse. This happened in Minnesota of all places. Yes it would make sense to have insurance for everyody in the country. However there is one overaching fact that comes before all else...illegals shouldn't be here in the first place and legals needs to come in managable numbers. That will solve the problem of medical care being over run by poor/uninsured immigrants. Dah, irrational compassion can factually kill those who generously give their place in line to many who exploit us and our health system.

Alvey, we get no response at all from Sen. Landrieu just as you don't-- not even a form letter or email! She must respond only to registered Democrats who donated to her campaign. On the other hand Sen. Vitter responds frequently. One more thing, I've called her offices in DC and BTR when there was no answer, no availability to leave a message either. It is very discouraging,and my skeptical nature wonders if that's her intent.

I send faxes too to EVERYBODY but I dont see it doing any good. The mail room tallies and sends to the reps and it goes no further than that.
These people - and I use the term loosely - in DC think we are idiots, know we have no voice nor power, laugh at us and do their own thing. They vote for what they want, not what you and I want.
Whoever is pulling BO's strings in Wash has promised big rewards to the idiots we have elected. Where is an honest person with work ethic and integrity?
I watch the House of Reps channel on TV for as long as I can stand it. Where are the 435 we pay salaries to? Not there. They never read the bills just pass them. All they have to do is say No to BO and the puppeteers-not until I have read it.
Democrats get up to speak, are articulate and have info to back up their positions. Repubs have nothing to say and so hem and hah the entire 30 secs. What a sham!
Waiting for elections is too much time. The country is being sold down the tubes faster than we can type. Now he has his own media and will tell us what he wants. So much for the transparency he bragged about in his campaign.
I have worked with criminals for 13 years. His mindset is exactly theirs. They are a different breed with no conscience. He wouldn't know truth if it stood in front of him.
I'll keep sending faxes here and on my own but I have lost hope.

I think you have a very good Idea, It would give the readers a shorter and more direct point of a subject.
You could catch the jest of the matter rather than reader a two page discussion of what is on most peoples minds.
Click the ( Contact Us ) Button and shoot it to the I'm pretty positive you'll at least get a responce. That's more than what most of these subjects are all about no responce from their Reps.
P.S. As a disabled veteran from the Nam area illegals seem to have more rights and better care than most vets do. I do think if they're caught they should go. No BS about it.

i set here one weekend and faxed almost every rep or senatot on an issue. what matters is we are one of thousands and we just keep doing this knowing we are making a difference even

Even if the amnesty does not become law, we have another scary situation. Although it has not come to the floor since 2003 when it was introduced by Congressman John Conyers, H.R.676 is a house bill in progress that if passed will create the biggest drain on our economy in history.
Under "Who is Eligible " The bill reads: EVERY PERSON LIVING OR VISITING IN THE UNITED STATES AND THE US TERRITORIES WOULD RECEIVE A UNITED STATES NATIONAL HEALTH INSURANCE CARED AND ID NUMBER ONCE THEY ENROLL AT THE APPORPRIATE LOCATION. SOCIAL SECURITY NUMBERS MAY NOT BE USED WHEN ASSIGNING ID CARDS"
Under what is covered: THIS PROGRAM WILL COVER ALL MEDICALLY NECESSARY SERVICES, INCLUDING PRIMARY CARE, INPATIENT CARE, OUTPATIENT CARE, EMERGENCY CARE, PRESCRIPTION DRUGS, DURABLE MEDICAL EQUIPMENT, LONG TERM CARE, MENTAL HEALTH SERVICES, DENTISTRY, EYE CARE, CHIORPRACTIC, AND SUBSTANCE ABUSE TREATMENT. PATIENTS HAVE THEIR CHOICE OF PHYSICIANS, PROVIDERS, HOSPITALS, CLINICS, AND PREACICES. NO CO-PAYS OR DEDUCTIBLES ARE PERMISSIBLE UNDER THE ACT"
Don't take my word for it. The bill and many summaries are on the web for you to take a look at.
Although from what I have read, H.R.676 has virtually no chance of passing or even coming up for a vote, but with 75 original co signers, there will be pressure to put some of the wording into new bills that will come to the floor over the next year or two.
If his happens, not only illegals, but legal foreign workers, medical vacationers, and the children of all three categories will have access to the free health care that Americans pay for in taxes.
The average cost of health care in the US per person today is $7,800, and of course will rise with inflation.
At some point , we will have 100 million people in the categories above here with their hands for their free care and the care of their anchor children.
Although a well run single payer system like the one above might sound great to hard working Americans, unless we find a way to stop the illegal and foreign use of our free system, it will go bankrupt, along with the rest of us very early on.
A single payer health care system might or might no be affordable for American citizens, and potentially in our best interest, but we have to watch very carefully that our lawmakers are no handing it out like candy to foreigners with their hands out.
By the way, the "free health care" is expected to Cover
8 million residents of Puerto Rico, Samoa, Guam, American Virgin Islands, and the Marianas. None of these independent countries playing at being American colonies pay any federal tax, so how many of them and how will they pay for their free services. They do though pay some token Medicare and Medicaid taxes.
We need to make sure any nationalized single payer health plan that is not just for American citizens does net get voted into law.
The farm lobbies, food service lobbies, pseudo-religious groups, and open boarder groups will be pushing hard...watch out.

