Former U.S. Border Patrol agent Ignacio Ramos embraced his wife, Monica Ramos, two days before he was sentenced to 11 years in prison (El Paso Times)</TD></TR></TBODY></TABLE>
Mychal Massie, the chief of the nonprofit and nonpartisan Project 21 and a columnist for WND, is renewing his call to President Bush to pardon two former U.S. Border Patrol agents who were convicted and jailed for shooting at a fleeing drug smuggler.
The call from Massie, whose Project 21 has been a leading voice of the African-American community for nearly two decades, follows a guilty plea from Osvaldo Aldrete-Davila, the smuggler in the case involving agents Jose Compean and Ignacio Ramos.
Aldrete-Davila pleaded guilty yesterday in U.S. District Court in El Paso, Texas, to drug smuggling and is to be sentenced in July.
Compean and Ramos are serving prison terms for shooting at the smuggler while he was running back to Mexico in 2005, Massie's statement noted. Aldrete-Davila conspired to smuggle marijuana into the U.S. twice after he was granted immunity to testify against the agents.
(Story continues below)

"It is time to prove that he [Bush] places the welfare of American communities and those men and women who risk their lives to protect them over the welfare of lying illicit drug smugglers," Massie said. "Pardon Ramos and Compean now, Mr. President!"
The agents are serving terms of 11 years for Ramos and 12 years for Compean.
Aldrete-Davila yesterday pleaded guilty to possession of a controlled substance, conspiracy to import a controlled substance and conspiracy to distribute. The marijuana he admitted smuggling into the U.S. in 2005 came after he testified against Ramos and Compean under a grant of immunity from U.S. Attorney Johnny Sutton, who has been described by Bush as a "dear friend."
"It cannot be overstated that President Bush's stolid indifference thus far toward the suffering of these brave protectors of our borders and their families, while simultaneously seeking special dispensation for illegal immigrants, is unconscionable," Massie said. "Now it appears that the burden to be borne by agents Ramos and Compean for unknowingly wounding a now admitted drug criminal as he fled from justice across the border is going to be greater than that to be borne by the criminal himself.
"When the Bush Administration is seeking to protect polar bears from unproven global warming scare-mongering, to not pardon or at least commute the sentences of Ignacio Ramos and Jose Alonso Compean in light of these new-found truths will severely tarnish the Bush legacy," Massie said.
On Feb. 17, 2005, Ramos and Compean pursued Osvaldo Aldrete-Davila on foot after Aldrete-Davila abandoned a van containing 743 pounds of marijuana worth an estimated $1 million. During the chase, Ramos shot at Aldrete-Davila in the belief that Aldrete-Davila had drawn a gun of his own. Aldrete-Davila escaped across the U.S.-Mexico border, and Ramos assumed Aldrete-Davila was unhurt. In fact, Aldrete-Davila had been shot in the buttock.
Sutton later charged that Ramos and Compean violated Border Patrol policy by pursuing Aldrete-Davila without supervisor approval, moving spent shell casings and improperly reporting the fired shots. Aldrete-Davila was granted immunity to testify against the agents. Ramos and Compean currently are in solitary confinement in maximum-security prisons.
Their cases are on appeal before the 5th U.S. Circuit Court of Appeals.
The Ramos and Compean convictions have been questioned by many who point out that during the trial, jurors were not told of Aldrete-Davila's continued drug trafficking, and jurors also were unaware that a fellow agent who testified against Ramos and Compean is a life-long friend of Aldrete-Davila – a violation of Border Patrol policy in itself.
T.J. Bonner, president of the National Border Patrol Council, a labor union, testified before the U.S. Senate that a medical examination of Aldrete-Davila supported the agents' description of events and complied with Border Patrol and Justice Department policies. http://www.wnd.com/index.php?fa=PAGE.view&pageId=62014

A team of Mexican drug smugglers unloaded $1 million worth of drugs across the U.S. border, spraying bullets at U.S. Border Patrol agents with automatic weapons, but the agents dared not return fire – as one official said they fear losing their jobs or ending up behind bars like agents Ignacio Ramos and Jose Compean.
Ramos and Compean are serving 11- and 12-year prison sentences, respectively, for shooting an illegal alien drug dealer while he smuggled nearly 750 pounds of marijuana across the border. They were convicted of assault, discharge of a weapon in the commission of a crime of violence and deprivation of civil rights.
Send a FedEx letter to the president asking him to help Ramos and Compean.
This time drug smugglers wore military clothing and fired "military type" automatic weapons at U.S. Border Patrol agents and Immigration and Customs Enforcement personnel in Tuscon, Ariz., on Dec. 1.
The brazen smugglers backed a flatbed tow truck into an 18-foot border fence and unloaded two pickup trucks packed with marijuana into the U.S. as National Guard and U.S. predator surveillance cameras recorded their efforts, and Border Patrol agents were immediately dispatched to the scene.
When the agents attempted to stop the pickup trucks, a Chevrolet Avalanche and a Ford F150, the smugglers began driving back toward Mexico. However, U.S. authorities deflated the truck tires before the smugglers could make it to the other side, the Laguna Journal reported.
Just then, another vehicle was spotted in Mexico, and a sniper began firing an automatic weapon at the U.S. agents.
But agents did not fire back.
(Story continues below)

According to reports, additional heavily armed smugglers began scaling the border fence and tossing bundles of drugs from the Avalanche pickup truck into Mexico.
The agents refrained from discharging their weapons.
When authorities arrived on the scene, the suspects lit the Avalanche on fire and retreated to Mexico, leaving behind 1,158 pounds marijuana – worth $1 million.

