Not sure if this was your point or not but at a DUI checkpoint legally you do not have to show your ID even though you are driving a motor vehicle. Unless you commit an infraction or they suspect you of being drunk/under the influence. You can simply say no thanks and drive away. Will that work and they will let you drive off? Probably not but that's the law...

That’s weird. What source is that from? I see it says California, but that’s not a stop and ID state.

First of all I don’t know if I would call driving a privilege. If you have a license, that is something you earned.


In America.....(let’s see if one of these great attorneys can co sign this)....there is a penal code on presenting idea. Each state has one. For most states it goes something like this....IF you haven’t committed a crime, are not in the process of committing a crime, or not about to commit a crime...THEN you are NOT lawfully required to provide your ID. Whether you are in a car or not, that’s the law.

Police need to have RAS(Reasonable Articulate Suspicion) in order to even ask for your identification. And if you know you did nothing wrong and they don’t have RAS...they are doing what you would call a violation of your rights.

Even if they start asking for an explanation for your actions, you are not required to answer them in any format that they wish. You can at that point tell them to eat a dick and leave you alone. And if they don’t? Call for their supervisor. If they want to violate your rights more after that, get all of their names and badge numbers and visit IA. That’s the law. You guys are welcome for what these Rx attorneys won’t tell you here.

Simple, it's not a right in the U.S. to drive a car. There's a difference between a privilege and a right.

A right allows you to obtain a gun (if you meet the standards), a privilege allows you to drive until you fuck up.
