Rep. Ruth Jones McClendon, D-San Antonio, is calling on the Texas Department of Public Safety to void the administrative rule until the state Legislature can debate the issue. McClendon claims that the rule is a major policy decision that should not be initiated by an agency without the Legislature.
Since Oct. 1, applicants who are not U.S. citizens have been required to present immigration documents before being issued state identification cards or driver’s licenses. People who don’t have permission to be in the U.S. longer than six months are prohibited from obtaining licenses.
Opponents of the rule change say the licensing requirements will push noncitizens into driving without licenses and without insurance. Fear of being deported for not having proper documentation is cited.
The rule brings the state closer to complying with the federal Real ID Act. Other states that have taken steps toward compliance with Real ID include Indiana, Michigan, Nevada and Tennessee.
Real ID is a controversial federal law that requires states to be in compliance by Jan. 1, 2010. Most states are still under an extension granted to all 56 U.S. jurisdictions through the end of 2009 by the secretary of the Department of Homeland Security.
The Texas Legislature is expected to take up the issue when the 2009 regular session convenes in January.

Supreme Court to Hear Case on Illegal Aliens' Use of Fake IDs

The Supreme Court accepted a case on Monday that could have a large impact on the government's enforcement of illegal aliens. The case will review whether or not prosecutors have to prove that defendants knowingly victimized real persons in identity theft cases.
The case stems from an appeal by Ignacio Flores-Figueroa who is a Mexican illegal alien who used false identification to obtain a job in a steel plant in Illinois. He was convicted of identity theft and several other counts and sentenced to prison for six years.
The defendant argues that the government did not prove that he knowingly stole the identity of a real person, but three appellate courts have sided with the government. The Supreme Court is expected to resolve the dispute.
The case is related to an Iowa meatpacking plant raid back in May. Hundreds of illegal aliens were arrested in the raid, and the government is pushing those arrested to plea on lesser charges or face the more serious charge of aggravated identity theft.
The Justice Department says the Supreme Court's decision will be important because many illegal aliens don't know if their fake IDs belong to someone else. President of the Federation for American Immigration Reform Dan Stein told the Washington Post, "It would effectively gut a provision clearly designed to crack down on immigration-related identity theft."

The Republicans on Sensible Immigration lists had to oppose the President and White House from their own Party. They had to oppose this year's Presidential nominee of their own Party. There were political risks to standing up for the workers in their Districts and states, but they did it -- time after time.
The Democrats on these lists probably had to be even more courageous. Not only do their national Party leaders and Presidential candidate push for mass amnesties and increased importation of foreign workers, but so do the Democratic leaders of both the House and Senate.
Fortunately, Members of Congress from both Parties have attitudes much like that of Rep. John Barrow (D-Ga.) who told a NumbersUSA conference last spring that whenever there is an immigration-policy conflict between what the leaders of his Party ask him to do and what the workers of his District need him to do, he will defy Party leaders without hesitation.
I hope you who read this blog will share it with many other Americans so they can see it really is possible for politicians to put American workers and communities first when it comes to immigration policies.

ICE Arrests 442 Illegal Aliens in Multi-State Area

ICE arrested 442 fugitive aliens and immigration violators in New York, New Jersey and Pennsylvania during an enforcement operation that ran from October 14-26. 334 of the total were fugitive aliens, including 152 with criminal histories. Fugitive aliens are illegal aliens who fail to show up for their immigration hearings, or who disappear after a judge orders them to leave the country.108 other immigration violators were also arrested during the operation; about half had criminal histories. The immigration violators were charged with being illegally in the United States and held pending a hearing before an immigration judge.
Criminal histories of the arrestees included convictions for sexual assault, assault, burglary, robbery, bail jumping, criminal sale of a controlled substance, criminal possession of a weapon, DUI, DWI, resisting arrest, and trademark counterfeiting. The following are examples of the criminals ICE arrested during the operation:

ICE Arrests 442 Illegal Aliens in Multi-State Area

ICE arrested 442 fugitive aliens and immigration violators in New York, New Jersey and Pennsylvania during an enforcement operation that ran from October 14-26. 334 of the total were fugitive aliens, including 152 with criminal histories. Fugitive aliens are illegal aliens who fail to show up for their immigration hearings, or who disappear after a judge orders them to leave the country.108 other immigration violators were also arrested during the operation; about half had criminal histories. The immigration violators were charged with being illegally in the United States and held pending a hearing before an immigration judge.
Criminal histories of the arrestees included convictions for sexual assault, assault, burglary, robbery, bail jumping, criminal sale of a controlled substance, criminal possession of a weapon, DUI, DWI, resisting arrest, and trademark counterfeiting. The following are examples of the criminals ICE arrested during the operation:
- A Bangladeshi national who overstayed his visitor visa and had several drug related convictions;
- An Ecuadorian national who served time in prison for petty larceny, criminal mischief and for possession and attempted criminal sale of a controlled substance;
- A Jamaican national who served nine months in jail for felony transportation of Marijuana;
- A Mexican national who had been previously arrested on multiple counts of criminal sexual conduct;
- An Argentinean national who had been previously charged with sexual assault; and
- A Guatemalan national who is a member of the Vatos Locos criminal street gang.