</TD></TR></TBODY></TABLE>
Registration records revealed the F150 had been stolen in Douglas, Ariz. Mexican police were notified, but they have not arrested suspects.
Many witnesses, including U.S. scientists working in Arizona, report seeing heavily armed illegal aliens crossing border fences in the area. When U.S. agents arrive on the scene, smugglers often pelt them with rocks, strike them with vehicles or fire weapons at them – and agents sometimes face penalties for firing back.
In an incident similar to the Ramos and Compean case, one border patrol agent said he feared for his life after a group of illegal aliens began throwing rocks and concrete chunks at him in August at the San Ysidro border crossing. He fired his weapon and wounded one of the men in the buttocks.
Officials at the Mexican consulate in San Diego criticized the 10-year Border Patrol veteran and demanded the U.S. conduct a full investigation, the San Diego Union Tribune reported. Local police and the FBI investigated the agent.
"Any kind of shooting toward Mexican territory is rejected by the Mexican government," Consul General Remedios Gómez Arnau warned Border Patrol agents. "They should have waited for response of the Mexican authorities."
After this month's incident, an anonymous officer close to the investigation told the Laguna Journal that agents often fear defending themselves because shooting back could mean prison time – just as it did for Ramos and Compean.
"These men are still in prison for doing what many of us think was just doing their jobs as Border Patrol agents," he said.
Send a FedEx letter to the president asking him to help Ramos and Compean.
And sign WND's petition urging President Bush to free U.S. Border Patrol Agents Ignacio Ramos and Jose Compean.http://worldnetdaily.com/index.php?fa=PAGE.view&pageId=84287

neworleans1.jpg

New Orleans, La.
</TD></TR></TBODY></TABLE>
After the devastation of Hurricane Katrina, illegal aliens flocked to New Orleans from other U.S. cities to find work – but three years after the storm, the most violent city in America is festering with crime while schools are overcrowded and immigrant births are ballooning.
The New Orleans Economic Development office estimates the city's Hispanic population has more than tripled since Hurricane Katrina devastated the city. It has risen from 15,000, or 3.3 percent of pre-Katrina residents, to 50,000, or 15 percent of today's population.
Tulane University and the University of California, Berkeley, released a 2006 study revealing that almost half of the city's construction labor force was Hispanic. At least 54 percent were found to be illegal aliens, and 90 percent had lived elsewhere in the U.S. before migrating to New Orleans.
As WND reported earlier, News reports indicate a flood of illegal aliens is moving South from states such as Arizona and Oklahoma – where immigration crackdowns have made life more difficult for them, and the slow housing market has made jobs scarce. In New Orleans, families are multiplying faster than hospitals and schools can accommodate them.
Overcrowded hospitals and schools
The Associated Press interviewed Kevin Work, a doctor who opened new prenatal offices and hired bilingual employees so he could make a living delivering New Orleans' Hispanic babies.
He performs "thirty to forty deliveries a month," he said.
Work told the AP he has helped illegal alien mothers give birth to at least 1,000 babies since the storm hit in August 2005. He said he provides payment plans to help the families afford the births, or they are covered by government programs such as Medicaid.
In 2004, Emergency Medicaid cost taxpayers $1.7 million in Metro New Orleans, according to the report. Now the government program covers five times as many people, and the cost is more than 4.5 times what it used to be – at $7.8 million.
Likewise, schools are having trouble keeping up.
Director Melinda Martinez of a Esperanza Charter School, a taxpayer-funded English-immersion institution in New Orleans, told the AP her elementary school doesn't ask about immigration status.
In May, Esperanza Charter School teacher Judy Flores told Louisiana's WWLTV she would never inquire about whether her students were legal.
"If I knew, I wouldn't tell you," Flores said. "Whether you agree or disagree, politics and that situation is outside of what our job is; our job is to make sure our students learn and feel safe in our environments."
A full 60 percent of Esperanza students are Latino, while 30 percent are black and 10 percent are white. Each class has extensive waiting lists.
Margie McHugh, co-director of immigration integration policy at the Migration Policy Institute, told the Associated Press, "There's no place in the world like New Orleans in terms of how rapid the population change has been."
(Story continues below)