Sharon, I feel just as you do. I also retired from military with 22 years service. The military is working for us and the politicans are working on the whole, against us.
You mentioned that you are not getting a response from your congressman. I am having the same problem with one of my senators. I have written, called and FAXed her numerous times on various subjects such as you covered in your post and many others. She has not responded to any of my efforts to give her my opinion and to get hers. She does not even answer when I praise or thank her for a positive vote. My question is do you know what a citizen can do when they refuse to respond to our correspondence? I am going to pursue this in every way I can but who can tell a senator or congressman that they must respond to a citizens concerns? For starters I am going to contact my other senator( who always responds) for some guidance on how to handle this. Anybody out there got any information or suggestions on this problem??

Illegal is illegal. Drugs,robbery,rape, & trespassing etc. will all get you jail time. So, anything an illegal alien does adds to the list of offences commited. Why don't they start cleaning up their own country? By the way, just get yourself caught coming into Mexico's southern border illegally and see if you are treated so graciously as the U.S.A. treats illegal Mexican aliens. THE KEY WORD HERE IS ILLEGAL. Just read Mexico's immigration laws. Ours should be as tough and ENFORCED.

Simple enough to solve. It's not the illegals; it's the "elected officials" that will do anything to stay in office so long as it's just your money. Keep up with what they are doing, not what they are saying. Cheaters don't lie and liars don't cheat, so that eliminates 90% of congress. There are groups that will champion almost any cause. The NRA, Judicial Watch, Numbers USA and HSUS are my causes and I try to support them and their actions as best I can. Vote to get the members of congress that you do not agree with out of office. Impeach them. Work against them. Writing to the local newspapers is one of my favorite things. I can always generate a little back talk.

We are already handing everything to "refugees", grants being given, homes being build by Habitat for Humanity, cars being bought, medical care being provided. "Refugees" who have balances in the thousands of dollars on their food stamp/TANF cards .... yet .... natural born citizens of our country are being denied denied denied. Even our active duty military have to pay co-pays on their dependents medical/dental care. RETIRED MILITARY PEOPLE HAVE TO PAY FOR THEIR INSURANCE. EXCUSE ME, but what in the hell is our government thinking? I know ... the congress, senate, even our president don't really give a dam about the citizens of this country. We have lost millions and millions of jobs to overseas production, our government put the working people of this country into bankruptsy, while the executives build multimillion dollar homes, we are being taxed to death, forced to insure everything, and if we don't insure, well we get tickets, get our licenses/registrations suspended, and soon we will be getting this if we don't have health insurance. Who gains from insurance .... the executives of the insurance companies!!!!! If I chose not to have insurance on my car or myself, or my home .... then I suffer the consequences when something happens ... even if I have insurance .... I suffer the consequences of somebody that does not even know me, will deny whatever claim made on the insurance. OH YEAH, hire a lawyer .... get what you deserve .... and make that lawyer even richer.
I am retired military, and may God forgive me for ever believing in my country's government. May God forgive me for dragging my family all over this country, for having to leave them for months at a time, to take and oath and live an oath to die for my country and my beliefs. May God forgive every single senator or congress member for taking oaths to work for the PEOPLE of this country and not doing so.
I am sick of my government. I have a very very military family. Out of 8 children in my family 5 enlisted in the military, out of 14 grandchildren. so far 6 enlisted and 4 are still active duty, 3 of those serving in Afganistan or Iraq at this time. OK, so where is their support ... their thank you for you service?
Maybe, just maybe, if the senators, and congress members were made to spend a year in one of these countries, or made to live as most citizens of the this country do for a year, living from hand to mouth. Why do they have to have homes in DC .... why doesnt the govenment just build a huge congressional/senatorial barracks, where they can stay when in session, why not have a galley where they can eat. For that matter, why not just stay in their states where they are needed video session.

