Very Important for you to be aware of a new bill HR 45 introduced into the House. This is the Blair Holt Firearm Licensing & Record of Sale Act of 2009. We just learned yesterday about this on the Peter Boyles radio program.
Even gun shop owners didn't know about this because it is flying under the radar. To find out about this - go to any government website and type in HR 45 or Google HR 45 Blair Holt Firearm Licensing & Record of Sales Act of
2009. You will get all the information.
Basically this would make it illegal to own a firearm - any rifle with a clip or ANY pistol unless:

*It is registered.
*You are fingerprinted.
*You supply a current Driver's License.
*You supply your Social Security #.
*You will submit to a physical & mental evaluation at any
time of their choosing.
*Each update - change or ownership through private or
public sale must be reported and costs $25 - Failure to
do so you automatically lose the right to own a firearm
and are subject up to a year in jail.
*There is a child provision clause on page 16 section 305
stating a child-access provision. Gun must be locked
and inaccessible to any child under 18.
They would have the right to come and inspect that you are storing your gun safely away from accessibility to children and fine is punishable for up to 5 yrs. in prison.

Peter Boyles is on this and having guests. Listen to him on KHOW 630 a.m. in the morning. He suggests the best way to fight this is to tell all your friends about it and "spring into action". Also he suggests we all join a pro-gun group like the Colorado Rifle Association, hunting associations, gun clubs and especially the NRA.

This is just a "termite" approach to complete confiscation of guns and disarming of our society to the point we have no defense - chip away a little here and there until the goal is accomplished before anyone realizes it.
This is one to act on whether you own a gun or not. If you take my gun, only the criminal will have one to use against me.
HR 45 only makes me/us less safe. After working with convicts for 26 years I know this bill, if passed, would make them happy and in less danger from their victims.

Interesting because Ive been thinking of buying a handgun & getting a concealed carry permit for it....Im already fingerprinted because now for homeland security to get a CDL with Haz Mat you have to get fingerprinted & checked...Now more red tape for guns....Im sure some of the more frequent readers of this thread would be interested in your info also...RR

As a result of ICE enforcement around the country, Americans have been taking the jobs that used to be done by illegal workers. In Tarheel, North Carolina, enforcement has resulted in probable unionization and a huge victory for the American worker. In Mississippi, out of work Americans lined up for jobs that used to be done by illegal workers. Hull commented, “Worksite enforcement works. Why would we want to stop opening up jobs for Americans when 11 million of our neighbors and friends need those jobs?”

Hull also pointed out that the Senate removed E-Verify from the recently signed stimulus package. E-Verify would have helped ensure Americans get the jobs fueled by the Stimulus package. E-Verify was included in the original Stimulus Bill passed in the House but was removed in the Senate and never made it back into the bill in the conference committee. Hull commented, “The stimulus is supposed to stimulate job growth for American workers. Without E-Verify, our tax dollars could be stimulating jobs for illegal workers who send their money out of the country. That won’t help American workers pay their mortgages.”

Hull is optimistic about the President continuing worksite enforcement actions, “I hope President Obama will decline the suggestions of Congressman Gutierrez,” stated Hull. “I know the President is trying to create more jobs for Americans, not give them away.”

Sens. Mikulski & Specter's H-2B bill multiplies less-educated foreign workers to keep less-educated Americans unemployed

Latest data reveal 1.6 million American young adults (18-29) with only a high school degree who are looking for a job but can't find one. Yet, Sens. Mikulski and Specter have introduced a bill to double or triple the visas for less-educated foreign workers over the next three years to compete against those unemployed young Americans.
And 24 Senators have already co-sponsored the bill.
It is my unfortunate role to regularly tell you of supposedly august public officials who seem totally unaware of the unemployment disaster befalling the American people.
Do Mikulski and Specter hate lower-educated and less sklled American young adults?
Or do the wads of contributions from greedy corporate lobbyists just make it impossible for them to see the struggles of our national community's most vulnerable members?
YOUNG AMERICANS NEED JOBS

