No Cash For Sick Gambler

Aztar Corp., the parent company of the Tropicana Casino, has won a summary judgment in court which dismisses against it a federal lawsuit that claimed a problem gambler’s condition was aggravated by the casino’s indifference to his addiction.
The case was filed last year in Indiana by David Williams, 52, now an unemployed Indiana Department of Revenue auditor. Williams’ lawyer, Terry Noffsinger, built a case that documented Williams' “long and embarrassing spiral downward through the circles of Hell,” U.S. District Court Judge John Tinder wrote. But in his decision Judge Tinder also wrote, “... despite his counsel's creative efforts and regardless of Williams' sympathetic plight neither federal nor Indiana law provides him any refuge or reward.”
Williams lost an estimated $175,000 at the casino. He also lost his home and filed for bankruptcy. Williams did not specify the damages he sought from Tropicana, but claimed that the casino’s parent company, Aztar, had “violated federal and state racketeering laws and had committed tortuous breaches of duty and fraud,” Rod Smith writes in the Las Vegas Wire.
Attorney Noffsinger has not decided as yet whether he will appeal the decision, and said, “The problem of pathological gambling is still here. What the courts will do about it and what the companies will do to address it is still up in the air.”
A court source reportedly said “it would be difficult to persuade an appeals court to overturn the trial court,” wrote Smith.
Joe Cole, a spokesman for Aztar, said: “We are gratified by the court's ruling which simply upheld the law. Patronizing a casino is a matter of personal choice and individual responsibility and the court recognized that.”

Here are the facts as I know them. You both can read this and know it is exactly what I know has happened. Before I start my story, I would like to say that Russ forbid me to mention the name sick gambler to him in the past several weeks since he was tired of the bullshit by sg and I on the forums.
Back when sick gambler came to visit me on July 2, he had told me he just lost 27k and he even told me he would give me 4k to get it back for him. I told him that I could not. I also knew at that time that his neteller accts had got locked down with the exception of Rick C and Andre H........Rick C being open because he had told someone who told me that he had his brother go to Rick C house and get Rick C identifacation so that he could fax it to Neteller. They told Rick C that they had entered his name in a contest and to collect the prize money they needed a copy of his ID to get the money.
In the car on the way home, he told me he wanted to call Shrink to get his money for him, I said no, you are not calling Shrink from my house. I also told him that he is not to email Rio from my house and that I wanted no part of his scam. He was very anxious to get into his neteller acct for Rick C and I told him he was not doing it from my house as well. He told me that neteller was investigating Rick acct and that he needed to conduct business to withdraw money from a book. It is my belief that he was anxious to keep checking because he knew that that acct was also being looked into very closely.
Okay, now.....3 weeks later, he tells someone that he is going to contact Shrink and tell Shrink that he will start posting at Rx again if Shrink helped him. I heard this 1 wk prior to this taking place. I then warned Rio that this was going to happen.

In closing I would like you both to know that I KNOW FOR A FACT that this man is a scammer. And he is doing his best to try to wreak havoc on everyone else to just take the focus off himself.