New I think illegal aliens

I think illegal aliens should be allowed to purchase health insurance, just as they can now, but with absolutely no government subsidy. They must be required to pay the full cost. If all Americans are required to purchase health insurance, which seems unlikely at present, illegal aliens (since we apparently don't have the will to deport them when they are identified) should also be required to buy it, but again, at full cost. They should be paying for their health care through insurance premiums, rather than getting it free, which significantly increases the expense of health care to the rest of us.
Here's a better idea. Require all aliens not in the country legally on temporary visas to purchase health insurance, and arrest, fine, and deport them if they do not. That would help to cover the health care expenses of poor legal immigrants and provide an additional enforcement avenue against illegals.

This is the exact reason California is broke. All the Social services to all the illegal's. I lived in California for 52 year's and that is all you see hand's full of food stamps and a brans new suv.
Plus sthey pay nothing in taxes they hold all these dependent's in MEXICO so they pay nothing. So if congress think's they will pay their way they are dreaming. Never going to happen.
They should cut off all immigration and visas of any kind until we get this country on the mend again. Which will take a long time.

It is impossible to have both an open border and a welfare state. One has to make a decision for either one or the other. The Obama administration doesn't seem to want to make such a choice. Otherwise, it could not be for both health care reform and amnesty.

I agree that health care for illegal aliens is too expensive. But so are visits to the emergency rooms. Or educating the children of illegal aliens or imprisoning illegal aliens. All of these things are items that should be paid for by the country where illegal aliens claim as their home country. It is too bad that some smart person can not or will not come up with a method of making that happen. For example, withholding $5000 from those governments aid packages for each illegal alien we apprehend in the U.S.
But let me reemphasize that I agree with the NUSA article. But even if health care and other items were not too expensive, there should be no consideration given to amnesty for illegal aliens. We have a legal process for people to enter this country and that should be the final, bottom line.

And for the record, this "amnesty" enslaves the Mexicans to the same industry for years before they get any freedom. This is patently illegal, and they will hate you forever also.

If we could vote (or thumbs up/thumbs down) on the comments, then let the most popular rise to the top, we would be able to have fun reading each other's comments and drawing support and ideas from what others are saying to their politicians.
Not only would a page of votable comments be fun and a great team building exercise for our side, it would also be a great way to learn about effective communications from one another.
We could even cut and paste the best comments into our own faxes and reuse them to some extent. That would maximize the best comments from the best writers reused on the most faxes.
And it would also be a lot of fun.

-- During this terrible economy, Americans need every tax dollar and seat in college conserved for Americans and legal immigrants!

"I am calling/writing Congressman ____ to ask him/her to vote against the Dream Act Amnesty HR 1751 and S 729.

A super majority of Americans oppose the Dream Act Amnesty and each state that considered similar legislation in 2009 soundly defeated the Dream legislation. Arkansas, Colorado, Oregon, New Jersey, and Maryland have all defeated in-state tuition for illegal aliens this year and 40 states have rejected such legislation over the last 8 years!

Congress needs to reject any form of Amnesty, including the Dream Act Amnesty because such an amnesty would reward illegal immigrant families and lead to more illegal immigration in America, at a time when we need every tax dollar, every job, and every job training seat in college for suffering American families.

HR 1868 would establish that the "subject to the jurisdiction" clause of the 14<SUP>th</SUP> Amendment awards birthright citizenship only if one of the parents is: (1) a U.S. citizen or national; (2) a lawful permanent resident alien in the United States; or (3) an alien on active service in the U.S. Armed Forces.

