I was referencing with that my own prior post that agreed with Computer Group's statement and thus hopefully clarifying my own feelings re: returning Vets within LE. :toast:

I don't have a dog in the fight, but I will say with certainty that EITHER party could have easily avoided this. I think her avoiding it would have been much easier than him, but still either party could have avoided it.

Dude, you can't explain to people that can't read between the lines.

The cop clearly thought he was smarter than her, & by seeing her upset, he clearly pushed her buttons towards an agenda he was clearly unfolding before our eyes.

Do I suggest people respond to police like she had? No way, be polite & answer all questions......but I talked to a friend that's a lawyer, & she stated when a cop pulls someone over, you don't have to answer jack shit.

You ask why you were pulled over, then you show your license & whatever other papers, & that's it. If he gives you a ticket, so be it. ....you don't have to get into a discussion with them.

But on the flip side, if you just go along with what's going on, & you're polite to them, everything should go smoothly 99% of the time.

Great comment......you're 100% right, only way this situation is resolved w/o incident is for her to just be polite, because cops think they're better than everyone & won't stand down......& having that badge, makes them invincible in their minds, & usually the law backs them up because of it.

Hate is a strong word, then again, a lot of people hate certain people, for whatever reason......they have their reasons.

The "legal" reality, yes, but "Real Life"? as opposed to the view from within a Law Book within an air conditioned attorney's office?

Hostility or even anything short of full co-operation with LE is simply asking for trouble. Seeing the Bigger Picture and co-operating, on the other hand, is a wiser tact to take.

This is the only thing that matters, except it will go smoothly 100% of the time if you are legal (no warrants, registered and inspected car, insurance). There are no lines to read in between. She wouldn't put out the cigarette, he said fuck you and yanked her out of the car. Simple as that. You guys want to come up with some agenda by the cop which is insane. Did you watch the stop before hers? He was completely reasonable, gave the girl a warning.

I know exactly what you're saying, but any good lawyer could have his badge for what he did.

First off, its her car, thats her property, she smoking inside of her car, she's not blowing smoke in his face.

He has no right telling her to put out the cigarette......she's not in a mall, restaurant, or wherever else smoking is prohibited.

He clearly has no right to ask her to put it out, & a good lawyer will beat him to a pulp.

Now as far as acting polite to a cop, I agree 100%, but we as people aren't all the same, & all have different backgrounds & so do cops, throw all this into a blender, & it can get ugly.

back in the day when I used to get pulled over my buddies would light a butt to try and cover up the pot smell.
Cops hate it. All of them will ask you to put it out.

I understand she is allowed to smoke in her car, but he came and talked to her, then went back to his car to run her license. He comes back to the car and she is smoking? I say she did it to piss him off and be rude. By her tone you can tell she's been pulled over plenty of times before. "you tell me, this is your job" shit. She assumes she's getting ticketed, but he says it was a warning.

Really dumb how this all started.

Yes, I agree its dumb how it started......maybe she kitbthe cigarette because she's stressed out, people smoke for that reason.

And she was pulled over for a BS changing lanes w/o signaling......so she's thinking she will get a ticket, so when he goes back to run her plates, she lights a cigarette......& since he's giving her a warning, he feels she's obligated to put out the cigarette because he's giving her a break.....that's where the power trip of cops comes in, because he has no right to ask her to put it out.

But anyway, both parties should have acted better. It only take one if the parties to make things difficult for both parties, & then we have this result.

But like you stated, if you're polite to them, you have a good chance of everything turning out OK.

Some good points but I'd say he certainly can ask her to put the cigarette out. He approaches her car and if he feels like she is weird or unstable he could easily say he was worried she may flick the cigarette at him or something.

I'm not saying that is right, i'm just saying that I think a good lawyer for him would play that card all day long. She pretty much has to do what he says.

The only thing she did wrong was not exit the vehicle immediately when he told her to. The cop on the other hand made an unlawful arrest, which is a bigger deal, and he probably wont be a cop anymore.

she did not use her turn signal , that caused the entire problem

Some of you guys crack me up.

Whether you like it or not the cop has the power in any encounter you may have with him. Any. Be cooperative and polite and respectful and you will increase your chances of getting the outcome you desire. Be noncooperative, cop an attitude, and be disrespectful, and there's a good chance the cop is gonna stick it to you. It's really that simple unless you have something big to hide. It's called another life's skill most of us learn somewhere between our teens and young adulthood. If you don't learn this skill you're virtually guaranteed to find yourself in some losing encounter with the law. And race doesn't matter.

PS I got a failure to signal when changing lanes three times ticket about a year ago, despite being completely respectful to the statie. Shit happens and they are paid to call you on it.

Not using your turn signal is not probable cause to do anything other than write a citation.

What a sad situation... cop is in the wrong, no probable cause for nothing... so corrupt, so much ego, power trip united.
