Not the same because they physically served someone. The more apt analogy would be if they went after someone who told another person "you should go get drunk", and then continued to encourage that person to go get drunk, and then he goes and gets drunk and dies in a car crash.

I don't know but thats one hell of an example. I wouldn't want to be that guy.
Someone like that would be charged with something I would imagine.

I think there is a case pending right now in California where a hooker helped a Google exec get loaded on heroin and he died. What they're charging her with is failing to render aid after he collapsed from an OD.

I saw that too. Dont they have her on video cleaning the place up and walking out calmly.

Hell, I don't think she even cleaned up. Think she helped shoot him up, sees him OD then drinks his wine and steps over him to look for money and more drugs. She had no clue whatsoever how much trouble she was in.

What law did she break? This is not a loaded question, I really don't know.

The prosecution thinks it meets the elements of the crime of involuntary manslaughter.

If I drive the getaway car after my friend robs a bank and kills somebody in the process, I get charged with and convicted for a crime even though I never pulled the trigger or entered the bank.

I know it's not the same, but I'm just giving an example of not having to have a direct roll in a crime and still be held liable.

Having said that, I think the prosecutor has an uphill battle.

He got out of the car and she told him to get back in.

She already has been charged, my opinion is she will cop a plea and not spend any jail time.
The family will sue her in civil court and have a judgement against her.

Several things need to be looked at on how & if they go thru with prosecution, do they want to make an example of her........there are people sitting in jails all across the country doing 10 years just for introducing someone to a connect for drugs, etc.......if they wanna make an example of her, they can throw the book at her while creating a new law in the process.

No one said life is fair......we live in a screwed up world with screwed up politicians that make screwed up laws.

I have to find the link, but a child was suspended from school for making the symbol of a gun with his hand Luke we used to as kids, & said bang bang........kid & his parents have to go to counseling I believe, lmao.......our world is off its rocker when we think that child that made that hand gesture is a danger to other kids & to the community.

If she doesn't accept a plead deal or isn't offered one, her family will go broke defending her

It will be interesting to see how this plays out. If I was a prosecuter I would probably be licking my chops to try this case because of the precedence it could set for future cases like this. It would be a nice feather in their cap if they won. I'm betting it will be the defense asking for any plea deal.

Jesus Christ man. Driving a getaway car for a guy you know was going to commit a felony is having a direct role in the commission of a felony.

They aren't remotely the same thing. What the kid did is not a crime in any state.

I mean, I get why a getaway driver is always charged as well when a felony is committed. Totally get it.

This girl is a psycho but she did not participate in the commission of a felony. I mean, the boy didn't even commit a crime. She's getting charged when absolutely no crime has been committed.