Our current policy encourages women to enter the United States illegally so that they can gain citizenship for these "anchor babies," resulting in over 300,000 additional citizens per year. The demographic impact is far greater because their families stay and bring in additional relatives. The DHS is reluctant to deport the illegal alien parents of a child born here.

Taxpayers end up with the bill for the medical costs and subsequent welfare outlays because of the child's citizenship status. Virtually every other nation requires that at least one parent be a citizen or permanent resident for a child to automatically become a citizen.

New Report Debunks Pro-Amnesty Arguments

With many pro-illegal alien groups pushing the Congress to take up "immigration reform" legislation sometime this year, many of these groups are publishing reports that detail, often falsely, the necessity of a "legalization program." One such report was published by Immigration Policy Center (IPC), a well known pro-amnesty organization.
Jack Martin, the Director of Special Projects at the Federation for American Immigration Reform, has penned a report, "Amnesty and the Economy: Myths, Lies, and Obfuscation," which details the fallacies and deliberate falsehoods found within the IPC report.
"Amnesty and the Economy: Myths, Lies, and Obfuscation" -- a Brief Summary

The IPC study claims that "[t]he 2007 immigration reform bill, which included a legalization program, would have more than paid for itself through increased tax revenue...." However, Martin is quick to expose this argument as a total sham. The Congressional Budget Office (CBO) and the Joint Committee on Taxation (JCT) estimated that the 2007 amnesty legislation would have generated $48 billion in new revenue during 2008-2017, primarily through Social Security payroll taxes. However, this revenue would not have offset the additional costs associated with the mass amnesty over the same time period. $23 billion would have been spent in "new direct spending" (tax credits and Medicaid) and $43 billion would have been spent on "new discretionary spending" (immigration enforcement) during 2008-2017. Obviously, the IPC was wrong to say that the 2007 Bush Kennedy McCain amnesty bill would have paid for itself when it actually would have cost taxpayers $18 billion over nine years. Perhaps the IPC does not regard $18 billion as a lot of money, but most Americans do. Furthermore, the CBO estimated that "[t]he legislation would increase the unified federal budget deficit by only several billion dollars a year by 2027." Even by the year 2027, the 2007 amnesty bill would have cost taxpayers billions of dollars each year.
Would an Amnesty Really Increase Tax Revenues?
The IPC study also asserts that a "legalization would increase tax revenue" by bringing workers out of the shadows and making them legal employees, subject to federal withholding. What the IPC fails to note is that most of these illegal workers are low skilled and poorly paid. It is very unlikely that these, suddenly "legal", employees would find better, well-paying jobs. Instead, it is far more likely that these workers would remain in their low-paying jobs and would pay very little, if any, income taxes and would, therefore, become a net deficit to the IRS.
Martin succinctly refutes the IPC argument by saying, "[t]he implications of the tax system and low-wage workers are two-fold: either increased immigration enforcement would drive more of today's illegal workers off the books-and that would make them ineligible to apply for refunds because they would have no wages withheld-thereby decreasing the EITC drain on tax revenues, or the adoption of an amnesty would increase the number of those low-wage workers subject to tax withholding, thereby increasing the number of workers potentially able to claim ... tax refunds." Simply put, the IRS (and the national debt), would suffer as a result of any amnesty).
Better Wages for Legalized Workers?
Advocates of amnesty constantly claim that a mass legalization of illegal aliens would improve the working conditions and wages of these illegal workers. Martin uses the 1986 IRCA mass amnesty as an example of how an amnesty could actually harm illegal workers: "Since 1986, many studies have examined IRCA's effects on economic outcomes among Mexican immigrants. Research generally suggests that IRCA led to deterioration in the wages and working conditions of undocumented migrants, but studies have not yet identified the reasons for this change. Possible explanations include intentional discrimination by employers on the basis of legal status; a shift in employer hiring practices in sectors that employ undocumented workers; increased competition from newly legalized workers; and a general decay of economic conditions after 1986." It is clear that IPC is wrong to assert that a mass amnesty would have a positive effect on the illegal workforce.
Better Wages for Most Americans?
Advocates of amnesty also claim that the legalization of illegal workers would not only improve the wages of illegal workers, it would also improve the wages of most American workers. The IPC paper even cites "numerous studies" which promote this argument. The problem with these studies is that they fail to distinguish between legal and illegal immigrants. Legal immigrants tend to be better educated than illegal immigrants and are less likely to compete with low-skilled, low-educated Americans, i.e., America's most vulnerable. This competition would decrease, not increase, jobs for most low-skilled Americans because the newly-legalized workforce would be willing to accept lower wages and poorer working conditions then most low-skilled American workers.