One problem is that most Senators are rich and primarily hang around with other rich people. They can't imagine their own kids making beds, waiting tables, running a cash register or checking passes at ski lifts.
In short, most Senators apparently cannot even see the 15.1 million young American adults (18-29) who have no more than a high school diploma and whose job prospects are heavily in the service industry.
Today's excellent report from the Center for Immigration Studies shows a lot of young adults who might love to have the jobs that Mikulski and Specter are insisting on giving to imported foreign workers:
  • 1.6 million young adults with only a high school diploma are unemployed, looking for work but unable to find any kind of job.
  • Another 291,000 of them are looking for a full-time job and have had to settle for part-time hours.
  • Yet another 477,000 teens (16-17) are officially unemployed, actively seeking a job.
But Mikulski and Specter can't imagine that somewhere between 66,000 and 300,000 jobs primarily in vacation and resort locations can be filled from among those 2.4 million Americans.
They have introduced S. 388, which would explode a cap of 66,000 H-2B work visas a year. The bill would allow any foreign worker who has used an H-2B visa to take a job from an American in the last three years to be brought back in over the next three years without counting against the 66,000 cap. Potentially, the number of H-2B visa workers could multiply two, three or four times.
Wouldn't you think that under our unemployment crisis, Senators would suspend the H-2B program instead of expanding it?
WOULD JOBLESS AMERICAN YOUNG ADULTS TAKE A 4-MONTH JOB?

Mikulski and Specter argue that H-2B visas are necessary to fill peak labor needs for amusement parks, ski resorts and other hospitality and entertainment functions. To them, young Americans would have no interest in working in resort/vacation locations since the full-time jobs tend to last only 3-6 months.
Certainly, their reasoning is true for some of the 2.4 million aforementioned young Americans looking for work. But only one out of eight of them would have to be interested to take care of all the needs of providing recreation primarily to American's affluent citizens.
In addition, there is another giant pool of potential workers that I haven't mentioned.
More than 3.8 million young American adults (18-29) with only a high school diploma are not even in the labor market right now. They are not listed as unemployed. Many of them have given up looking for work. Others have chosen not to work for various reasons. But four or six months of work in a vacation location might be just the thing they are looking for.
Dr. Steve Camarota, author of the CIS report, notes:
The difficulty that young workers are experiencing is particularly worrisome because it is as young persons that people learn the skills necessary to function in the workplace, such as showing up on time, following supervisors’ instructions, and interacting with customers. There is evidence that people who are poorly attached to the labor force in their youth tend to stay that way throughout their lives.
SPECIAL INSULT TO BLACK AND HISPANIC AMERICANS

Sens. Mikulski and Specter's actions are especially insulting to Black and Hispanic American who are suffering catastrophic unemployment rates.
The CIS report finds that the official unemployment rate ...
  • is 13.6% among U.S.-born Hispanic young adults with high school diplomas
  • is 20.2% among Black American young adults with high school diplomas
  • is 31.6% among Black American teens (age 16-17)
  • is 40.3% among U.S.-born Hispanic teens (age 16-17)
These rates are for Americans who aren't in jails or other institutions.
Yet, about a quarter of U.S. Senators have already signed on to Mikulski and Specter's attempt to shut these and other unemployed Americans out of the resort and vacation industry jobs.
I hope you will go to our Action Buffet and let your Senators know what you think about this sad, sad sell-out of America's most vulnerable young adults.

