Matt Blunt’s desk would call for trucker-hopefuls in Missouri to prove they have a firm grasp of the English language to obtain a commercial driver’s license. The bill also would outlaw “sanctuary” cities in the state.
A conference committee made up of select members from the House and Senate waited until the final hours of the regular session to sign off on the bill – HB1549 – that would require the written test to be offered only in English. The full chambers followed suit shortly thereafter.
Applicants would also be required to understand traffic signs and signals written in English. They would be prohibited from using translators while taking the test.
Supporters say they are concerned that people are allowed to drive trucks on Missouri roads without a command of the English language. They point out that the federal regulation, 391.11, states that applicants are required to:
“read and speak the English language sufficiently to converse with the general public, to understand highway traffic signs and signals in the English language, to respond to official inquiries, and to make entries on reports and records …”
Opponents say there are no studies that suggest English proficiency makes better drivers. They also voice concern that adopting the strict standards would push certain trucking companies to go “underground” to hire people to sit behind the wheel of trucks.
Advocates for the English standard say it’s a matter of safety.
Officials with the Owner-Operator Independent Drivers Association are encouraged by the pursuit in Missouri and other states to make sure aspiring truckers can communicate in English.
Rick Craig, OOIDA’s director of regulatory affairs, said that making the English requirement standard for both portions of the test is vital, and all states should be doing it.
“It’s the only way you’re really going to know for sure” that applicants can communicate in English, he said.
Another provision in the bill would prohibit local governments from enacting policies that give sanctuary to illegal immigrants. State funding would be cut for localities that do not cooperate with federal officials trying to enforce immigration laws.
Advocates for the bill point out that law enforcement in some states make it a policy for their officers not to ask suspects about their immigration status. In fact, there are 60 so-called sanctuary cities throughout the nation that are recognized by rule or regulation, The Associated Press reported.

Bush signed the order Friday and the White House announced it Monday.
The federal government has had some embarrassing moments when illegal workers have been discovered to be working for contractors they've hired, Homeland Security Secretary Michael Chertoff said in a news conference. For that reason it's trying to get its own house in order, Chertoff said.
"The federal government should lead by example and not merely by exhortation," he said.
The order says federal departments and agencies must require contractors to use an electronic system to verify that the workers are eligible to work in the U.S.

Homeland Security operates the Web-based E-Verify system, which Chertoff said 1,000 employers a week are signing up to use. The system allows employers to check Social Security numbers provided by employees. The order would affect hundreds of thousands of workers, at the least, and potentially millions, Chertoff said.
Bush's order is aimed at cracking down on hiring of illegal immigrants. But people who overstayed visas or came to the country legally but do not have permission to work, such as some students or those awaiting work permits, also could be snagged with the system.
"It is the policy of the executive branch to enforce fully the immigration laws of the United States, including the detection and removal of illegal aliens and the imposition of legal sanctions against employers that hire illegal aliens," the executive order says.
The order comes as a worker verification bill has essentially stalled in Congress. A Democratic immigration enforcement bill would require employers to check the citizenship and legal status of all their employees.
"I think it's a great decision. I think it's what the American people have been asking for, common-sense, basic things that are not Draconian or dramatic. Employer verification addresses the real problem and that is illegal employment," said Rep. Brian Bilbray, a California Republican who heads the Immigration Reform Caucus, a group of lawmakers who support tougher immigration laws.
Most employees fill out I-9 forms and submit accompanying documents that employers generally look over to determine whether the worker is legitimate. With E-Verify system, employers enter a name and Social Security number into a computer using the Internet.
E-Verify checks various government databases to make sure the number is legitimate and that it goes with the name that was submitted. If the there are problems, the person is tagged as a potentially illegal worker and must resolve the discrepancy.
The issue of using E-Verify has run into opposition over the years from business groups who say the system is burdensome and civil libertarians who say it will lead to discrimination and job losses by U.S. citizen workers misidentified as illegal workers.
Concerns about the system's effect on privacy was to be the topic of a House subcommittee hearing on Tuesday. Several members of Congress were to testify at the hearing.
Chertoff said the system gives correct results 99.5% of the time and legal workers are able to resolve problems in less than two days.
But Tim Sparapani, senior legislative counsel with the American Civil Liberties Union, said the president's immigration announcement "will vastly increase, not decrease the incidence of identity thefts because they are turning work-eligible American workers' identities into black market commodities.
"This will not decrease immigration, but it will cause enormous turmoil and economic distress for the poor workers who wrongly lose their jobs due to erroneous government data or whose identity is borrowed by an undocumented immigrant who is desperate to work," he said.
Also Monday, Chertoff said Homeland Security is awarding Boeing Co. contracts to build two sections of Arizona "virtual fence" that are a version of a prototype known as Project 28 that failed to perform as expected. Sen. Chuck Grassley (R-Ia.) recently introduced legislation (S. 3093) that would reauthorize the E-Verify program. Grassley's legislation also makes several improvements to the program.
Sen Grassley said, "Nobody could have imagined the sophistication of the documents that illegal aliens use to work in the United States, which has made the E-verify program an even more important and useful tool for employers....With a comprehensive immigration bill highly unlikely this year, we need to enhance the tools that are already on the books and make sure they remain available for employers who want to do their part to comply with the law."