"Since the landmark raid, an economic squeeze has destroyed several businesses. Postville's population has shrunk by nearly half, to about 1,800 residents, and townsfolk say the resulting anxiety -- felt from the deli to the schoolyard -- has been relentless.
"It's like you're in an oven and there's no place to go and there's no timer to get you out," said former Mayor Robert Penrod, who, overwhelmed, resigned earlier this year....
Roy Beck, head of the Washington-based NumbersUSA group that advocates for reducing immigration, argued that Postville invited its problems by relying so heavily on a plant many suspected was violating labor and immigration laws.
"The situation should have never gotten to that point," he said. "If you don't enforce the laws steadily, then when you suddenly enforce them, there is more collateral damage....""

The immigration system, broken in a thousand places, needs a multitude of fixes, from the borders to the workplace to the status of would-be Americans waiting in limbo overseas and toiling in shadows here. A new bill called AgJobs, introduced in the House and Senate, addresses some of those problems. It seeks to relieve chronic farm labor shortages while protecting rights and opportunities for immigrant workers.

The legislation, which has bipartisan support, is the result of years of negotiations between growers and workers’ advocates. Growers and workers are tied together, but their interests are highly prone to collision, as anyone who remembers the California farmworker strikes of the 1970s knows.

"Mom, you can do something," Kilborn said. "You can write your congressman. I'll even get you the address."
So in September 2007, the 90-year-old Heintz put pen to paper for her first letter to a politician. Two weeks later, she died at the hands of an illegal immigrant.
"Ironic, isn't it?" Kilborn said. "This one issue, it's changed our lives forever....""

On June 8, 2009, an ‘Amnesty for Illegal Aliens Summit’ will be held at the White House. The meeting is behind closed doors, despite the claim of a transparent government by the Obama Administration.



Unemployment in the United States is approaching 10%, yet the Obama administration with the help of Senator Chuck Schumer (NY), is forcing amnesty for illegal aliens’ upon the American people. Schumer says the time is now for amnesty and the American people support it! NOT TRUE!


The Obama administration has already weakened border enforcement. President Obama’s 2010 budget calls for the elimination of the State Criminal Illegal Alien Assistance Program (SCAPP). SCAPP provides $400 million to states to offset the costs of jailing criminal illegal aliens.


American citizens will not be invited to the summit! We are not stakeholders in this discussion!!!


A bi-partisan group of lawmakers and those who have worked on immigration reform are invited. During the last push for Comprehensive Immigration Reform, a massive amnesty for illegal aliens, the radical ethnocentric organization, the National Council of La Raza (The Race) and the United States Chamber of Commerce were invited to help write the bill, behind closed doors. This unholy alliance, was promoting amnesty and open borders. American citizens were completely ignored!


The only way Americans can have a voice is to contact their Senators and Congressman in huge numbers before, and especially on June 8, by phone calls, emails and faxes. They must realize trouble is brewing for any ‘path to citizenship’ scheme!!! Otherwise why would they be hiding this amnesty fest from the view of American Citizens!!!

This is an outrage against our representative government as guaranteed under the United States Constitution!!! Our elected officials are betraying us! Can you afford to remain silent???

· What have illegal aliens done to deserve any path to citizenship??? They are not the responsibility of American citizens or the United States government.

· Senator Schumer knows American citizens are consistently against any ‘path to citizenship’ or ‘amnesty’ for illegal aliens. (A ‘path to citizenship’ allows illegal aliens to pay a meager fine for the precious gift of American citizenship—this is how Congress attempts to say they are not giving illegal aliens ‘amnesty’ for their crime of crossing the border illegally, taking American jobs and suppressing American wages)

· Who represents the majority of the American people at the ‘amnesty summit’ that oppose any path to citizenship for the 20-40 million illegal aliens in this country?

· Where is the compassion of your Senators or Congressman for Americans out of work and struggling? They are not speaking out against the many in Congress who are pushing amnesty for illegal aliens!

· Do your Senators or Congressmen represent you and your family, or foreign nationals, in this country illegally?

