Legislation is finally moving through committee (a) to mandate E-Verify nationally, (b) to take away the ability of illegal aliens to use stolen identities to steal American jobs, (c) and to begin opening up hundreds of thousands of construction, manufacturing and service jobs for unemployed Americans.

A few minutes ago, the "mark-up" (the process of considering amendments and voting out the bill) was announced to start Thursday morning.

Now is the time to pour every bit of activism you can give to helping Members of the U.S. House of Representatives Judiciary understand why they must pass this bill.

New Bill Number for Lamar Smith's "Legal Workforce Act"


Since Rep. Smith (R-Texas) introduced this bill early in the year (as bill number H.R. 2164), he has gotten a lot of feedback and made enough changes to decide to re-introduce the bill under a different number.

INCLUDES A NEW PROVISION TO HELP STATE AND LOCAL ENFORCEMENT OF IMMIGRATION LAWS

All the basic elements that we've described in the past are still in the bill (despite huge efforts by powerful forces to water it down).

But this bill has a wonderful addition.

The bill creates an office within ICE Immigration and Customs Enforcement (ICE), whose sole purpose is to respond to -- and investigate -- state and local governmental agency complaints about businesses hiring and/or employing illegal immigrants.

This new office is required to respond within five business days of the filing of the complaint.

Attorneys General, prosecutors and other state and local officials who believe they see a pattern of a business employing illegal aliens will have a direct line to ICE with a guarantee of rapid response. As these complaints will be a matter of public record, failure of ICE to obey the law will provide direct evidence for congressional hearings into Administration misfeasance.

Fortunately, another office of this type that has been operating as a complaint desk on another immigration matter has a reported high degree of complaince by the feds and satisfaction by state and local officials.

Rep. Lamar Smith (R-Texas) is the Chairman of the Judiciary Committee. Major forces have attempted to get him to keep postponing the moving of this bill. We had campaigned hard to get a vote in committee before the August recess. We are ecstatic that Chairman Smith has made this bill such a priority and is moving this so soon after Labor Day.

Debate Over Mandatory E-Verify Continues Next Week

Call House Judiciary Members And Urge Them To Preserve State Enforcement Authority!

Today's scheduled mark-up of Rep. Smith's mandatory E-Verify bill (H.R. 2885) only made it through opening statements by House Judiciary Committee members before adjourning until Wednesday of next week. H.R. 2885, also called the "Legal Workforce Act", requires all employers nationwide to use the E-Verify system to verify the work authorization of new hires.
Amendments on the E-Verify bill are expected next Wednesday when the House Judiciary Committee reconvenes. While FAIR has always supported mandatory E-Verify, we are asking our members to call members of the House Judiciary Committee and urge them to either delete or amend the preemption provision (Section 6) of the bill. As currently written, that language would strip away the authority of state and local governments to go after employers that hire illegal aliens.
In today's hearing, True Immigration Reformer Congressman Steve King (R-IA) praised Chairman Lamar Smith (R-TX) for "laying the foundation" for an E-Verify system, but said preemption was "the number one issue" that must be addressed in this bill. Rep. King said the federal government is unwilling to enforce immigration laws, and urged the Committee to restore the authority of state and local governments to enforce our immigration laws when the federal government fails.
Meanwhile, Representative Dan Lungren (R-CA) told committee members that he would have a hard time supporting the mandatory E-Verify bill if the Committee doesn't also adopt a sweeping expansion of the agricultural guest worker program. He argued that reforming the H-2A program alone is insufficient and that an entirely new program is necessary to meet the needs of agricultural employers. Lungren claimed that anyone who suggests American workers can perform all the needed agricultural work simply does not understand agriculture. The House Judiciary Committee is expected to mark up Rep. Smith's agricultural guest worker bill immediately after it marks up the mandatory E-Verify bill.
The House Judiciary Committee will meet again on Wednesday of next week to debate and amend the E-Verify bill. Please call members of the Judiciary Committee NOW and urge them to restore the ability of state and local governments to enforce our immigration laws! Tell them:
  • You want a mandatory E-Verify law that is enforceable by both state and federal authorities.
  • State and local governments must be able to enforce our immigration laws when the federal government refuses to do so.