Grassley's bill makes the E-Verify program permanent, requires all contractors of the federal government to use the program, and requires businesses who have a history of illegal hirings to use the program.

Will Supreme Court Allow States to Violate Federal Law Barring In-State Tuition for Illegal-Alien College Students?

We may get an answer over the next week from the high court, which will decide whether to hear the case.
A federal district court and a U.S. Court of Appeals have essentially already refused take action against states that break the federal law.

Administration & Courts Have Refused to Enforce Law


Ten states are breaking federal law by providing the cheaper in-state tuition to illegal aliens attending their colleges.
This is one of the more egregious examples of both the Executive and Judicial branches of government failing in their Constitutional tasks.
The Legislative Branch (Congress) passed the ban on this benefit to illegal aliens in 1996.
But although President Bill Clinton signed the ban into law, his Administration -- and now President George Bush's -- have not fulfilled their responsibility to enforce the law.
And the courts have not done their responsibility to hold the Presidents accountable.
Repeatedly in the realm of immigration, American citizens see the rule of law subverted and corrupted in this way. It gives rise to increasing cynicism about whether we remain a nation of laws.
U.S. Justice Department Bears Chief Blame


The 1996 law actually allows a state to provide the subsidized, lower in-state tuition rates to illegal aliens ....
.... but only if the state also provides the same low rate to U.S. citizens that are born in other states.
Congress was pretty sure that no state would be willing to give up the huge amounts of money it collects in higher tuition from out-of-state students. But it gave states that option if they truly insisted on subsidizing illegal-alien students.
None of the 10 states giving the benefit to illegal aliens has followed the law and offered the cheap tuition to all American students.
Nonetheless, the Justice Department under Clinton and now Bush has never done its duty under the law and taken one of those 10 states to court.
And, thus, disrespect for the law and an orderly society grows.
The Lawsuit Before the Court


The Washington Legal Foundation (WLF) stepped in to try to force the compliance with the law that the Justice Department ignored.
It sued the state of Kansas for its recent statute offering in-state tuition to illegal aliens. You can read its press release about the case and its plans for the Supreme Court by clicking here:

WLF filed its brief on behalf of a University of Kansas student who had lived in Kansas earlier in life but went to high school in Kansas City, Missouri. She pays far more tuition than do illegal aliens.
Both federal District Court and the Tenth Circuit Court of Appeals have thrown out the suit on technical grounds, saying that the student plaintiff has no standing as a victim of the Kansas pro-illegal-alien law.
The Supreme Court will decide -- probably over the next week -- whether U.S. citizens such as this indeed do have standing to sue for adherence to the law when the President of the United States and his Administration refuse to enforce that law.
When it comes to the details and technicalities that the Supreme Court will consider, I don't have skills to offer an educated opinion. But I do agree with WLF Chief Counsel Richard Samp that unless the courts force states to play by the rules set by Congress, the pro-illegal-alien lobbies will be emboldened in their efforts to "encourage yet other states to flout federal law."
Our campaign for Attrition Through Enforcement to steadily drive illegal aliens to leave this country has been gaining steam, with local and state victories throughout the country. A continuation of tuition benefits to illegal aliens in the 10 states -- and, even worse, an expansion into other states -- would be a serious setback to our Attrition efforts.

All of those committee Members need a phone call today letting them know that voters are watching and expecting them to expand funding for enforcement.

The committee Members are under huge pressure from special interests and newspaper editorial boards in their Districts to do the opposite -- to gut the rapidly increasing enforcement of immigration laws by local police and sheriffs.

You know the Congressman/woman is on the committee that will be marking up the bill tomorrow ("marking up" means amending and putting into final form to send to the full House of Representatives).

