My realtor sucks ass - what's my recourse?

All communication with your friend needs to be documented through email. Send him an email tonight addressing your concerns and dissatisfaction. Allow him to respond within a said time frame. Once he does and its still not to your satisfaction then i would contact his superior by phone call then follow up with an email. Long story short you can fire them. His higher up will get involved because they will have to rescind the contract and remove themselves as the listing agent on MLS.

go right to the owner broker..whomever ....

and explain the incompetence of said person...

they don't want bad press....

again....I have fired 3 people and got great results afterwards....

Yeah so if I say "here is why I'm dissatisfied...blah blah blah...I no longer feel that 7% commission is commensurate with the effort or lack thereof that has gone into marketing the property at the critical stage of the sale. The commission needs to be dropped to 5% or............."

That's the problem I'm having. I don't have any leverage because of the contract.

My understanding is the best I could do to "stick it to him" is refuse to do a price drop and tell him he has to get a full-price offer in order to get paid. Which probably won't happen, and I'll continue paying double mortgages until November, and then have a stimatized property that has been on the market for 5 months, have to find a new realtor, and start over. Doesn't sound like a win for me.

Well Harry, I've been in this situation too.

Selling a house using a proxy essentially. You have to ask yourself and figure in the financials. Do you want to get the house sold or let your pride stand in the way? Double mortgages stink. Pay what you have to pay to get the house in pristine condition and have someone inspect it for you. Tell the agent he's an asshat and you want to work with another agent inside the agency and cut him off while maintaining the integrity of the contract.

No you can't. You're describing something different than what I said. You can't rip up the contract and sign with another agent because you're unhappy. Can you work with another agent within his company? Sure.

More worthless fucks have adopted that profession than one can count. All but 1 realtor that I have ever worked with were lazy, dumb, and self-serving. Any imbecile can get a license.

So I'm going to write an email outlining my dissatisfaction. Essentially my thought is the first step is to tell them I'm pissed, and give them a chance to make it right. I will explain that I expect a more thoughtful and aggressive marketing plan moving forward. I want daily updates telling me what they are doing to sell my house. And I want to re-negotiate the commission.

In y'all's opinion does that email go to the realtor friend? Or his boss? Or both?

His boss is actually listed as the listing agent, although I have never met him.

Any termination options in contract? Might be better to eat the fee, take house off of market and start with a clean slate.

You can absolutely fire your Realtor. They won't just remove themselves from MLS without a valid reason, but HC has a list of reasons. They will try to retain the listing, but that's where the emails come in and talking to his friends boss.

Sure, you can fire your agent but you described the contract being rescinded because your pissed off at the agent. You can't just rescind a contract.

HaHa...Homeowner rents their place to animals and finds everything they worked for basically destroyed...I see this 20 times a week and 1/2 of those times are close family members...Do you really think realtor does not want to sell your house? After all they do work on commission right? Since he was a childhood friend or whatever I would say he only wanted to help out and if you don't like him let him know and he will probably let you out and let you know what a dump you have and letting animals(the supposed humans) you don't know live in your investment was not a very good choice...I laugh at the people in my neighborhood that like to play landlord and spend 10k every time these beast move out and I try to explain the math to them and they are too stupid to figure it out....500.00 mortgage 175.00 hoa.50.00 insurance.100.00 property tax=825.00 and they rent for 1100.00 and they think they have struck it rich when in reality they let someone live there to make 275.00 which would take 3.5 years just to break even and then the stupid motherfuckers turn around and rent it out again...

Dude, you butted in in post #21 as if I said you can't fire an agent and hire a new agent within the same company. You can do that.

I was responding to Bourn's post in #15 where he said if you're unhappy you can simply rescind the contract which isn't true.
