What Is the Crime?

Thursday on CNN’s “Anderson Cooper 360,” Harvard law professor Alan Dershowitz called into question the purpose of the Department of Justice naming Robert Mueller as a special counsel to investigate Russian involvement in the 2016 presidential election.


Dershowitz argued Mueller’s appointment would benefit Trump given that “collaborating with the Russians” to get elected wasn’t illegal and Mueller’s role would be to investigate illegalities.

“I
think he will be the beneficiary of the special prosecutor,” Dershowitz said. “A special prosecutor is supposed to investigate a crime and most of the things that have been leveled at the Trump administration are not criminal acts. Collaborating with the Russians to get yourself elected — not a criminal act. Terrible, morally wrong, but not criminal. The same thing is true with the leaking of the information to the Russians.”

Host Anderson Cooper ( MO) and Dershowitz’s fellow panelists Jeffrey Toobin (LARRY)and Carl Bernstein (CURLY) argued the investigation should proceed, but Dershowitz insisted there wasn’t a criminal statute about what Trump and his campaign have been accused.

“Let’s assume that that’s true —show me the criminal statute
,” he said. “I still sit here as a civil libertarian. I don’t want us ever to become what Stalinist Russia became when Stalin was told by Lavrentiy Beria, ‘Show me the man and I’ll find you the crime.’ What is the crime?”

Cooper said the question wasn’t whether or not it was illegal collusion or just collusion but if it occurred, to which Dershowitz said that wasn’t something over which Mueller would have jurisdiction.
'That is a political issue, but that doesn’t give Mueller jurisdiction,” he added. “Mueller has no jurisdiction to explore whether he made political mistakes, did terrible things, engaged in wrongdoing. Only
criminal acts.”​

The independent investigation into possible ties between Russian efforts to interfere in last year’s election and associates of President Donald Trump is necessary, U.S. Ambassador to the United Nations Nikki Haley said in an interview that aired Monday morning, so that the issue can be put to rest.


The Department of Justice announced last week that former FBI Director Robert Mueller had been appointed as a special prosecutor to oversee the Russia investigation, a move that the president took little time to characterize as “the single greatest witch hunt of a politician in American history.” But Haley, visiting Jordan on her first foreign trip as Trump’s representative at the U.N., voiced support for Mueller’s appointment.

“I think we absolutely need the investigation,” she told NBC’s “Today” show. “I think that all these questions need to be answered so that the administration can get back to work.”


Haley also responded to a report last week that Trump had shared highly sensitive intelligence with two top Russian diplomats during an Oval Office meeting earlier this month, information that had been provided by a U.S. partner that was considered so secret that even American allies were purportedly not told of it. Haley said she would work to reassure U.S. partners in the Middle East that their secrets remain safe with the Trump administration.

So much of what I do at the United Nations is based on sensitive information, so much of what a lot of the Cabinet members, what they do is based on sensitive information,” she said. “So we're trying to reassure all of our counterparts that what they tell us is kept, trusted, and valued and we will return the favor.”

More importantly Joe, since you're making the accusation, you have to prove why it is obstruction of justice.

Just because you hate Trump, just because you want it to be, that's just not enough.

You have to gave evidence, and thus far any and all substantive evidence sides with Trump.