Soaring crime statistics
Meanwhile, the city's streets have reportedly become some of the most dangerous places in the nation. A study conducted by Congressional Quarterly recently labeled New Orleans the most violent city in the U.S. Likewise, Foreign Policylisted it as third among its top five "murder capitals" of the world – behind only Caracas, Venezuela and Cape Town, South Africa.
Though many studies have not linked New Orleans' crime surge to any specific cause, Foreign Policy attributes the city's high murder rate to "grinding poverty, an inadequate school system, a prevalence of public housing and a high incarceration rate." While New Orleans has always had high crime rates, there were 19,000 reported crimes and 208 murders in 2007 – up from the 134 homicides reported just before the storm. According to FBI crime stats, forcible rape and robberies were up substantially in 2007 as well.
Even during the city's legendary Mardi Gras celebration this year, four people were murdered and a dozen were wounded by gunshots, according to EMS Responder. Foreign Policy reports there has also been a surge of drug-related violence since Hurricane Katrina.
"Since the hurricane struck in 2005, drug dealers have been fighting over a smaller group of users, leading to many killings," it states."On just one four-block stretch of Josephine Street, in the city center, four people were murdered in 2007 and 15 people shot, including a double homicide on Christmas day. A precise murder rate is hard to pinpoint because the population is swelling quickly, approaching its pre-Katrina numbers. Whether you use New Orleans's own figures or the FBI's, however, the city remains the most deadly in the United States, easily surpassing Detroit and Baltimore with 46 and 45 murders per 100,000 people, respectively."
The New Orleans Times-Picayune tracks and maps the city's homicides. The 2008 map shows too many murder victims to count – most of the victims were shot to death.
Jose Campos, 37, from El Salvador, works in New Orleans and regularly wires money home. He told the Associated Press it is a rough place.
"Life is hard here, harder than any place I've been in the U.S.," he said. "It's a dangerous place, a bad place. But when you can find work, it's all worth it."

The breakup of the U.S.

<!-- begin bodytext -->In 1990, few were predicting the breakup of the Soviet Union.
But it came – only a year later.
With 2009 set to begin in a few days, there is someone predicting the breakup of the United States – a year from now.
His name is Igor Panarin, a former KGB analyst and the dean of the Russian Foreign Ministry's school for foreign diplomats – in other words, a serious fellow.
For him, it's nothing new. He's been making the same prediction for the last 10 years. But, until recently, no one took him very seriously. And then came the economic calamity that has rocked Americans and the rest of the world, too. Now, Panarin's predictions of an end of the United States, due to economic and moral collapse, is being taken seriously by many.
Panarin blames out-of-control mass immigration, economic decline and moral degradation for what he believes could be a civil war as early as next fall and a total collapse of the dollar. By June or July of 2010, he sees the U.S. breaking into six pieces.
Now, I'm not buying into Panarin's entire prediction. But I do think there's something to it.
(Column continues below)

I've been talking about this possibility more and more in recent years. I don't see how this house of cards we're building can possibly withstand the next significant windstorm. The political ties no longer bind. Only inertia and the threat of force hold us together.
The economic crisis is clearly visible to all – but all the wrong buttons are being pushed. In fact, the same people who got us into this mess are digging a deeper hole for all of us to climb out of.
The other two crises he points to have scarcely even been recognized by many people – out-of-control immigration and moral rot.
Nothing has been done to seal our borders, even though the American people have been screaming for it for years. The tidal wave of illegal immigration may have slowed only because of economic conditions. Nevertheless, we are a much less united country as a result of the influx of tens of millions of people welcomed here by a federal government gone mad.
As for the moral degradation, if you don't know what I mean, you're part of the problem. America's founders made it abundantly clear when they ratified the Constitution that it was a document that would only work for the governance of a religious people – folks who understood right from wrong and would, for the most part, govern themselves. Does anyone really believe America is still a country like that?
I don't.
But it doesn't mean I'm giving up on America.
Just the opposite.
I am fighting to preserve the kind of America our founders gave us.
It may be that we can only rediscover that kind of liberty with the breakup of the United States.
I'm open to that possibility.
I recognize, all too clearly, I have little in common with most Californians, for instance. That's what drove me out of that state after 20 years. But where can a freedom-minded constitutionalist go these days? There are no new worlds to discover. There are increasingly fewer states dominated by freedom-loving people.
That's why I have postulated over the possibility of a secessionist movement of like-minded people. I'm not talking necessarily about the grouping of states, like the Confederacy of old. Frankly, I don't see that happening. But what if there were one place – one state – that attracted people from all over the United States to come live in freedom?
Would you go?
I might.
If Panarin's theory proves even partially right, we may wish we started such a movement much earlier.

If you would like to sound off on this issue, participate in today's WND Poll. http://worldnetdaily.com/index.php?fa=PAGE.view&pageId=84884

FIRE Coalition is introducing easy access to the latest in illegal immigration news stories, editorials, blogs and legislative updates to all individuals that have expressed a commitment to fight for a sovereign United States of America.

The current election has solidified, empowered and emboldened the radical minority: ethnocentric groups, open borders lobbyists, globalists, the American big business/cheap labor lobby and corrupt elected officials.

Grass roots lobbying efforts are endangered. Be it a direct assault on our freedom of speech by legislating anew the Fairness Doctrine, regulation of the internet or the dissolution of the 2nd Amendment, patriotic Americans are facing the very thing our Founders railed against—a centralized, over-reaching and rogue federal government.

