I believe it's far more complicated than simply this. I agree with you, there is little debate the players are in violation of this provision and this would be the league/owners number one leg to stand on. I will caveat, I'm not an attorney, but I was bouncing this off a few legal resources at our firm, one of which specializes is employment law. They pointed to three areas of recourse for players if they were terminated and/or suspended for anthem protests.
1.) Apparently the CBA does have wording indicating an employee can not be terminated due to their political views. It's a gray area, and possibly a losing one for players, but still an area they could attack.
2.) Although the players could/would lose their appeals over termination/suspension they could argue certain violations of the CBA and employment contracts that could allow them to be paid thier full contract, including non-guaranteed monies.
3.) The league/owners could open themselves up to discrimination/EEOC suits. For example, if a team only cut a few players that protested and not all, the players terminated would have a suit that is almost a guaranteed winner against the team. If the team cut all players who protested and other teams didn't, the terminated players could have a suit against the league.
I'm sure I butchered some of that, but that was the gist of what I heard.