It is most important the he/she expand funding for the 287(g) program that trains local agencies to enforce immigration law.

There are enough local agencies across the country willing and eager to help the feds that the illegal immigration problem could be largely solved if Congress would just provide enough training and other resources.

It is important that enforcement not be just for illegal aliens who have committed violent felonies. All illegal aliens must fear being arrested if we are to get enough voluntary departure to open up millions of jobs to non-employed American workers.
The news is full of stories of illegal aliens returning -- or considering returning -- to their home countries in part because of the pressure they feel from the growing number of cities, counties and states that are enforcing the law.

This is driving the pro-illegal crowd crazy. Don't underestimate how much pressure they are putting on the House Appropriations Committee to de-fund or underfund 287(g) and other enforcement efforts.

Local agencies cannot enforce immigration laws unless they receive proper training such as through the 287(g) program.

Dozens of law enforcement agencies are blocked from cracking down on illegal immigration because Congress in the past failed to appropriate enough money.

State and local police are badly needed to help overwhelmed federal immigration authorities apprehend and detain illegal aliens in the interior of our country.

Illegal aliens currently outnumber federal immigration agents by 5,000 to one, and only 2,000 federal agents are active in enforcing the immigration laws in the interior of our country. Clearly, those numbers indicate that a limited number of federal agents are incapable of confronting the estimated 12-20 million illegal aliens currently inside our nation's borders and would benefit from the assistance of the more than 600,000 state and local law enforcement officers nationwide who come into contact with illegal aliens every day.

As of August 21, 2007, 23 state and local law-enforcement agencies had struck agreements with ICE, and about 75 others had submitted applications. Most agreements were signed in the prior 18 months. To date, ICE has trained 416 officers, who, in turn, have made over 22,000 arrests in conjunction with Federal law enforcement officials.

We cannot tell you for sure what committee leaders had planned to introduce today because they have refused to make public their bill. (Whenever that happens, we generally are correct in suspecting that they are including convoluted language designed to disguise legislation that we would oppose. If they wait to the last minute to make a bill public, we don't have time to read and analyze it and to alert you to any dangers.)

We do know that there are strong currents within Congress wanting an election-year action that will look really tough against the worst criminals among illegal aliens while secretly gutting the enforcement programs that are proving effective in pushing overall illegal immigration down.

Particularly at risk are two effective efforts that the pro-illegal groups despise:

No. 1: 287(g) program allowing and equipping local agencies to arrest and detain illegal aliens of all kinds.

No. 2: Arrests of any illegal alien encountered while looking for criminal alien fugitives.

One idea floating around Congress would be to take away all funding for 287(g) and put it into a larger fund for tracking down fugitive criminal aliens.

Another idea has been to bar ICE -- when tracking down those fugitives -- from arresting and detaining non-fugitive illegal aliens it encounters along the way.

We believe both ideas may have been part of the DHS spending bill the committee was supposed to consider today.

Basically, the pro-illegal forces are willing to track and deport illegal aliens who have been convicted of violent crimes. But they don't want any other of the 13-20 million illegal aliens bothered in any way.

The first real showdown on this philosophy may be in the House DHS spending bill debate. If any congressional leader thought these guttings of enforcement could slip through unnoticed, your phone calls yesterday and today proved that to be impossible.

Mr. Schwarzenegger also said he would ask the federal government for aid to farmers and press water districts, cities and local water agencies to accelerate conservation. Drought conditions have hampered farming, increased water rates throughout California and created potentially dangerous conditions in areas prone to wildfires. [/SIZE]<DT> <DT>[SIZE=+1]"The declaration comes after the driest California spring in 88 years, with runoff in river basins that feed most reservoirs at 41 percent of average levels. Consider this: America immigrates 182,000 legal immigrants and illegal migrants every 30 days. How many immigrants? That many people nearly fill the Pasadena Rose Bowl twice! State and local police are badly needed to help overwhelmed federal immigration authorities apprehend and detain illegal aliens in the interior of our country. Illegal aliens currently outnumber federal immigration agents by 5,000 to one, and only 2,000 federal agents are active in enforcing the immigration laws in the interior of our country. Clearly, those numbers indicate that a limited number of federal agents are incapable of confronting the estimated 12-20 million illegal aliens currently inside our nation's borders and would benefit from the assistance of the more than 600,000 state and local law enforcement officers nationwide who come into contact with illegal aliens every day.