FIRE Coalition hopes the dissemination of immigration related stories will make it simpler for you to remain current with the rapidly changing landscape of the immigration debate as well as to allow you to easily inform others of the crisis threatening our national security and our independence as a nation.

The future of our children and grandchildren depends on a united majority of Americans, unafraid to exercise their First Amendment right to free speech.

We offer the FIRE Coalition Forum,
http://forum.firecoalition.com , for additional news on the illegal alien invasion of our country, immigration news from various states and current events of interest outside of illegal immigration. Issues that are important to me and my family, as I'm sure they are to yours, are also in the forum such as preservation of liberties, placing America first, and adhering strictly to the Constitution.

We invite you to actively join and participate as much as you wish through comments, postings of news stories, and any discussion of the same. Of course, many of you may wish to do more than just post, comment, and discuss. We are always looking for volunteer help on one of our many
projects, and for those of you without the time to volunteer, we hope that you'll consider donating to help us make the most of our all-volunteer staff and keep our projects effective and ongoing!

We must stand as a united voice against the Obama administration, most of Congress, the main stream media, the open borders/big business lobby and the minority radical ethnocentric groups funded by our own government with tax payer dollars.

God Bless and Keep up the fight!

Action Alert!!!

THE UNITED STATES CHAMBER OF COMMERCE IS ATTEMPTING TO END E-VERIFY BY LAWSUIT!

1) Call your local Chamber of Commerce and tell them to protest the lawsuit to stop e-verify filed by the United States Chamber of Commerce against the Department of Homeland Security.

To find your local COC contact information go to: http://www.uschamber.com/chambers/directory/default.htm?d=false Search alphabetically by name and click on the first letter of your city (or state) and you will find the listing for the local Chamber(s) in your city (or state). Both options are included. There will be email contact and phone numbers.

Let your local chamber know they are putting the security of America at risk, by encouraging a continuous flow of illegal aliens across our border. Businesses, with their demands for an unending supply of illegal cheap labor, are taking jobs away from the many out of work Americans during this terrible recession. Let them know over-burdened tax payers can no longer support the cost of cheap illegal labor for the profits of businesses!

2) Call your Senators and Congressman and tell them you support e-verify as a way of insuring the employment of out of work Americans.

To find the federal and state offices of your Senators and Congressman go to:
http://www.congress.org/congressorg/directory/congdir.tt

Let them know that the American people do not support the greed, nor the efforts, of the United States Chamber of Commerce to saddle the American taxpayer with the expense of illegal slave labor, in order to increase their profit margins! Americans must always come first and elected officials took an oath of office to legislate in favor of the American people--not business and not foreign workers!

<HR>Background Information:

The U.S. Chamber of Commerce and other business organizations filed suit against U.S. Homeland Security Secretary Michael Chertoff last week, complaining that the Homeland Security Department cannot legally require federal contractors to use its online worker verification database…”

The Bush administration issued an executive order requiring that federal contractors or subcontractors use the system. That has raised the ire of immigrant-rights advocates. The Chamber of Commerce filed a lawsuit in federal court just last week against the proposed expansion. Unless there is a court injunction, the expansion will take effect on Jan. 15, less than a week before Obama is inaugurated.
The United States Chamber of Commerce has repeatedly stood in opposition to the majority of the American people in regard to illegal immigration. They were a powerful voice in crafting the McCain /Kennedy comprehensive amnesty bill in 2007.

A spokesman for the U.S. COC lawsuit said, "The DHS intends to expand E-Verify on an unprecedented scale in a very short timeframe, and to impose liability on government contractors who are unable to comply. Given the current economy, now is not the time to add more bureaucracy and billions of dollars in compliance costs to America’s businesses." The U.S. COC has the audacity to complain about the cost to business of e-verify! The Chamber is willing to see you, the American tax payer, fund the benefits that illegal labor enjoys! At the same time, they insist that cheap illegal labor be allowed to take jobs from American workers in an epic period of joblessness!!!

1) American laborers are going without jobs so American businesses can remain profitable with cheap illegal labor.

2) The United States Chamber of Commerce is anxious to continue placing the burden of the costs of illegal immigration on the backs of the tax payers at the expense of our poor--even during this terrible recession.

3) Americans pay for the welfare benefits and the entitlements of illegal aliens, not only in states where this is sanctioned, but across the nation for criminal aliens who have stolen the identities of Americans. Many have multiple identities and obtain multiple benefits.

4) American taxpayers pay for the incarceration costs of jails and prisons and the prosecutorial and court costs of the numerous criminal aliens in our federal and state justice systems.

5) American taxpayers pay for the health care expenses of illegal aliens through emergency room visits, maternity and infant care, and indigent Medicaid state-funded clinics where immigration status is never asked! Our elderly find their Medicare payments slashed each year; at the same time hospitals are going bankrupt under the weight of illegal alien health care demands.