· Why hide ‘the amnesty summit’ behind closed doors away from the scrutiny of the American people?

Gut Rules Designed to Prevent Identity Theft by Illegal Aliens


Earlier today, FAIR learned that in the coming days, maybe as soon as tomorrow, the Obama Administration will announce two regulations that will dramatically undermine immigration enforcement.
The first regulation would gut a Bush Administration rule that required federal contractors -- paid with your tax dollars -- to use the E-Verify program to ensure that their employees are legally authorized to work in the U.S. FAIR expects the Obama Administration to gut this rule so that illegal aliens who are currently working for federal contractors will be able to continue in those jobs. This would give job security to illegal aliens who work for federal contractors instead of freeing that job up so that an American worker could be hired. Last week, the Bureau of Labor Statistics announced that 14.5 million Americans are out of work.
The second regulation would gut another Bush Administration rule to provide "no-match" notices to employers who have reported paying wages to people whose name and Social Security number don't match. As the Department of Homeland Security said in October: "One private study concluded that 'most workers with unmatched SSNs are undocumented immigrants.'" The Bush Administration proposed a rule to instruct employers how to deal with the "no-match" letters to ensure that employers don't continue to employ illegal aliens. By gutting this rule, not only would illegal aliens be allowed to continue in their jobs but the Obama Administration would also be turning a blind eye to those illegal aliens who are committing felony identity theft by using the Social Security number of an American citizen or legal immigrant!

Today, the House Appropriations Committee will consider the Department of Homeland Security Appropriations Bill for 2010. This bill already contains language that would extend the E-Verify program for two years.

However, Rep. Jack Kingston (R-GA) will submit an amendment to the bill that would require government subcontractors to use the E-Verify program and weed out illegal aliens from their payroll.

You can read on our home page how the Obama Administration has plans today or early next week to gut the 2008 Executive Order that would require government contractors to run all their employees through E-Verify. But while the new Obama order would bow to the wishes of the greedy Big Business lobby, Rep. Kingston's amendment would force the Administration to keep illegal foreign workers out of taxpayer-supported jobs.

If one of the House Appropriations Committee members is from your state, you will find a phone note with talking points on your Action Buffet corkboard.

Otherwise, call the Members below who are from the smallest states that are near yours.

Tell them that 14 million unemployed Americans would like to have the jobs that illegal aliens currently hold with government contractors. And that you expect the Representative to vote for the Kingston amendment to open up these jobs to unemployed Americans.

First, hammer Jerry Gonzalez, the executive director of the Georgia Association of Latino Elected Officials for his obnoxious letter today that attempts to paint D.A. King as something he most definitely is not. Gonzalez parrots the false statement making the rounds that Shawna Forde, who was recently arrested and charged with murdering two people in Arizona, including Brisena Flores, has ties to the Federation for American Immigration Reform (FAIR). FAIR denies any such links with Forde:

Again, you place a convicted felon and leader of a local hate group arguing to twist the U.S. Constitution into saying something that makes no sense. The wording of the 14th Amendment is very clear-all persons born on U.S. soil are U.S. citizens. The anti-immigrant birthright citizenship legislative initiative by U.S. Rep. Deal is a dead issue and should remain a dead issue.

Hate crimes against Latinos rose 40 % in the last several years, marking the fourth consecutive year of increases. The Leadership Conference on Civil Rights Education Fund issued a report a few days ago that faulted anti-immigrant rhetoric in the media and mobilization of extremist groups. The conference said that some groups advocating for tighter immigration laws, including the Dustin Inman Society, have utilized "the dehumanizing, racist stereotypes and bigotry of hate groups."

D.A. King is fanning the flames of intolerance and likely inciting violence with his dehumanizing language towards Latinos and immigrants. One month ago, extremist groups he associates with have murdered a nine year old girl, Brisena Flores, and her father to fund their extremist activities.

There's actually no mandate

When immigration activist and sanctuary beneficiary Elvira Arellano was arrested in Los Angeles and deported back to Mexico last month, claims of unfairness were leveled because she was being separated from her son, a U.S. "citizen." Similarly, Yaser Esam Hamdi, captured on the battlefield in Afghanistan and held in Guantanamo Bay, was transferred to Norfolk, Va., and treated as a citizen after it was discovered that he had been born in Baton Rouge, La., some 20 years earlier.

