i bet matchups for the derby, was fading roadster. looked like a 4-0 sweep before the overturned result. sucks he dropped all the way to 17th, as roadster finished 15

The owners of Maximum Security plan to file an appeal with the Kentucky Horse Racing Commission, contending that their horse should be declared the rightful winner of the 2019 Kentucky Derby, owner Gary West told the "Today" show on Monday.


Maximum Security will also skip the Preakness, West said.


"We are going to file an appeal today with the state racing commission," West said. "Right after the race, I had the trainer call the stewards and very nicely ask them if they would be willing to visit with us after the races were over. I said, 'We'll stay here until 11, 12 o'clock at night, whatever you want,' and they said, 'Absolutely not, we won't be showing the films until Thursday.' We didn't really have any alternative legally ... the appeal has to be filed within 48 hours."

Maximum Security was disqualified from first by the racing stewards and placed 18th in the 145th running of the Kentucky Derby on Saturday. It was the first disqualification due to race riding in the history of the event. The stewards took 22 minutes to declare runner-up Country House the winner after deciding that Maximum Security interfered with several horses when he drifted out from the rail on the final turn.


"It was literally like the old TV show, 'the thrill of victory and the agony of defeat,' all within a 22-minute period of time," West said. "Winning it was the most euphoric thing I have probably ever had in our lives and disappointment when they took the horse down for the first time in history, we were stunned, shocked and in total disbelief. It had never been done before."


KHRC does not actually allow for an appeal, so West is likely racing an uphill battle. According to the rules: Stewards are responsible for "all findings of fact as to all matters occurring during and incident to the running of a race," and "findings of fact and determination shall be final and not subject to appeal."

Marc Guilfoil, executive director of the Kentucky Horse Racing Commission, also backed the stewards on Sunday in an interview with Blood Horse magazine. West said this is a particularly unique circumstance.

"I think this is something that's big enough that the entire racing world is looking at this, and I think they deserve an opportunity to really know what was going on," West said. "I was a bit shocked and surprised that the stewards wrote a statement that was probably prepared by their lawyers and refused, literally refused, to take questions from the media. So they've been about as nontransparent about this whole thing as anything I've ever seen in my life."


West said he understood that his horse came over in front of another horse, but he said that's going to happen in such a big field of horses. The Kentucky Derby allows 20 entrants, the biggest field in North American thoroughbred racing.


"You shouldn't have 20 horses in the Kentucky Derby. Churchill Downs, because they're a greedy organization, has [20 horses] rather than 14 like you have in the Kentucky Oaks, the Breeders' Cup, every other race in America. Just because they can make more money, they're willing to risk horses' lives and people's lives to do that. I'm not a fan of that. I think you should have 14 like every other race ...


"Yes, I saw the horse move out, but every Kentucky Derby, you could set down two or three or four horses if you wanted to, because it's like a rodeo out there."


West also said he found it strange that the stewards did not file a stewards' inquiry. While stewards can file their own inquiry after the race if they see fit, in this situation, the jockeys of Country House and 17th-place finisher Long Range Toddy both filed objections against Maximum Security.


"They looked at exactly what the rest of the world looked at, and they didn't file a stewards' inquiry. So I can't imagine it was very obvious to them at the time, either."


The only legal precedent requiring a Kentucky Derby disqualification came in 1968, when Dancer's Image won and was disqualified several days later after trace amounts of a then-banned drug was found in his system.


The owners of Dancer's Image went to court to contend that he should be the rightful winner. The legal battle dragged out several years, and while they initially won their case, it was overturned on appeal.

West is right, you can disqualify several horses in every 20 horse derby field ......what will it be like in the following years......will jockeys call objection every year.

Time for Churchill to lower the field to 14 horses, 20 horses is too big. The payouts for us bettors is better with 20 horses, but who can handicap what the stewards or whenever they choose to enforce certain rules.

this one hurt hurt hurt - but im at piece with the ruling to be honest. War of Will could have got first second or third, Long Range maybe should have taken 4th or 5th, and even Bode was effected. it was pretty bad how the horse MAX moved over so many lanes at least 5 wide, and then back over to the rail and happy nobody was injured or horse/jockey falling. One for the ages...