Enter Your Zip Code After introducing a new version of the bill Monday, the House Judiciary Committee announced that on THURSDAY it will mark up the “Legal Workforce Act” (now H.R. 2885), a bill that would require all employers nationwide to use the E-Verify employment eligibility verification program
While FAIR has always supported mandatory E-Verify, we are asking our members to take action to ensure the committee adopts important improvements to the bill. As introduced, Section 6 of H.R. 2885 (entitled “Preemption”) would eliminate the authority of state and local governments to revoke the business licenses of employers who knowingly hire illegal aliens. This language will invalidate many state immigration enforcement laws, undo the Supreme Court’s recent decision in Chamber of Commerce v. Whiting, 536 U.S.__ (2011), and impede the ability of states to penalize employers who profit off cheap illegal labor.
Members of the House Judiciary Committee can solve this problem by striking Section 6 and replacing it with language that allows the states to go after employers who hire illegal aliens—a right now recognized by the U.S. Supreme Court!

Lamar Smith’s bill not only requires employers to use E-Verify, but it also substantially increases the penalties for businesses that violate our laws. A number of amendments will be offered in committee, but at this point, we anticipate that a strong bill will emerge.

While we understand that there are those who would like to see an even tougher bill, we believe that this legislation is an important step to fix our broken immigration system.

Three PA trucking school leaders plead guilty in CDL fraud case

The International Training Academy offered to train potential truck drivers, and rent them tractor-trailers to take the FMCSA CDL Skills Tests.
The trucking school even provided interpreters for drivers to help them take the CDL Knowledge portion of the exam in their native language.
As it turns out, the trucking school also provided customers with fake residency documents to satisfy PENNDOT requirements and even helped them open illicit bank accounts. The interpreters also gave CDL candidates answers to the exam as they were tested.
Vitaliy Kroshnev, Tatyana Kroshnev and Tair Rustamov each pleaded guilty Sept. 8 to one count of conspiracy to produce, and aiding and abetting the production of identification documents. Vitaliy Kroshnev also pleaded guilty to an additional count of false statement.
The defendants were scheduled to face trial Sept. 9.
Seven others have been charged in the case, which allegedly included CDLs being issued to more than 400 “unqualified individuals.”
The case was investigated by the FBI, with assistance from the Federal Motor Carrier Safety Administration and the Pennsylvania State Police.
In July, Land Line reported about a state bill in Pennsylvania that would require English-only CDL testing.
That bill remains in committee.

Our Immigration Ad Runs During Nationally Televised Debate the Day After National E-Verify Passes Through Committee

Obviously, the news of the week was the House Judiciary Committee's passage of Chairman Smith's national E-Verify legislation. (Read all about it here.) But the immigration issue also made a big splash during last night's GOP Presidential Hopefuls' debate on FoxNews.
During the first commercial break of the night, we ran a 30-second ad linking the impact of America's current legal immigration policy to unemployment. The timing was perfect since the candidates were asked questions about how they would handle unemployment just before the ad ran.