6) American taxpayer dollars build schools, roads, etc… for the illegal alien population. In addition, our children’s education suffers…time and money goes to children who cannot read or write in English.

7) Money is taken out of the local economies and remitted home to the families of illegal aliens in their countries of origin.

8) The Chamber of Commerce and related business have no compassion, or care, for the incalculable costs to the American crime victims of illegal aliens and their families. The cost cannot be measured either in suffering, or in dollars lost, as a result of identity theft, rape, pedophilia, robbery, murder, DUI and DUI death on our highways, etc…

It's time for American Citizens to say, "Enough is Enough!"

RI Judge Dismisses ACLU Lawsuit Defending Illegal Aliens

Friday, January 2, 2009, 10:45 AM

cops0102.png

A judge in Rhode Island has thrown out a lawsuit filed by the ACLU that challenged the detention of 14 Guatemalan immigrants that were pulled over for a minor traffic stop. The 14 immigrants were pulled over in Richmond, R.I. on Interstate-95, but all turned out to be in the country illegally.
U.S. District Judge Mary Lisi ruled that officer Thomas Chabot acted legally when he asked for all the men to produce identification, and when most of them couldn't, he then asked for proof of citizenship. When they still failed to comply, he contacted immigration officials. He was instructed to bring the men to the Immigration and Customs Enforcement offices in Providence.
In the judges ruling, she cited a 2005 Supreme Court ruling that found that "an officer did not need independent reasonable suspicion to question an individual about her immigration status during the execution of a search warrant." She added that inquiring about a person's immigration status did not infringe upon the fourth amendment rights that protect from illegal searches and seizures.
In the suit, the ACLU claimed that the state violated the Racial Profiling Prevention Act and that discrimination played a role in the traffic stop and arrest.
The ACLU is appealing the case.

H-1B's Negative Impact Goes Beyond IT and into Science and Academia

By Norm Matloff, Monday, January 5, 2009, 10:25 AM
picture-43850.gif
Most discussion of the H-1B work visa program focuses on IT, not surprising since the computer fields take a plurality of the visas. Yet H-1B's impact on science and academia is equally important, with the abuse being equally rampant (though, as with IT, fully legal). A piece by Beryl Lieff Benderley in Science Careers, a publication of Science Magazine, highlights this issue. It's startling but gratifying to see such a staid publication take such an un-PC, though correct, stance.
“H-1B holders' vulnerability to their employers' whims is only one of the many features of this controversial visa that attract sharp criticism. Just about everyone with a stake in the system—American engineers, scientists, and IT professionals; high-tech executives and their lobbyists; influential U.S. senators and the Department of Homeland Security--finds fault with the program's provisions, enforcement, or both.”
I've brought up the subject myself in various ways, most recently in connection with Douglas Prasher, the "almost-Nobelist" who is working as a van driver for a Toyota dealer. In a recent posting , I wrote…
“The 2008 Nobel Prize in Chemistry was awarded to Martin Chalfie, Osamu Shimomura and Roger Tsien for their work on green fluorescent protein (GFP). Douglas Prasher, who played a key role by discovering the relevant gene, and by contributing it to Chalfie and Tsien, was snubbed for the prize. Much worse, it turns out that he is currently not in science at all, working as a shuttle bus driver for a Toyota dealership in Alabama.”
In summary: Prasher's work was central to research that led to this year's Nobel Prize in chemistry, and one of the winners said he could well have been selected for the award himself. Yet he went through a series of jobs in science, with shorter and shorter duration and less and less security. In the end he was reduced to driving the van for a living.
The point is that Prasher is a victim of a crushing oversupply of scientists, in turn caused by a large influx imported from abroad under the H-1B program, just as Ms. Benderley describes. What Benderley probably doesn't know, though, is that all of this was deliberate. When the National Science Foundation was lobbying Congress to establish the H-1B program in the late 1980s, the NSF cited as a major goal holding down PhD salaries, which would be accomplished by flooding the labor market with H-1B PhDs. The NSF also noted that the low salaries would drive away American students from PhD programs, which is of course exactly what has happened. See Eric Weinstein's investigative reporting on this, at http://nber.nber.org/~peat/PapersFolder/Papers/SG/NSF.html and quotes of it, at http://heather.cs.ucdavis.edu/Archive/ForeignStudentGreenCards.txt.
Bottom line: The H-1B program is being used in academia for cheap labor, just like in IT. It's ruining the careers and lives of people like "Otto B. Doing-Better," even to the point of forcing a Nobel-level researcher into blue collar work to earn a living. And all this is occurring unseen behind the hype that "Johnnie can't do science" and the U.S. is on the verge of losing its technical edge.
Well, WHY is it unseen? Are Benderley and Weinstein and I really the only ones who know this? Of course not. Any academic with her eyes open knows it. Shirley M. Malcom, head of education and human resources at the American Association for the Advancement of Science, knows there is a huge oversupply of scientists, and surely understands the role of H-1B in it. She spoke of the oversupply on NPR (without explicitly mentioning H-1B).
But almost no one is willing to rock the boat, as the personal consequences would be severe. Though I must note that my own university has been remarkably tolerant of my gadfly writings on H-1B, even bestowing its Distinguished Public Service Award on me in part because of H-1B. But if for example Dr. Malcom had mentioned H-1B explicitly in that NPR segment, her days at AAAS likely would have been numbered, and she would have been blocked from obtaining other positions of that type. Greg Zachary of the Wall Street Journal wrote some great pieces on H-1B in the mid-90s, then later changed 180 degrees; why the change of heart? Several academics who have been strongly H-1B have in the last year or so come out in favor of expanding the employer-sponsored green card program, in spite of that program having essentially the same adverse effects as H-1B.
Hal Salzman, whose Urban Institute report is cited by Benderley, was on that show with Malcom, and he didn't mention H-1B either--in spite of the fact that he was the investigator on a 2001 congressionally-commissioned study which found that use of H-1Bs as cheap labor is rampant. Again, I believe that this reticence on his part is due to H-1B being a kind of Third Rail in the research world.
Meanwhile, those with huge vested interests in the program--academia, industry and last-but-not-least the immigration attorneys--have been flooding the press with PR, which is the source of the "Johnnie can't do science" perception. By the way, Benderley appears to be unaware that one report she cites, by NAP, was written by a researcher who has been quite partisan in favor of the industry and whose funding is suspected to come from the immigration lawyers group. See http://heather.cs.ucdavis.edu/Archive/NFAP.txt.
And these people, e.g. Google CEO Eric Schmidt, have Barack Obama's ear. Not coincidentally, Obama's Secretaries-designate of Commerce, DHS and Labor all are in favor of expanding H-1B and employer-sponsored green cards. Obama's own position paper, linked to in Benderley's article, might as well have been written by the industry, and may well have been.
And even though Obama's fellow senator from Illinois, Dick Durbin, has sponsored a good H-1B reform bill and Durbin was one of Obama's most active supporters in the election campaign, Obama doesn't seem to have been educated by Durbin very much, or worse, Obama sees that reform of H-1B is a political nonstarter. I'm sure the Durbin-Grassley bill will languish this coming year just as it did during the Bush years.
Voices like Lindsay Lowell, whose outstanding Urban Institute study with Hal Salzman, which is cited by Benderley, are lost in the shuffle. Though UI is well-respected in DC and is especially valued by Democrats, you could knock on doors on the Hill all day and not find more than one or two staffers who are aware of the Lowell/Salzman report. Similarly you could talk to all the science and business reporters at the New York Times and likely not find any who know about Lowell/Salzman.
Nor for that matter would you find congressional staffers who are aware of Congress' own findings, in two of its commissioned reports (the one by NRC that Salzman contributed to, as mentioned, and another by GAO), that H-1B is used widely as a means of cheap labor--as reported by the employers themselves. You might find some staffers who know of a recent DHS study that found a substantial percentages of irregularities (some fraudulent, most not) in H-1B applications, but that is missing the real point, which is that most abuse of H-1B for cheap labor is fully legal, due to the loopholes, as pointed out in the GAO study.
The sad truth is that Congress hears what the monied and powerful want them to hear. http://www.numbersusa.com/content/n...-goes-beyond-it-and-science-and-academia.html