WASHINGTON -- Barack Obama's aunt, a Kenyan woman who has been quietly living in public housing in Boston, is in the United States illegally after an immigration judge rejected her request for asylum four years ago, The Associated Press has learned.
Zeituni Onyango, 56, referred to as "Aunti Zeituni" in Obama's memoir, was instructed to leave the United States by a U.S. immigration judge who denied her asylum request, a person familiar with the matter told the AP late Friday. This person spoke on condition of anonymity because no one was authorized to discuss Onyango's case.

Information about the deportation case was disclosed and confirmed by two separate sources, one of them a federal law enforcment official. The information they made available is known to officials in the federal government, but the AP could not establish whether anyone at a political level in the Bush administration or in the McCain campaign had been involved in its release.
Onyango's refusal to leave the country would represent an administrative, non-criminal violation of U.S. immigration law, meaning such cases are handled outside the criminal court system. Estimates vary, but many experts believe there are more than 10 million such immigrants in the United States.
The AP could not reach Onyango immediately for comment. No one answered the telephone number listed in her name late Friday. It was unclear why her request for asylum was rejected in 2004.
Onyango is not a relative whom Obama has discussed in campaign appearances and, unlike Obama's father and grandmother, is not someone who has been part of the public discussion about his personal life.
A spokeswoman for U.S. Immigrations and Customs Enforcement, Kelly Nantel, said the government does not comment on an individual's citizenship status or immigration case.
Onyango's case -- coming to light just days before the presidential election -- led to an unusual nationwide directive within Immigrations and Customs Enforcement requiring any deportations prior to Tuesday's election to be approved at least at the level of ICE regional directors, the U.S. law enforcement official told the AP.
The unusual directive suggests that the Bush administration is sensitive to the political implications of Onyango's case coming to light so close to the election.
One of the sources acknowledged he was not a supporter of Obama or John McCain and said he has no plans to vote on Tuesday. He said that was not a motive for releasing the information.
Kenya is in eastern Africa between Somalia and Tanzania. The country has been fractured in violence in recent years, including a period of two months of bloodshed after December 2007 that killed 1,500 people.
The disclosure about Onyango came just one day after Obama's presidential campaign confirmed to the Times of London that Onyango, who has lived quietly in public housing in South Boston for five years, was Obama's half aunt on his father's side.
It was not immediately clear how Onyango might have qualified for public housing with a standing deportation order.

Those actions include reconquista or complete takeover of the four borders states neighboring Mexico. If not by outright revolution, they expect to repopulate Texas, New Mexico, Arizona and California into Mexican dominance. One look at Texas and California shows their success appears imminent. The son of the owner of the Iowa kosher slaughterhouse involved in the largest immigration raid in U.S. history was arrested today and accused of helping workers get fake documents.
Sholom Rubashkin, 49-year-old son of Agriprocessors owner Abraham Aaron Rubashkin and a former plant manager, is charged with conspiracy to harbor undocumented immigrants for financial gain, aiding and abetting document fraud, and aiding and abetting aggravated identity theft.
According to a federal affidavit, one witness said Sholom Rubashkin gave him $4,500 to buy identification documents for illegal immigrant workers. The Postville plant was raided May 12 and agents arrested 389 workers. State prosecutors say that more than 30 were children. Agents also seized dozens of fraudulent permanent resident alien cards during the raid.
Yesterday, Iowa's labor commissioner fined the company nearly $10 million for alleged wage violations.

Rubashkin was in federal court in Cedar Rapids today. He was released after agreeing to post a $500,000 bond by Nov. 5 and wear a tracking bracelet.
At the same time, according to The Jewish Daily Forward, the plant — the nation's biggest kosher meat processor — shut down major parts of its operations today. The plant has been rumored to be nearing bankruptcy.
Also, the Jewish Telegraph Agency reports that sources told it that "employees were ordered to kill thousands of unused chickens, apparently because the company couldn’t afford to feed them," and that plant officials were "preparing to lay off scores of workers later today." Neither claim was confirmed independently.

Here are some immigration-related issues that we don't hear the candidates talk about (click on the titles for more information:
(1) Immigration and U.S. Population:
The Pew Research Center projects U.S. population to reach 438 million people by the year 2050; 82 percent of that growth will be attributable to immigration. Is this population growth, driven by our current level of legal immigration, good for our country?
(2) Immigration and American Workers:
More than half a million American jobs were lost between December, 2007 and October, 2008. Unemployment now stands at 6.1 percent and millions more Americans have dropped off of the official unemployment rolls. The average work week for Americans is down to an historically-low 33.6 hours per week. How does current immigration policy (1 million legal immigrants and an additional million illegal aliens) benefit the average American worker?
(3) Immigration and the Environment:
Since Congress increased legal immigration dramatically in the 90's, more than 80 percent of U.S. Population growth is attributable to immigration. Yet, there has been no discussion of the impact of overall immigration numbers in the presidential campaign. How do you feel about federally-forced U.S. Population growth? And, how do you feel about population growth's impact on urban sprawl, congestion, overcrowded schools and hospitals, and the environment?