Most people in the country today take for granted the claims that Arellano's son and Yaser Hamdi are citizens. Mere birth on U.S. soil, no matter the parental status, is alone sufficient, according to the received understanding of the Constitution. This is true, they believe, despite the fact that Arellano's son was born while his mother was in this country illegally, and Hamdi was born while his parents were residing in the United States on a short-term work visa.

The Constitution does not actually mandate such a result.

To be sure, the Fourteenth Amendment guarantees citizenship to anyone "born or naturalized in the United States and subject to the jurisdiction thereof," but for those who drafted and ratified the clause, "subject to the jurisdiction" meant much more than mere territorial jurisdiction. Being born in the United States while subject to the political jurisdiction - the "I-pledge-allegiance-and-can-be-prosecuted-for-treason" type of jurisdiction - was required.

As Senator Reverdy Johnson of Maryland noted during floor debate at the time the clause was proposed, the citizenship clause simply provides "that all persons born in the United States and not subject to some foreign power . . . shall be considered as citizens of the United States." The author of the provision, Senator Jacob Howard, maintained that the clause "will not, of course, include foreigners."

Thirty years after the 14th Amendment was ratified, the Supreme Court expanded the constitutional mandate slightly, holding that the children of legal, permanent residents were automatically citizens, but the court has never held that the clause also confers automatic citizenship on the children of temporary visitors, much less on the children born to those who are in this country illegally. We have simply backed into that understanding, without consideration of the actual meaning of the citizenship clause or concern about the consequences to other constitutional text and principles.

One such principle is the idea of government by consent. Birthright citizenship permits some to demand citizenship unilaterally, without the consent of the political community in which membership is claimed. It is therefore incompatible with a system of government based upon consent of the governed and, when utilized by those who enter this country illegally, the rule of law as well.

The lessons learned by the "unilateral citizen" children of illegal immigrants are, unfortunately, not the principles of the Declaration of Independence and the Constitution, but rather those of a culturally separate underclass whose illegal residence among us all but assures a deep suspicion, rather than embrace, of our governing institutions and principles.

And the lessons learned by others - legal immigrants who patiently wait for their turn at a new life in America, for example- is a lack of respect for the rule of law that will ultimately threaten our entire system unless we get serious about removing the inducements to illegal immigration, including birthright citizenship.

Yes. Some exploit birthright citizenship to dodge deportation.

Georgia Rep. Nathan Deal’s pending legislation in Congress that would end the lunacy of awarding birthright citizenship to children born in the United States to illegal alien parents should have become law when he first introduced it six years ago. It should be passed into law now.

It won’t be. But the issue needs to be discussed.

One of the myths surrounding the 14th Amendment to the U.S. Constitution and the current convoluted misinterpretation of its birthright citizenship clause is that automatic U.S. citizenship is granted to every child born on American soil.

It is not. Doing so was never the intention of Congress.

Despite lawfully present parents, children born in the United States to diplomats and other public ministers of foreign nations are not awarded what is arguably the most coveted and valuable title in the world: “United States citizen.”

The fact that Deal’s reasonable and logical corrective legislation has near zero chance of passing speaks volumes on the power of the well-heeled lobby that has made a thriving industry out of the organized crime that is illegal immigration.

A result of the Civil Rights Act of 1866, the citizenship language in the 14th Amendment was intended to reverse the injustice of the Dred Scott decision of 1857 that, simply described, denied constitutional protections and citizenship to black Americans.

Before its ratification in 1868, Michigan’s Sen. Jacob Howard, author of the citizenship clause in the 14th Amendment, made the intent crystal clear to the Senate: “This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to ambassadors or foreign ministers accredited to the government of the United States, but will include all other classes of persons.”

The 14th Amendment to the Constitution was never meant to reward illegal aliens with the jackpot grand prize of becoming a parent of a new American citizen who would then serve as immunity and insulation from punishment for violating U.S. immigration laws, or as an “anchor baby” to gain access to welfare benefits.

It was passed before the nation had laws regulating immigration.
There were no illegal aliens for the mid-19th-century lawmakers to imagine or define.