Unfortunately, the candidates weren't questioned about legal immigration during the debate, but the moderators did spend 12 minutes on immigration. The immigration segment was also moved to the first hour of the debate after landing in the second hour during the first three debates. You can read my blog to see what the candidates said.
Perhaps the most important result of the ad was forcing the nation's political reporters who were watching the debate to actually hear and see that somebody believes LEGAL immigration is a jobs issue and needs to be reduced. Roy says that from the phone calls he has gotten thus far from reporters, the ad apparently was shocking to many journalists. One reporter asked Roy how he justified such an "extreme" position. Roy notes, "The first step in moving a political idea into the possibility of solution is to get it into the public where it can shock people and even be ridiculed. Because national political leaders and mainstream media won't raise the subject, we have to find ways to inject it into the public square where we begin to de-sensitize the resistance so the solutions can be considered on practical merits."
Another success last night came when former House Speaker Newt Gingrich was asked if he supported Chairman Smith's national E-Verify law. Not only was the content of the question a win, but as part of the debate format, viewers were able to send in video questions via YouTube. The question posed to Gingrich was submitted by FAIR. In the coming days, we'll update our Presidential Hopefuls' Grid with some of the new statements made by the candidates.
What's Next?: Many of you are probably asking what comes next now that Chairman Smith's Legal Workforce Act passed through the Judiciary Committee.
When the bill was introduced, it was also referred to the House Ways & Means Committee because of the Social Security Administration provisions in the bill. Those of you that have Reps. on that committee will be receiving action alerts in the near future. The rest of you will soon see new faxes posted on your Action Board urging your Reps. to support the bill when it reaches the House floor.

Wednesday, September 21, 2011The House Judiciary Committee passed Chairman Lamar Smith's Legal Workforce Act on Wednesday afternoon 22-to-13. Only two amendments were approved by the committee, including one offered by Chairman Smith himself. The bill, H.R.2885, would require all employers to use E-Verify within 2 years for all non-agricultural new hires, while requiring federal, state and local agencies to check current employees as well within 6 months.

ALIPAC's prediction that "Rick Perry Is Finished" went viral on the web and in the media this weekend. This has led to the group announcing plans to protest outside of Rick Perry events in an effort to forewarn voters about Perry's numerous efforts to support the illegal immigrants and encourage illegal immigration.

Rick Perry's support levels have fallen dramatically since he reaffirmed his support for in-state tuition subsidies for illegal immigrants, legislation he signed into law in Texas which is opposed by 81% of Americans of all races and parties according to recent national polling conducted by Rasmussen Reports. Perry accused opponents of in-state tuition for illegal immigrants of being heartless.

ALIPAC has helped to defeat similar legislation in 20 states in the last six years starting with the dramatic defeat of HB 1183 in North Carolina in 2005.

"This was Rick Perry's 'Dukakis moment' when he told the over 80% of Americans who opposed his radical support for illegal immigrants that they were heartless for opposing the replacement of their own children with illegal aliens in our limited seats in college," said William Gheen, President of ALIPAC. "How many tens of thousands of innocent American students have been denied the limited seats in the colleges of their choice thanks to Perry's incentives for illegal immigrants?"

A few states like Texas snuck the in-state tuition for illegal immigrants legislation into law with a shortage of media coverage or political opposition. Since ALIPAC has formed, media coverage and organized activist opposition has led to defeat for such legislation in most states except for Maryland and Wisconsin, where there are active efforts to repeal the bad laws.

ALIPAC believes Rick Perry is unfit to be President of the United States because of his recent promotion of in-state tuition for illegal aliens, Perry's choice to side with President Obama and Mexico against Arizona's SB 1070 illegal immigration bill, and Perry's opposition to significant border fencing. Rick Perry also supports commercial Mexican trucks rolling freely into the US without adequate inspection and "bi-national health insurance" between American and Mexico.

While Perry touts the fact that Texas is one of the few states to create jobs recently, a Center for Immigration Studies report proves that 81% of these new jobs in Texas have been filled by illegal and recent immigrants instead of suffering American citizens.

"If Perry becomes president he will continue the radical and treasonous open borders agenda pursued by Obama, Bush, McCain, and the other servants of the globalists," said William Gheen. "Can you imagine an economic recovery where Americans in all states watch 4 out of 5 new jobs be given to legal and illegal immigrant labor? We must continue to protest Perry to assure that every American voter is warned."

ALIPAC is asking Republican and Tea Party groups across America to identify Rick Perry campaign events and fund raisers, and to arrange protests designed to bring more attention to Rick Perry's unpopular positions in support of illegal immigration.

