Issue #1 is if Junior and Senior and Dash-cam Man were even allowed to chase Arbery and attempt a citizen's arrest. My understanding is that they would have had to witness a felony in order to do so, and the evidence so far indicates Arbery only committed a misdemeanor. I believe that is the basis for the "Criminal Attempt to Commit False Imprisonment."

Issue #2 would be the self-defense argument. I don't think it applies as stated above. Junior shot and killed Arbery. He wasn't allowed to chase him, and he isn't allowed to claim self-defense. He is likely getting convicted.

From what I've read so far, I don't think dumb and dumber were allowed to pursue the guy either and in that case, it's going to be hard to prove self defense.

The lead investigator just said at the press conference, "If we believed (William Bryan) was just a witness, we wouldn't have arrested him."

I agree - but there are numerous mitigating factors/excuses that are going to lower the charges or their punishment - like a lot

"Criminal Attempt to Commit False Imprisonment" - is that the underlying felony the prosecutors are alleging here? if so, I'm pretty sure I previously said they are going to allege some form of kidnapping or false imprisonment

Well there it is - if he says so - it must be true - anyone with any understanding of a criminal case knows this case is DOA without him testifying against Junior and Senior

Why do you think he recorded this thing?

I don't know. Maybe he is just one of those guys that has a dash cam going 24/7. Maybe he was aware they were all chasing a person and he wanted to get it on tape.

The older McMichael actually thought the release of the tape would help them haha. Dumbass.

16-5-1. Murder; felony murder


(a) A person commits the offense of murder when he unlawfully and with malice aforethought, either express or implied, causes the death of another human being.

(b) Express malice is that deliberate intention unlawfully to take the life of another human being which is manifested by external circumstances capable of proof. Malice shall be implied where no considerable provocation appears and where all the circumstances of the killing show an abandoned and malignant heart.

(c) A person also commits the offense of murder when, in the commission of a felony, he causes the death of another human being irrespective of malice.

(d) A person convicted of the offense of murder shall be punished by death, by imprisonment for life without parole, or by imprisonment for life.
