I've got a feeling this started earlier that evening. Premeditation could have started earlier. Maybe not so random.

Agreed. There is something more to this. They both had football backgrounds. Haynes hit Smith why would Haynes be the aggressor? Smith maybe was going crazy? They only charged this guy with 2nd degree murder. WTH?

This (if true) puts cold water on the idea this was some sort of "hit"

Defense attorney John Fuller said that before Hayes and Smith connected, Hayes had been chasing a hit-and-run driver who had rear-ended his Humvee and sped off. Fuller wouldn't say whether Hayes identified the Mercedes as that vehicle.

"My client attempted to pursue that vehicle in an effort to get the license plate number and in an effort to report an accident," Fuller said. "As he attempted to close on this vehicle, a three car accident occurs: Smith's vehicle, my client's vehicle, and another vehicle."

Fuller said Hayes called 911 after he was hit and convinced a witness who was about to leave to remain and talk to police.

Attorney doing what an attorney does. Defend his client. If dude gets rear ended....he feels he has to gk rear end someone else and kill them?

Lol a whole lot of nothing was just said by Hayes attorney. I don't believe that happened in a sequence of events like they aare suggesting. If will Smith hit this guys hummer...a friend of a cop.... don't you think he would own up? An ex nfl player with millions doesn't stop after he hits someone? Lol no.

Hayes trying to say whatever to lighten his actions. If you call the cops why would you still take things into your own hands? Dude is either very dumb or he's lying

Sean Payton expressed strong anti-gun opinions in an interview with USA Today Sports on Monday, less than two days after the fatal shooting of formerNew Orleans Saints player Will Smith.
Describing himself as "leaning to the right on some issues," the Saints' coach emphatically stressed he is not in favor of current gun laws in the United States, specifically in Louisiana.
"I hate guns," Payton told USA Today Sports.
Smith, 34, was killed Saturday after being involved in a minor traffic accident in New Orleans. Police have arrested Cardell Hayes, 28, and charged him with second-degree murder.

</aside>"I've heard people argue that everybody needs a gun," Payton said. "That's madness. I know there are many kids who grow up in a hunting environment. I get that. But there are places, like England, where even the cops don't have guns."
Payton, who lives in New Orleans' Garden District, also railed against the overall violence in the city, saying, "Our city is broken."
He was joined in this chorus later Monday by Saints quarterback Drew Brees and Alvin Gentry, the coach of the city's NBA team, the New Orleans Pelicans.
"I feel like this is a problem that's been around for a long time," Brees said in an interview with local station WWL Radio. "And it's not just New Orleans, it's nationwide. It's worldwide. It's the way that people treat people. And somehow along the way we've all become desensitized to the fact that this stuff happens every day and it's OK, or we can just kind of move on from it as if it's gonna happen and it's part of the way things are and there's nothing we can really do about it.
"And it's overwhelming," Brees added. "It's overwhelming when you think about this epidemic, or this problem, of young, mainly young men, killing young men for no apparent reason."
Gentry called on the need "to eliminate such senseless violence in our city," saying he was "totally against" guns.
"I don't want to have what happened the other night, in the Will Smith situation, taint everything about this city," Gentry said Monday night before the Pelicans' game against the visiting Chicago Bulls. "It was a senseless thing. It was ridiculous. The whole gun thing makes me sick to my stomach."
Police said Smith and Hayes argued after Smith's Mercedes was rear-ended by Hayes' Hummer. According to police, Hayes shot Smith and his wife, Racquel, who was taken to a hospital with a leg wound.
Payton, who was Smith's coach with the Saints from 2006 to 2013, went to the accident scene early Saturday morning and joined Smith's family at the hospital.

"It was a large caliber gun. A .45," Payton told USA Today Sports. "It was designed back during World War I. And this thing just stops people. It will kill someone within four or five seconds after they are struck. You bleed out. After the first shot, he took three more in his back. ... We could go online and get 10 of them and have them shipped to our house tomorrow.
"I don't believe that was the intention when they allowed for the right for citizens to bear arms."
Payton, 52, has been the Saints' coach since 2006 and has lived in various New Orleans communities ever since. He lamented recent budget reductions for the city's law enforcement but also cited extensive gun violence in New Orleans' less affluent areas.
"We don't hear this noise when something happens in New Orleans East or in the Lower 9," he said. "Now you creep into the Garden District ... I just know this: Our city is broken."
Gentry also issued condolences and get-well wishes to Smith's wife and family.
"For us, it's part of our family, because you take the Pelicans and you take the Saints and we're all a part of the family," Gentry said. "Our thoughts and prayers go out to his family and to his wife -- and I hope that she has a speedy recovery -- and then I think we all need to pray for the kids. And hopefully that doesn't define us as a city, because this is a great place to live and got so many great people that are so caring, that that's not who we are here."
Information from ESPN's Mike Triplett and Justin Verrier was used in this report.

Great post, thanks the guesser

Um, this part:

Payton told USA Today Sports. "It was designed back during World War I. And this thing just stops people. It will kill someone within four or five seconds after they are struck. You bleed out. After the first shot, he took three more in his back. ... We could go online and get 10 of them and have them shipped to our house tomorrow.

Is complete fabrication. It is untrue, you can't do that in America.

So of course you 2 buffoons are clapping.

Youi guys are still talking about this?

It's black on black crime. It's positive and happens everyday. Sure a middle of the road aging NFL DE was involved but he is more remembered for Ohio State than in the NFL.

Former New Orleans Saints running back Pierre Thomas said Tuesday that he left New Orleans on Monday night after struggling to overcome the images stuck in his mind following the death of longtime Saints star Will Smith on Saturday.
Thomas, who'd spent time with Smith that evening, posted a message on Facebook about what he witnessed and his intense feelings since the incident:

The last few days have been a whirlwind and I am still trying to wrap my head around this whole thing. I flew out of New Orleans last night and back to Chicago because I couldn't think straight...I witnessed a close friend, teammate and a man that I thought of as one of my big brothers in the NFL shot to death over a F--KING FENDER BENDER!!! What, why how? I just don't get it...these images that I have in my head will never leave me and I understand that and will have to live with it. I want to thank each and every one of you, my family, friends, fans and the whole entire Who Dat Nation for all of your thoughts and prayers....but let's send them instead to Will's family—his wife and 3 kids who have to be strong during this difficult time.