Democrat State Senator Richard Moore and Republican State Senator Bruce Tarr have co-authored a massive illegal immigration enforcement bill in Massachusetts that the two lawmakers hope will come up for a vote during the current session. The bill would deny illegal aliens access to in-state tuition, overturn Gov. Deval Patrick's policy by requiring the state to join Secure Communities, and punishes employers who hire illegal aliens. Rick Perry Campaign Caught Trying to Censor Opposition

At least one official member of Rick Perry's campaign for President asked Facebook to censor and remove an online ALIPAC invitation asking Americans who oppose in-state tuition for illegal immigrants to protest outside of a Perry fund raiser in Charlotte, NC on Thursday.

Americans for Legal Immigration PAC (ALIPAC), the group reported widely in the national media predicting that "Rick Perry Is Finished" after stating his current support for in-state tuition for illegal immigrants during the last debate, has called for a protest outside of Rick Perry's $1000 per plate fund raiser at the San Antonio Modern Mexican Restaurant in Charlotte, NC. 11:30am-1:30pm Thursday, September 29, at 4331 Barclay Downs Dr.

ALIPAC created a Facebook event invitation last night to invite the group's thousands of online supporters on Facebook to attend.

This morning, ALIPAC captured screen shots proving that Clint Cox, who is the Washington State social media coordinator for Americans for Rick Perry's Super Pac 'Americans for Perry', used the 'Report' feature to ask Facebook to delete the event.

The Facebook report feature asks users to report postings for harassment, Scams, 'Hate Speech', Violence, or Sexually explicit content. Once the reporter selects one of those options they can then notify the target of their protest.

William Gheen, President of ALIPAC, received two copies of reports from Perry Campaign operative or employee Clint Cox and from a Christine "Chris" Warren that state, "I found this event offensive. Please remove the event or content posted that may potentially be harmful."

As documented in the screen shots ALIPAC is releasing today, William Gheen responded to Mr. Cox saying, "This is a political event and your attempt to have Facebook censor our event because you disagree is reprehensible."

Clint Cox then replied "Your a liar and deserve to be censored...people are on to you!"

Americans for Legal Immigration PAC calls on Rick Perry to direct his campaign supporters or employees to not engage in censorship and false accusations on behalf of his floundering campaign.

"Americans who represent the 81% of US Citizens found in Rasmussen Reports polling to oppose Rick Perry's in-state tuition for illegal aliens subsidy have a right to speak out, assemble, and protest his events and stances without attempted censorship," said William Gheen. "The fact that an official member of Americans 4 Rick Perry tried to have our Facebook event deleted claiming we were "harassment, Scam, 'Hate Speech', Violence, or Sexually explicit content" is very inappropriate."

Shortly after these false reports were filed by Rick Perry's campaign, William Gheen was blocked from inviting his remaining Facebook friends to the event.

The Des Moines Register reports that Rick Perry's wife is in Iowa today trying to limit the damages to his campaign by excusing his recent support for in-state tuition for illegal aliens.

"Anita Perry also defended in-state college tuition for the children of illegal immigrants, saying the Texas Legislature thought it was a choice between educating the youths or having them go on welfare. "

Americans for Legal Immigration PAC opposes both welfare benefits and in-state tuition for illegal aliens as do hypermajorities of American citizens.

"Texas should not be giving welfare or college tuition to illegal immigrants," said William Gheen. "The fact that Rick Perry and his wife support both are strong reasons for GOP voters to reject his candidacy."

According to Zogby polling, Rick Perry's support levels have dropped 19% in reaction to his comments during the recent debates.

Rasmussen polling released today indicates that "...a plurality (44%) says Perry is not qualified for the job."

Americans for Legal Immigration PAC will protest Rick Perry's fund raiser in Charlotte tomorrow and then call on GOP, Tea Party, Patriot, and Immigration Enforcement groups across America to protest every Perry event they can to warn voters of his unpopular support for illegal immigration.