NumbersUSA is proud to endorse H.R. 878 and to salute you for your leadership in once again trying to enact what we believe is the single most important change needed in our immigration policies.
The Nuclear Family Priority Act would put the emphasis of family immigration where it belongs – on spouses and minor children.By ending chain migration of adult relatives and in-laws, H.R. 878 would bring about more economic justice to America’s most vulnerable citizens, a better quality of life to Americans whose daily lives are becoming too congested and regimented, and more opportunity for our grandchildren to live in individual liberty and environmental sustainability.
In introducing H.R. 878, you are operating in the spirit of bi-partisanship and compassionate change that seemed to be high on the wish list of Americans last fall. Ending chain migration was one of the top recommendations of Democratic leader Barbara Jordan when she chaired the U.S. Commission on Immigration Reform. She concluded that chain migration serves no compelling national interest while harming the Americans who most need our help.
While ending chain migration would directly reduce overall immigration by around 1.2 million a decade, it would eventually and indirectly lead to an even larger decline in other categories.
The creation of the chain migration categories has been the primary reason total authorized immigration has skyrocketed from 2.5 million per decade to 10 million.
Chain migration was recklessly put into our immigration system 50 years ago. At first glance it seems relatively harmless as it allows immigrants to bring in not only their spouse and minor children but also their brothers, sisters and adult children. But that starts a chain that cannot be stopped. Each of those adult relatives can bring in his/her spouse, leading to the mother-in-law, father-in-law, brother-in-law and sister-in-law. All of that leads to the immigration of the Anchor Immigrant’s cousins, aunts, uncles and the in-laws of the in-laws of the in-laws.
The result of all this uncontrolled migration is that at age 233, our nation is undergoing its biggest population explosion ever, leading to massive loss of natural habitat and farmland, and to flooding American occupations with excess labor that increases unemployment and depresses wages.
Thank you again for leading on this long-overdue step while declining to raise the greencards in any other category.

Indiana Senate Committee Approves Immigration Crackdown

An Indiana Senate committee approved a bill that would punish employers who repeatedly hire undocumented workers. The bill now moves to the Senate floor for a full vote.
The proposed legislation would prohibit employers from knowingly employing illegal aliens and would require state and local governments, and their contractors, to use the federal E-Verify system to check the workplace eligibility of new hires. While some private employers would be required to use E-Verify, the most significant provision of this legislation is the establishment of an administrative complaint process (individuals can file complaints with the state attorney general) that could lead to a business-license suspension or revocation for those found to have knowingly hired illegal aliens.
Companies that use E-Verify, however, are provided safe harbor against such administrative actions. The bill also bans sanctuary policies, requires state correctional facilities to check the immigration status of inmates, and mandates the use of the federal Systematic Alien Verification for Entitlements (SAVE) system to verify eligibility for public benefits. http://www.numbersusa.com/content/n...committee-approves-immigration-crackdown.html

Louisiana Rep. Rodney Alexander and Arkansas Rep. John Boozman were among the 19 original cosigners when Rep. Phil Gingrey introduced H.R. 878 (Nuclear Family Priority Act) earlier this month.

Rep. Rodney Alexander has earned a recent grade of an A+ from NumbersUSA. Rep. John Boozman has a recent voting record of an A+ as well.

The current annual limits on greencards are 65,000 adult brothers and sisters, 23,400 married sons and daughters and 23,400 unmarried adult sons and daughters. H.R. 878 would eliminate all three categories and not provide an increase in any other category, thereby decreasing overall immigration by 111,800 per year (1.118 million a decade).

A federal jury on Tuesday afternoon ruled that an Arizona rancher did not violate the civil rights of 16 Mexican nationals he detained at gunpoint after they had snuck illegally into the United States in 2004, but the jury awarded $78,000 in actual and punitive damages to six of the illegal immigrants on claims of assault and infliction of emotional distress.

After a nine-day trial, the eight-person jury -- four men and four women -- returned the verdict in U.S. District Court in Tucson, Ariz., after a day and a half of deliberation, also tossing charges of false imprisonment, battery and conspiracy against Douglas, Ariz., rancher Roger Barnett. Most of the award, about $60,000, was for punitive damages.

Mr. Barnett's attorney, David T. Hardy of Tucson, described the decision as an "80 percent victory," adding that he wished he and his client "would have gotten the other 20 percent." But he said he would appeal the decision, citing what he called "solid grounds." He also said U.S. District Judge John M. Roll had been "scrupulously fair" during the landmark trial.