<!-- begin bodytext -->Outraged at his low pay and uncompensated overtime, an illegal alien in Boston filed a complaint with the Massachusetts attorney general's office against a supermarket – and won his case.
The illegal alien from Guatemala spoke to the Boston Globe anonymously because he feared deportation.
"I was just collecting what was rightfully owed to me," he said in Spanish. "They already pay us a miserable amount of money. Why do they have to rob us?"
The alien spent years at a Super 88 supermarket seafood counter earning $6 an hour instead of the state's $8 an hour minimum wage. He grew frustrated as the supermarket did not compensate him for his overtime work.
One day, he decided to gather his pay stubs into a plastic bag and deliver them to a lawyer – who turned them over to the state attorney general's office.
To his surprise, Super 88 was ordered to provide back pay and fines of $200,000 to more than 300 workers, the Globe reported.
Illegal aliens now make up 17 percent of Massachusetts' workers – twice the state's 1980 workforce. Authorities have expressed concern that employers sometimes exploit illegals because they believe aliens will not report them to state labor authorities.
"It's a huge problem," Russ Davis, executive director of Massachusetts Jobs with Justice, told the Globe. "We really need some major way to address it, and if not, the economy in Massachusetts is going to spiral down into sweatshop conditions."
Super 88's owners are said to be Vietnamese immigrants who did were not aware with the state's labor laws. Now they are paying penalties and back wages and are subject to state monitoring.
(Story continues below)