The 21st-century reality is that in addition to taking in more legal immigrants than any nation on Earth, the United States also suffers more illegal immigration than any other country. Using Border Patrol apprehension statistics, Arizona Sen. John McCain estimated that in 2002 nearly 4 million illegal aliens entered the United States.

Upon capture, the belligerent defense from well-prepared illegal aliens who face deportation is the now standard “You can’t deport me; I have an American citizen child.” In today’s fading republic, enforcement of immigration laws is depicted as mean-spirited and “breaking up families.”

Many legal scholars have noted the disparity of the intention of the change to the Constitution and the end result of the amendment.

Writing on the history of the 14th Amendment in a 1997 edition of the Yale Journal of Law and the Humanities, for example, Emory University law Professor Polly Price accurately noted that “politically no one intended to accord equal citizenship rights solely on the basis of birth within the territory.”

With endless advocacy for open borders, expanding NAFTA to include the free flow of people, hordes of illegal border-crossers invading our nation and millions of “guest workers” being imported each year, continuing the practice of awarding automatic citizenship to their offspring is effectively taking the power and authority to control America’s future away from the American people and surrender it to the whims of alert foreigners who recognize a golden goose when they see one.

We are progressively making the terms “American citizen” and “sovereignty” meaningless.

No. Plain reading of 14th Amendment shows will of Americans.

U.S. Rep. Nathan Deal, who is also a Republican candidate for governor of Georgia, is proposing a measure in Congress to deny citizenship to the children of undocumented aliens who are born here. Deal proposes, by statute, to dispense with “birthright citizenship” — the rule that all people born in the territorial United States are automatically citizens of this country, regardless of the citizenship status of their parents.

But birthright citizenship cannot be changed by an act of Congress.
The automatic grant of citizenship to any baby born on U.S. soil is enshrined in the 14th Amendment to the U.S. Constitution. Any change to this constitutional command requires a constitutional amendment. A constitutional amendment requires a two-thirds majority vote in both houses of Congress and approval by three-fourths of the states.

The language of the 14th Amendment to the U.S. Constitution is clear: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” This is, in fact, the very first clause of the 14th Amendment.

Not only is the language clear, so are the Supreme Court precedents interpreting it. The 14th Amendment was added to the U.S. Constitution in 1868, after the Civil War. A few decades later, the Supreme Court ruled that the language meant what it said.

The 1898 case known as United States v. Wong Kim Ark determined that a person born on U.S. soil to Chinese citizens (who were present in the United States but unable to obtain citizenship by law) was nonetheless a citizen of this country. Arguments presented to the Supreme Court centered on the claim that the 14th Amendment applied only to former slaves of African descent. The Supreme Court easily rejected this argument, ruling that the 14th Amendment’s birthright citizenship provision was not limited by race.

That the Supreme Court has not had more recent occasion to revisit this ruling is due to the clarity of the language in the Constitution.

It is a tortured reading of the plain language (something “activist judges” are accused of doing) to conclude that the 14th Amendment does not mean what it says. Do the proponents of this statute actually claim that any child born here of noncitizen parents is not “subject to” our “jurisdiction,” as the 14th Amendment reads? If that person breaks a law, would the proponents insist that we could not put that person in jail?

The Republican Party believed it was necessary to amend the U.S. Constitution in order to change the rule of birthright citizenship during the Reagan and the first George Bush presidencies. At that time, the Republican Party’s platform called for a constitutional amendment on this issue.

The provision disappeared during George W. Bush’s first presidential campaign. The omission was an exercise of expediency, to court Hispanic voters.

The present attempt to change this long-standing constitutional practice by statute is new. It is no doubt a realistic acceptance of the difficulty of amending the Constitution. In the more than two-century history of our federal Constitution, only 27 amendments have been ratified. Ten of those amendments, the Bill of Rights, came into effect in 1791.

Whatever the merits of the proposal to change the rule of birthright citizenship, the way to do so is not through enacting a statute in Congress. Hearings on the proposal would no doubt shed light on the various policy considerations for and against the practice, but an effort to enact a statute on the subject would be a waste of Congress’s valuable time.

What is worse, Deal has said he is not optimistic that his proposal could become law unless it is “tacked onto another bill.”

This is not a matter for Congress alone. It is a matter for the American people. The 14th Amendment meant something when it was ratified. It means something now.
