1) Does Harry have language in his agreement allowing him to opt out with no repercussions? Doesn't sound like it.
2) Can he prove the agent is negligent? Don't know. Hard to prove.

If you don't have those two items in your favor and the real estate company held you to your word, its a legally binding contract and you'd lose in court. Don't know what else to tell you.

The animals I refer to are the people you rented to...I simply think your buddy was trying to be nice and did not want to tell you what a dump you had after these animals moved out and he thought the market was hot enough to get you out of a jam and he may have failed...Selling your house could mean the difference of making his own mortgage next month so he has no reason to fuck you over...Tell him you are not happy and if he is a good friend he will let you out and then be brutally honest and tell you that fucked up by trying to be a landlord and jeopardized the future sales in the neighborhood by renting to scum that you probably would not have lived within 5 miles of...I see it everyday and complain about it to the landlords here,as I am association president...I would think you are not an HOA,so of course that part does not apply to you...I mean no disrespect to you either....

I didn't rent it to "unknown animals", it was a friend of mine who was my roommate. He was actually on a rent-to-own but opted out when he decided he wanted to move out of state.

Dude is a slob. What can I say? He was a great tenant for 4 years that never missed rent once and even laid out to put in new carpet and do some painting before he moved out.

Yes when it is 100% paid off and he has spent 50k in repairs...Real logical...Almost as smart as spending 700.00 or whatever it was on a Christmas tree....

Of course my comment was some people rent to animals that they would in no way live within 5 miles of... In other words people rent to people that they would not want to live next door too in order to make a couple hundred bucks a month...So you will lose 10k either by repairs or loss of value each time you rent it out to scum and slobs...I honestly feel for you and hopefully lesson learned,but trying to blame on realtor is wrong in my opinion at 100k at 7% he is looking at 7k and if he is not selling agent he still at 3500.00...Not chump change...Good luck and like I said if he is true friend he will let you out and let you know what may have went wrong...

What lesson is that? You're painting this picture that I thought it would be cool to play landlord and make a few bucks for doing nothing, and now I'm getting burned. That is so far from the truth.

The truth is the realtor hasn't done jack shit to sell my home, and has been downright negligent in ensuring that it was show-ready before confirming appointments that were initiated by buyers' agents. He literally put the home on Zillow with a canned description and moved on with his life. That is not what I'm paying 8k+ for. I have a valid beef here. I'm not blaming him that the house was in disrepair. I'm blaming him for OK'ing the showings to begin while the house was in an abhorrent condition, filled with 8 bags of trash and fucking filthy.

Maybe we aren't getting showings because he isn't doing shit to market it.
Maybe the showings we do get aren't converting into offers because the place looks like shit.

Part of the reason I'm paying him to be my eyes and ears. He knows I was willing and able to do anything that needed done to get the house ready, as far as paying to have it cleaned, etc. He has clearly dropped the ball.

second, if he won't then call his broker with your concerns.
third, if no satisfaction then contact the local board of realtors with your complaint
and consider arbitrating for damages incurred.
fourth, once you get rid of your realtor then interview two or three successful
local realtors on the phone. let them tell you their marketing strategy,
experience in your neighborhood, and get a feel for their ability to negotiate
a contract and successfully monitor an escrow. get references if in doubt
and insist these references are from difficult escrows and/or negotiations; not
the slam dunk sales. hope this helps.

Enfuego bought a 120k house once and he read on the internet that all contracts are iron clad and legal binding. Especially, Realtor fucking contracts. So....that's that!! Lmfao

HC, not too much to add. Spoke w/ the Mrs this morning and she reiterated what some others said...speak to the broker and demand to be let out of the agreement or at the very least insist on another Realtor from the agency. She did want me to ask why the heck you agreed to pay 7%?

There are several here that are in real estate, and probably many that have had bad experiences with realtors.

Why are you so negative? I think it's a good place to come for guidance on this.

Problem with all that is that it all takes time. We've already lost 30 days, I would like to avoid losing any more.

I was told 7% is standard, and all realtors in the area wanted 6-8%.

I have asked for the contract to be redrawn at 5% commission and a 60 day exclusivity, and if not I asked them to drop the listing.

Contract is binding unless there is language in the agreement allowing you to opt out or if you can prove the agent is negligent.

Prove me wrong.

You are technically correct, but you're missing the point.

The point is, that while the contract is in fact legally binding, no realtor in their right mind is going to take you to court to enforce it if you have ample reason to want them off the listing. They would almost always prefer to voluntarily drop the listing and avoid the negative pub. Especially on a 125k house.

I'm going through something similar.

I left on a cruise on July 30th, and I get a text from my tenants at my rental house saying they're not paying August's rent, and
they are moving out that weekend. Grrr. Thanks for the notice assholes.

Then, when I get back from the cruise on Aug 4th, I call him to set up a meeting to get the keys from him, and do a walk-through,
he says he needs more time to clean. I meet him a couple days later, and there are piles of garbage by the curb, and the garage
is full of garbage - I mean full. He gives me the keys and he says he's going to come back to clean. The place is a disaster,
he clearly is not getting any of his deposit back - but the fuckers smoked in the house, and I believe in 6 years never vacuumed the
carpet once. It will all need to be replaced. The assholes lived like total pigs. It's party my fault, as I didn't do checkups on them.

The last thing I noticed that really pissed me off, is that I put a brand new A/C unit in there 2 years ago (probably 4-5 grand) and
he assured me he was replacing the filters every month. I looked, and the fucker didn't even have a filter in there, he threw the
last one out, and was too cheap to pay the $1.99 cost for a new one, and put my new A/C unit at risk.

The only good news out of the whole thing is that the realtor says the house is worth 30K more than I thought, so I'm putting
the thing on the market, and I'm done with fucking scumbag tenants. Q!@#@$%^#$#^$%#&^%#$#

Oh, and the bastard never came back to clean. I hope someone calls me some day for a referral on him.