According to the report, Attorney General Martha Coakley has staffed bilingual employees, allowed complaints to be filed in 90 languages and provided logbooks to nonprofit organizations to help illegal aliens track their hours.
Now state officials are implementing a no tolerance policy for companies that don't compensate illegals.
In November, 764 former workers at a New Bedford factory raided by U.S. immigration agents won an $850,000 settlement. The company was forced to pay overtime wages.
In May, C-Mart Supermarket in Chinatown was forced to pay $66,000 for not adhering to state minimum wage.
The seafood worker from Super 88, a father of five, said he worked 14 hours every day, six days a week since 2004 at the $6 rate. He said he applied there after his job painting houses for $10 an hour became too hazardous. He was working without a harness and standing on old ladders.
"It's like we're worth nothing," he said. "I was worried. But I was also worried about my family because I had to send them money."
According to the Globe, the attorney general's office never asks about a worker's citizenship status because officials claim their intention is to enforce state law – not federal immigration law.
Steve Kropper, cochair of Massachusetts Citizens for Immigration Reform, said illegals are not entitled to minimum wage because they are not citizens.
"No government resources should be devoted to the rights of people who are here illegally," he said. "They broke the law by being here. They had no right to the job." http://worldnetdaily.com/index.php?fa=PAGE.view&pageId=85432

Reid Alert

Reid Signals Intention to Push INCREASE in Foreign Workers

Wednesday, January 7, 2009, 10:40 AM

reid0107.jpg

On the first day of Congress, Senate Majority Leader Reid introduced the "Stronger Economy, Stronger Borders Act" (S. 9), suggesting his intention in the first months of the new Congress to push through some version of amnesty and immigration increases.
Exactly what the bill will do is left open. Sen. Reid (D-Nev.) introduced the bill as a shell to serve as a place holder until he decides what the legislation will be. But this does not bode well for American workers who must compete against imported authorized foreign workers and against uninvited illegal workers. For weeks, Reid has told the news media that he intends to push for an amnesty for 11-19 million illegal aliens in the country and to greatly increase the number of foreign workers legally brought into the country.
The filling of S. 9 on Tuesday shows that Sen. Reid is serious.
Perhaps one piece of good news is that Reid introduced 10 placeholder bills and that the immigration one was No. 9. Since three bills are about economic recovery, one on mortgages, one on energy, one on national security, one on health care and one on reviewing Bush's "midnight regs," we can hope that immigration won't be first up to bat.
On the other hand, American voters may want to push Reid and others in the Democratic leadership to fill their "shell bill" with immigration reform that suspends the illogical importation of 140,000 foreign workers each month.

A Message from FIRE....
If you are like me, every day brings more concerns about the future of our sovereign nation. While we have been effective in some areas as a coalition of outraged patriots and groups, we are losing time and events are spiraling out of control.

Consider these recent events...

A $700 billion dollar bailout of the corporate elite is passed using threats of martial law despite the overwhelming opposition of the American public.

The so-called president-elect is awaiting inauguration day despite not having proven he is a a natural-born citizen, flaunting the supreme law of the land (Article II, Section 1 of the U.S. Constitution)

These events prove two things:

1) Our elected ""representatives"" no longer represent our interests. 2) Our government no longer feels the need to abide by a Constitutional form of government. They'll do what they want to do and ignore the laws they don't like.

It is for these reasons that I ask each and every one of you to re-commit right now to doing all that you can to reverse the course our nation is on. The FIRE Coalition is committed to keeping you informed about the important issues and suggesting action items for you to participate in.

It is also very important for you to contact the FIRE Team Leader near you or State Director in your State to ask them what you can be doing to help. You can find their contact information at http://www.FIRECoalition.com/fireteams.

Thank you, and let this be a very productive New Year to us all. Our childrens' futures depend on it!

Did you know....
Taxpayers each year spend more than $7 billion to educate the children of illegal aliens, $1 billion for health care and emergency treatment, and nearly $3 billion to detain illegal aliens in state and local jails.

Call your local Chamber of Commerce and tell them to protest the lawsuit to stop e-verify
“The U.S. Chamber of Commerce and other business organizations filed suit against U.S. Homeland Security Secretary Michael Chertoff last week, complaining that the Homeland Security Department cannot legally require federal contractors to use its online worker verification database…”

<A href="http://cts.vresp.com/c/?FIRECoalition/a147b73cd7/4adf43c9cd/ae4bf0d068" target=_blank>Business groups sue over Homeland Security E-Verify program

(
http://www.firecoalition.com/forum/yaf_postst3886_Business-groups-sue-over-Homeland-Securi ty-EVerify-program.aspx)

“The DHS intends to expand E-Verify on an unprecedented scale in a very short timeframe, and to impose liability on government contractors who are unable to comply,” Johnson said. “Given the current economy, now is not the time to add more bureaucracy and billions of dollars in compliance costs to America’s businesses.”

Obama to face critical immigration test early

(http://www.firecoalition.com/forum/yaf_postst3881_Obama-to-face-critical-immigration-test- early.aspx

The United States Chamber of Commerce has repeatedly stood in opposition to the majority of the American people in regard to illegal immigration. They were a powerful voice in crafting the McCain /Kennedy comprehensive amnesty bill in 2007.

Now the U.S.