Mr. Barnett owns the Cross Rail Ranch near Douglas, Ariz., where he maintains cattle on 22,000 acres of private and leased land. A $32 million lawsuit, brought by the Mexican American Legal Defense and Education Fund (MALDEF), sought damages for civil rights violations and the infliction of emotional distress. It also accuses Mr. Barnett of assault, battery and false imprisonment.

Also named were Mr. Barnett's wife, Barbara, and his brother, Donald, although the jury dismissed the allegations against both the wife and the brother.

The trial was based on a March 7, 2004, incident in which Mr. Barnett approached a group of illegal immigrants while carrying a gun and accompanied by his dog.

Bullsh*t-If the land was posted they were trespassing. They could have been trying to rustle cattle and if at night how would he know. He has all the right in the world to defend his property, period. He should have tied them to a tree and let the coyotes take care of business. If not, it's time to shoot to kill.Pay them money-like hell.

By the way, Arizona passed a law a couple of years ago that precludes illegal aliens from receiving punitive damages in case such as this. Not sure
if this applies as the case was tried in federal court, but may be grounds for appeal.

I don't think he should have to pay one thin dime, what was this jury thinking? This just opens the can of worms so more illegal scum can clog up our already clogged up courts with frivilous lawsuits. Of course, had he shot them dead, which he was in his right to do, they were criminals trespassing on his property, we'd have never heard of this story.

Usually, cases taken on behalf of indigent clients are done on contingency. MALDEF most likely will get a percentage of the judgment if it sticks.

If on appeal the jury award is overturned, MALDEF gets zilch and has no legal recourse except possibly another appeal, however. If a higher court overturns the jury award, it is doubtful an even higher court will hear the case unless there is some sort of procedural error.

Good idea itswin. I have my doubts, however, that any of our courts would be willing to take on a case in which a legal American citizen actually sues an illegal "visitor" who is clearly violating our laws.

Hmm, one poster here got me thinking. Maybe people should start suing the illegal's more in civil court in situations like this.

Perhaps if the Rancher's takes the next group that comes on his ranch to court for emotional damage, threats, damage to his property etc.

Though the compensatory and punitive damages award for assault and i.i.e.d. are deplorable, one positive is that the constitutional claims were rejected, which means that MALDEF cannot collect attorney's fees from the defendants. Thus, MALDEF lost money on this litigation. Clearly the cost of litigation was far in excess of the $78K. Unfortunately, the defendants' costs were very large as well. Hopefully they were represented pro bono.

Another sad day for our justice system. Perhaps the rancher can sue the country of Mexico for creating a situation where its citizens are pushed out of Mexico to come and violate the laws of the United States since our own government we not take any action against these law breakers.

Wish I were a Mexican. I'd be heading straight for the largest border ranches I could find and start building a farm on one of them. When they shut me down, I'll get enough to buy one of my own.
There's only one place this is all heading: paying protection money to Mexican gangs.
Like everything in our society: who will have the most rights? Criminals.
It's us or it's them and it looks like our system is rooting for them.
Stop saying "God bless America," everybody. It's clearly useless.

Well, it looks like MALDEF got what they were after - $78k - and the rancher got scr***. The damages for emotional distress and punitive are unjust. Everyone who has been watching this story knows that it is the rancher who should be receiving the emotional distress and punitive awards. It is his land and property the illegals continually trashed and burlarized. It is his livestock the illegals repeatedly slaughtered. It is his citizen rights upon which the illegals trampled. Yet this court and jury award the winnings to MALDEF and the illegals.

What is the message that court and jury has just sent? If you are an American citizen, you can protect your property but you had better not cause any emotional distress upon those who violate your property or you will pay significantly.

The men also are under suspicion for being the in U.S. illegally, the Courier newspaper also reported.
According to the article, Harbor Police Chief Jon Callais said that the guard’s port training helped him zero in on the suspected workers.
The Courier article didn’t say how many days the pair had used the fake TWIC cards to illegally enter the port, but the Port of Fourchon had been requiring TWIC cards for access for nearly a month at the time of arrest.
Police said the men worked for the Danos and Curole offshore-service company.