Kentucky Derby shuts down Maximum Security appeal, owner strikes back




LOUISVILLE, Ky. — The Kentucky Horse Racing Commission didn’t take long to deny the appeal of Maximum Security’s disqualification as Kentucky Derby winner for interference, saying hours after it was filed Monday that the stewards’ decision is not subject to appeal.

The commission’s letter to attorney D. Barry Stilz, who filed the appeal of behalf of owners Gary and Mary West, also denied a request to stay the disqualification ruling pending appeal.

West said he was disappointed by the KHRC decision, but added the matter is not settled.

“Based on everything that has happened so far, I’m not surprised,” West told The Associated Press in a phone interview after the appeal was denied. “We’ll file suit in whatever the appropriate court is. I don’t know the answer to that, but the lawyers that I have retained will know what the appropriate venue is.”

Racing stewards disqualified Maximum Security after Saturday’s Kentucky Derby and elevated Country House to the winner’s circle following objections filed by two jockeys. Stewards determined Maximum Security impeded the paths of several horses in the race.

Maximum Security is the first Derby winner disqualified for interference in the race’s 145-year history.

The KHRC’s decision can after West’s legal team filed the appeal to the commission based in Lexington, Kentucky. The owner has acknowledged that the legal proceedings could take “months, if not years, down the road.”

The only other Derby disqualification was in 1968, and long after the race. First-place finisher Dancer’s Image tested positive for a prohibited medication, and Kentucky racing officials ordered the purse money to be redistributed. Forward Pass got the winner’s share. A subsequent court challenge upheld the stewards’ decision.

West also has said he would not run Maximum Security in the May 18 Preakness in Baltimore. Acknowledging the horse’s removal from Triple Crown consideration because of the disqualification, the owner said there is “really no need” to run a horse back in two weeks.”

This has created a black eye for horseracing.

Today I read that 6700 seats at Pimlico will go unused because they are unsafe. WTF!!!

Why wasn't this race moved from Pimlico if they can't accommodate the fans?

The Triple Crown is such a magnificent thing. Sullied very badly this year. Hope they get their act together very quickly. I love horse racing.

This was a horseshit DQ call. War Of Will started this whole thing when riding up and trying to get to a space that was not there causing the horses to clip and that is why MS veered out. If this was any other day of racing, the 1 would have been DQ'd and/or Tyler would be getting days for careless riding.

Found out too late probably. Will still be over 130,000 there.

It feels weird that the best horse in the derby won't be at the Preakness defending his win.....Country House certainly wasn't anywhere near as good as Max Security.

I wonder if Country House will win another race this year........

BAS i am shocked you said this. i know you are a long time harness guy and have watched tens of thousand of races. You are 100% wrong. War of Will has his position on the track. He absolutely did not go where there was no room. it was a small miracle that the horse didn't go down.
i am glad to be able to tell you that you are wrong considering where you were health wise a few months ago. i was worried for you. Best of health to you but you are wrong on this one.

Country House out of Preakness Stakes in Triple Crown debacle




There will be no Triple Crown winner this year.

Controversial Kentucky Derby winner Country House will not be running in the May 18 Preakness Stakes after developing a cough, trainer Bill Mott told the Daily Racing Form on Tuesday.

“He developed a little bit of a cough this morning,” Mott told the paper by telephone. “His appetite is good. He doesn’t have a fever. But he’s coughing. We drew blood. He’s acting like he’s going to get sick. He’s off the training list, and if he’s off the training list, he’s off the Preakness list.

“It’s probably a little viral thing. Hopefully it doesn’t develop into anything serious. Usually when something like this happens, a horse misses a couple weeks of training. He’s not seriously sick right now. But he’s showing indications that something is going on.”

Country House was the beneficiary of Maximum Security’s disqualification at Churchill Downs after stewards ruled he illegally cut off challengers. Maximum Security’s owner, Gary West, told the “Today” show on Monday that his horse would not race at the Preakness Stakes with the Triple Crown no longer in play.

Country House developed the illness after winning the Derby and has yet to leave Churchill Downs, Mott said.

The run of Triple Crown bad luck started before the Derby when favorite Omaha Beach was scratched with a lung problem days before the race.