  • American laborers are going without jobs so American businesses can remain profitable with cheap illegal labor.
  • The United States Chamber of Commerce is anxious to continue placing the burden of the costs of illegal immigration on the backs of the tax payers at the expense of our poor--even during this terrible recession

Americans pay for the welfare benefits and the entitlements of illegal aliens, not only in states where this is sanctioned, but across the nation for criminal aliens who have stolen the identities of Americans. Many have multiple identities and obtain multiple benefits.

American taxpayers pay for the incarceration costs of jails and prisons and the prosecutorial and court costs of the numerous criminal aliens in our federal and state justice systems

American taxpayers pay for the health care expenses of illegal aliens through emergency room visits, maternity and infant care, and indigent Medicaid state-funded clinics where immigration status is never asked! Our elderly find their Medicare payments slashed each year at the same time as hospitals are going bankrupt under the weight of illegal alien health care demands.

American taxpayer $$$ build schools, roads, etc… for the illegal alien population. In addition, our children’s education suffers…time and money goes to children who cannot read or write in English.
  • Money is taken out of the local economies and remitted home to the families of illegal aliens in their countries of origin
  • The Chamber of Commerce and related business have no compassion or care for the incalculable costs to the American crime victims of illegal aliens and their families. The cost cannot be measured either in suffering or in dollars lost as a result of identity theft, rape, pedophilia, robbery, murder, DUI and DUI death on our highways, etc…

ACT NOW AGAINST THE ATTEMPT BY THE UNITED STATES CHAMBER OF COMMERCE TO END E-VERIFY!!!

Call your local Chamber of Commerce and tell them to protest the lawsuit to stop e-verify filed by the United States Chamber of Commerce against the Department of Homeland Security

Let your local chamber know they are putting the security of America at risk by encouraging a continuous flow of illegal aliens across our border. Business, with their demands for an unending supply of illegal cheap labor, is taking jobs away from the many out of work Americans during this terrible recession.

Let them know over-burdened tax payers can no longer support the cost of cheap illegal labor for the profits of businesses!

You Don't Speak For Me
You Don't Speak for Me formed when Col. Al Rodriguez became fed up watching media coverage of the mass protests of April. ""Their leaders were saying it was a march for immigrant rights and a Latino/Hispanic movement,"" says Rodriguez. ""I thought to myself, 'Hey, those are illegal aliens, not immigrants!'"" Col. Rodriguez began speaking out to others saying, ""I'm of Hispanic ancestry and those people are acting like they speak for me. Well, you don't speak for me!""

We are Americans of Hispanic heritage who believe in America. We believe in the governmental institutions and laws that make this country the greatest in the world. It is because of this strong belief in the principles of freedom, individual liberties, the rule of law, and democracy that we formed You Don't Speak for Me!: American Hispanic Voices Speaking Out Against Illegal Immigration. For more information: http://dontspeakforme.org ; http://webmailbb.juno.com/webmail/n...gStatus=all&count=1231371541&content=central#

FIRE Coalition leads by example in second half of 2008
How I spent my summer vacation is what people might have thought of as September rolled around, but not the FIRE Coalition. Our members and partners were too busy fighting the largest invasion in world history for such folly. Besides outstanding state and local efforts by our many partners, our national staff was very active, from coast to coast. In-between a two-day national security convention in Denver in late August and another in Orange, California in mid-October, FIRE Coalition National Director Jeff Lewis traveled to Kentucky, Illinois, Minnesota, California, South Carolina, Connecticut, New York, North Carolina, Pennsylvania, and West Virginia. You'll find some of what Jeff was up to in the FALL 2008 Brush-FIRE Report. If you want to know why he's on FIRE, read Article IV, Section 4 of the U.S. Constitution. Read Sections 3 & 4 of the 14th Amendment, and read the Fall 2008 Brush-FIRE Report linked below. Get involved in 2009. We only have to lose our nation once, and its gone forever! For more information: http://firecoalition.com/docs/fallbrushfire2008.pdf ; nationaldirector@firecoalition.com

Workers from India to change pleas
Associated Press

December 17, 2008 - 12:07 PM

FARGO, N.D. - Twenty-three ethanol plant workers from India who face illegal immigration charges faced federal court hearings Wednesday to change their pleas. Their supporters say they are victims of a human trafficking scheme, and they plan a 24-hour fast and prayer vigil.

Hearings were scheduled Wednesday afternoon in Fargo for some of the workers and next week for others.

Attorneys would not comment on specifics of the plea changes. The workers earlier pleaded not guilty to charges of possessing counterfeit immigration documents and false representation of Social Security numbers.

The 23 were arrested in October at an ethanol plant being built near Casselton. Their supporters say they came to the U.S. to help after Hurricane Katrina in 2005. Prosecutors have said they were aware of the trafficking case but had no further comment.

Saket Soni of the Workers Center for Racial Justice, who announced Wednesday's fast and vigil, said the co-called "Cass 23" are not criminals.

"What we want is for ICE (the federal Immigration and Customs Enforcement agency) to release these workers and for these workers to stay in the United States as witnesses in a federal investigation so that the traffickers are brought to justice," he said.

In Minnesota, Rep. Keith Ellison and religious leaders announced they would join the fast to support the workers.