The House voted Tuesday, Feb. 24, to pass the omnibus appropriations bill – a piece of legislation that provides funding to government agencies. In that bill, HR1105, two sections cut off the funding to the highly contentious program. The bill now moves to the Senate for consideration sometime next week.
Losing its funding should essentially mean the end to a program that OOIDA has fought to stop even before it started.
The Owner-Operator Independent Drivers Association has long opposed opening the border to long-haul operations for Mexico-domiciled motor carriers, citing Mexico’s poor oversight of its trucking industry and the threat to the safety of highway users in the U.S.
The Association filed suit with the 9th Circuit of the U.S. Court of Appeals in December 2007 seeking to stop the program. The court has not issued a ruling in the case.
Now, with the funding for the program in the hands of the Senate, OOIDA has issued a Call to Action urging members to call their senators in support of cutting off the funding in next week’s upcoming vote. To read the Call to Action, click here.
OOIDA hasn’t been alone in its opposition to the program. Congress has already tried to cut the funding of the program once before.
Congress voted to cut the program’s funding in the 2008 appropriations legislation. Sen. Byron L. Dorgan, a Democrat from North Dakota, introduced the language. It passed both chambers of Congress and was even signed into law by then-President Bush.
What followed were legal word games over the intent of Dorgan’s amendment.
Dorgan’s amendment in the 2008 appropriations legislation stated: “None of the funds made available under this Act may be used to establish a cross-border motor carrier demonstration program to allow Mexico-domiciled motor carriers to operate beyond the commercial zones along the international border between the United States and Mexico.”
The DOT attorneys zeroed in on the word “establish” and said that since the program started in September of 2007, and not after the legislation was signed into law, the program could continue.
Dorgan defended the intent behind his legislation to no avail. However, the program continues to this day.
In the 2009 transportation appropriations legislation now in the works, Dorgan is back with an amendment that would cut off funding of the program, this time with careful wording that would prevent the word game end-around. His amendment, if signed into law with the full transportation appropriations bill, prohibits the DOT from spending any money, either directly or indirectly, to “establish, implement, continue, promote, or in any way permit a cross-border motor carrier demonstration program to allow Mexican-domiciled motor carriers to operate beyond the commercial zones …”
The 2009 amendment goes on to cut the funding of ongoing programs, “… including continuing, in whole or in part, any such program that was initiated prior to the date of the enactment of this Act.”
The next step for the funding cut will be when the Senate takes up debate on the omnibus spending bill.
The 12 bills that make up the 2009 appropriations funding legislation were due the first of October 2008. The money allocated in the currently debated appropriations legislation funds government agencies for the government’s 2009 fiscal year, which runs from Oct. 1 to Sept. 30.
Agencies have been running thanks to “continuing resolutions” of the 2008 appropriations legislation because the 2009 funding has not been passed or signed by the president. To read more on the appropriations process, click here.
Three of the 12 appropriations bills have been completed for 2009. Instead of passing each of the nine remaining appropriations bills separately, they have been rolled into one massive bill. The Senate is expected to begin deliberations on the bill sometime next week.

