"barman --is there a federal law that bans people from placing bets on the internet?

Or is that your interpretation of the wire act?"

B: It's how I've most often heard the wire act explained. Here in Florida there are periodic references to it, suggesting that using the internet thru a phone line constitutes using the phone to make a bet.

I would think that the subsequent advent of broadband cable complicates this interpretation.

Bottom line is that they have NO means of enforcing this law save catching someone in the act, which is very unlikely without a search warrant. Another way would be to have other valid cause to search a person's computer and examination of History, or perhaps Cached pages might demonstrate using the net to bet.

Both are extremely remote if the person in question is otherwise law-abiding and therefore unlikely to be subject to a valid search warrant.

Even a valid warrant to search a hard drive would likely include limitations as to the scope of the search, making the revelation of any online betting 'poison fruit of the tree'.

Time will only tell. The industry will adjust. Online Gambling will not go anywhere when people want to bet online.

Worse case - next two years fish - the areas for sportsbooks to market for players gets cut down 80%. Many small books perish. The current larger books evolve into taking large payments, less frequent because of how tough it will be to get a payment out. In the end, people still gamble online. Millions of our tax dollars will be wasted over this when they could just find a way to regulate it.

It is interesting that Elliot Spitzer's office says it is NOT a crime to place a bet in New York State, but yet they convicted Jay Cohen on the premise that a bet was placed with the World Sports Exchange in Antigua from a telephone in New York...

"While it is illegal to run an Internet gambling operation in the United States, state laws vary as to whether the bettor is committing a crime. New York, for instance, prohibits operation or promotion of an unlicensed casino, but it does not make the act of placing a bet a crime, said Kenneth M. Dreifach, chief of the Internet bureau for the New York attorney general, Eliot Spitzer."

Furthermore, they completely rejected the obvious fact that a bet cannot even be made until accepted in Antigua on the internet, where World Sports Exchange is licensed.

Oh, the irony of it all...

well its a game of "Skill" so it's a loophole I think poker will be legal WAY before net wagering..at least that is a good thing if it happens

Dante- Correct me if Im wrong, so your saying(like political people) that betting sports is not a game of skill??

All this hoopla surrounding gambling is such a gray area, that NOBODY knows the EXACT correct answers whether one is debating online gambling legalities or whether the subject be gambling taxes(or taxes in general for that matter).

I will cut the government some slack and say I realize they have a tough assignment, but they could certainly be doing a whale of a better job then what they are doing IMO.

Fish-

What do you mean here? Where is online poker considered "more legal," I would think something is legal or is illegal.

IMO, online sports wagering attracts more attention because:

1) The industry is older.
2) Without running any numbers, I would guess that it is ENORMOUS compared to online poker.

Regarding your skill reference, that comes from a lack of understanding by public servants. In poker it is VERY easy to determine that it is a skill game with some luck since you have a finite number of cards and odds that are easy to calculate. With sports, there are certainly probabilities involved but there was a time when it was difficult to beat the book primarily due to lack of access to information by players. Add the vig to that and sports wagering against the "house" seemed like a losing proposition.

What people do not recognize (or at least they minizime the impact) is that humans make lines and therefore can be beat. Additionally, the playing field is much more level today for players due to the number of outs available and access to information via the internet.