Rick Perry’s Border Problem
If he won’t use E-Verify, he can’t complain about lax immigration enforcement.

Rick Perry stumbled through much of the last Republican debate, but not when speaking about immigration. He issued a clarion condemnation of critics of his state’s policy of giving the children of illegal immigrants in-state tuition to college. Such naysayers, Perry declared, lack “a heart.”
The Texas governor prides himself on his distinctness from George W. Bush, yet on this issue he sounds just like him: scolding his party for its lack of compassion for immigrants coming here to make a go of it. If Perry had wanted to avoid raising the hackles of Republicans with the imputation of heartlessness, he could have borrowed the staple Bush line: “Family values don’t stop at the Rio Grande.”

Neither, more relevantly, does the desire to find a job. What Perry portrays as the great American job machine in his state has mostly benefited people who aren’t Americans, according to a new study by the Center for Immigration Studies. This significant caveat to the Texas Miracle raises the larger question of why the country has continued to welcome millions of new immigrants during the past few years while shedding millions of jobs.
In Texas, the study finds, 81 percent of the jobs created since 2007 have gone to immigrants who arrived in the [COLOR=#216221 !important][COLOR=#216221 !important]United[/COLOR][/COLOR] States since 2007. Ninety-three percent of these immigrants aren’t citizens. An estimated 50 percent are illegal immigrants. All of this may be further testament to the status of Texas as a jobs magnet, but Perry won’t be bragging about this indication of its drawing power.
In this same period, the native-born accounted for almost 70 percent of the population growth in Texas. They didn’t experience the same gains in [COLOR=#216221 !important][COLOR=#216221 !important]employment[/COLOR][/COLOR], though. “The share of working-age natives holding a job in Texas declined significantly,” the study finds, “from 71 percent in 2007 to 67 percent in 2011.” In the second quarter of this year, the unemployment rate for natives in Texas, 8.1 percent, ranked 22nd in the country, and the share of natives holding a job, 66.6 percent, ranked 29th.
If providing ready [COLOR=#216221 !important][COLOR=#216221 !important]employment [COLOR=#216221 !important]opportunities[/COLOR][/COLOR][/COLOR] for non-Americans seems awfully cosmopolitan for the man who is supposed to be a famous rube from Paint Creek, it’s the Texas way. The unpleasantness of the Alamo aside, the Lone Star State has always had a close relationship with its neighbor to the south. And a wide-open attitude is good politics. In welcoming all comers, Perry can do the bidding of a business community that wants the immigrant labor and simultaneously appeal to the Hispanic vote. If anyone should think to complain that he’s soft on illegal immigration, well, now, that’s why God created the pointless gesture, isn’t it?
Perry can ostentatiously send Texas Rangers to the border and lambaste the federal government’s failures, but none of it matters if it’s relatively easy for illegals to find a job. Another border state, Arizona, implemented the E-Verify system requiring employers to check the immigration status of prospective employees. It led to a dramatic reduction in the population of illegals, many of whom have, no doubt, decamped to Texas. So long as he doesn’t implement E-Verify, Perry is shooting holes in the hull of the U.S.S. Enforcement and demanding that the feds bail faster.
It would be much too simplistic to say that every new immigrant employed in Texas took his job from a native. On the other hand, it would be much too Pollyannish to deny that there must be crowding out, especially of natives who don’t have a college degree. At least Texas has been creating jobs. The country has lost about 7 million jobs since the onset of the recession in 2007 and continued to import another 1 million new [COLOR=#216221 !important][COLOR=#216221 !important]immigrant [COLOR=#216221 !important]workers[/COLOR][/COLOR][/COLOR] a year, and 200,000–300,000 illegal immigrants on top of them. In August, monthly job growth ground to halt, yet we’re welcoming some 100,000 new immigrants a month.
Is it heartless to wonder why this makes any sense?