Margaret Rains and Haley Tepe were sitting down to enjoy ice cream at a Baskin-Robbins in Aurora, Colo., when a sport utility vehicle driven by an illegal immigrant sent two cars plowing into the shop, leaving three dead and the two women injured.
Now the women are taking action against the city of Denver, arguing that its sanctuary-city policy contributed to the Sept. 4 crash. The driver, 23-year-old Francis Hernandez, had been arrested numerous times by Denver police, but was never reported to federal immigration authorities.
"Despite these numerous arrests and the readily ascertainable illegal-immigrant status of Mr. Hernandez, at no time were proper procedures relating to the reporting, detention and handling of illegal immigrants followed by the law-enforcement agencies of the city of Denver," said the claim, filed on behalf of Ms. Rains.
Her attorney, Stuart Morse, filed the claim Nov. 4 as a precursor to a lawsuit against the city of Denver. He has said that he also may file claims against other Colorado jurisdictions, including the city of Aurora, where Mr. Hernandez was arrested.
The odds aren't in their favor. A handful of other victims of illegal-immigrant crime have filed similar claims and lawsuits in the past few years, without much success, mainly because of issues over standing, said Michael Hethmon, general counsel of the Immigration Reform Law Institute.
He pointed to two similar cases that were thrown out because they were filed in federal court. However, he said, as reports of such crimes proliferate and the case law grows, a court ultimately will side with the victims.
"The number of these cases is simply accelerating because of the growth in the number of illegal aliens and because of the havoc and tragedy they're causing," Mr. Hethmon said. "We're on the cutting edge of the law, but it's simply a matter of one case working its way through the court system, and as soon as one is successful, you'll see the tort bar all over this."
The most visible case pending centers on San Francisco's sanctuary-city policy. Anthony Bologna and his two sons, Michael, 20, and Matthew, 16, were fatally shot in a traffic altercation June 22. Police have charged Edwin Ramos, 21, an oft-arrested Salvadoran native suspected of living in California illegally, in the killings.
Last year, widow Danielle Bologna filed a claim saying San Francisco's sanctuary-city policy was a "substantial factor" in the deaths of her husband and sons.

    If you think sanctuary city policies are a huge problem, Janet Napolitano and President Obama’s immigration policies are going to be immense problems. Already, Napolitano is looking into the recent work place raid conducted in Washington State where 28 illeagls were arrested. It was against her policies that this raid was carried out in the first place. Obama has already made it clear that “immigration reform” is his administrations goal. That translated means, 20 million illegals eligible for legal status, millions more clamoring to get into the US as soon as the word about reform is mentioned, and no more arresting illegal aliens working here illegally.

    What this story fails to do is connect the dots. The telling stat that the MSM is afraid of getting out to the public is the fact that 25 Americans--AMERICANS--are murdered or otherwise killed by illegals thru their fault in DUI accidents.     This is rampant. In 2008, a couple in Gulfport, MS was killed by an illegal alien who hit and tried to run. ONE WEEK prior he had been arrested for DUI, no license and no insurance. Had he been detained for ICE that couple would be alive today.

    I believe it is more by design, rather than mistake, that our government allows illegal aliens to sue American citizens and our government, yet denies that same right to American citizens.
    When those who have no right to be in this country are granted more rights than law-abiding, tax-paying citizens this is a violation of our federal law.
    Current law may dictate that victims have no rights and, for this reason, it should be mandatory that those who enacted and enforce these laws should then be impeached/recalled and prosecuted for violating federal law that clearly states no foreigner can be granted that which is not provided to citizens.

    I wish the ladies the best of luck in their lawsuit... However, chances of VICTORY, slim and none... We had a POLICE OFFICER shot, and killed by an ILLEGAL here in PHOENIX... Same scenario as DENVER and SF... Numerous chances to get this TRASH taken out, but failure of various police agencies to report him to IMMIGRATION, and this EXCREMENT was free to roam our streets, and finally kill a POLICE OFFICER... Sad, but that's the way it is...

    These sanctuary city policies are the worst form of hypocrisy. A lot of these cities will take action in a code enforcement situation, are quick to issue out parking tickets, yet won't act when they see a felony in progress, being in the United States illegally.
    That cannot but help to create a contempt for law and order, and create a sense in these communities that more laws can be broken with impunity --- which is exactly what happens in these situations.
    Disregard for the law is exactly the reason that San Francisco and Denver should be held liable for the damages caused by their sanctuary city policies.

    Those municipal policies are Liberalism at its finest. Don't you all know that those poor "immigrant guests" are just trying to better their lives by coming to America. Citizens need to sacrifice some of their own rights and privileges in order to help make those poor people feel that they are welcomed. If they break a few of our public rules while they are here, it is just because they don't know any better. Don't judge them, reach out to them. Teach them to sing the Coke song in perfect harmony. ... If you don't, then you are just a racist.
    Actually, I don't think we, as American citizens, will get any thing done from our legislators about this illegal alien problem until a family member of some high ranking Pol becomes a victim.
