Acebb is by far the dumbest make believe lawyer I have ever met. The kid struggles with some of the most basic concepts out there. He can't grasp what liquidate means, he had trouble with what "sold" means, fails at basic math, can't figure out what scientists mean by "very likely", now he thinks a policy has to be written down?? Hahahaha. There is no chance he is a lawyer if he thinks policies have to be written. 0% chance. Absolute comedy gold!!

Being charged isn't being convicted. Admittedly, we only know what's reported, but isn't part of his defense is that his unit was committing War crimes to civilians in his mind, and his commanders weren't listening to his complaints, so he was going to another unit to report the crimes? If his CO was a criminal asshole like Alan West who committed war atrocities on civilians, and Bergdahl's complaints were falling on deaf ears with his current unit, his defense might be valid. Or he's making that up, but point is, like any other trial, facts aren't in until a verdict is in.

Guess you didn't read what I wrote the first time. Berghdal admitted deserting his unit to investigators. It's a fact he walked off post on his own.

In the DoD AK, policies are on paper and published or they don't exist. They are called "policy letters," "publications," or "instructions." Supervisors at all levels always ask first "what does the publication say?" when talking about matters of contention or disagreement. These instructions provide clarity and remove ambiguity from the equation.

Um, since America left POW's behind in Korea and Vietnam, when was this policy you're saying exists put into place and who implemented it? Additionally, how can a policy be enacted when it is not written down?

That's not entirely true. There are unwritten policies. Like leave no man behind, we don't negotiate with terrorists, etc, etc. Policies do not have to be written or published. They are just generally accepted guidelines and practices.

We don't negotiate with terrorists is not a policy or Bergdahl would still be sitting in a mud hut in Afghanistan. Policies are guidelines written down, signed and published by supervisors at all levels so the organizations know what the standards are.

In the government/military you don't want them and they are hard to enforce if they aren't explicitly written, but they do exist and it's not impossible for unwritten policies to exist as our resident all-star lawyer Acebb claims. Do not negotiate with terrorists is a perfect example of an unwritten policy that the government tries to abide by.
