If you bust your head open, run up huge medical bills and can't pay guess who picks up the tab? The taxpayers; that's why you should wear your seatbelt.

If you bust up your head in a motorcycle accident and live long enough to run up any notable medical bills, you're probably about one of ten guys nationwide.

Meanwhile, taxpayers are paying literally thousands of police officer man hours daily to burn their time catching people without seatbelts.

And meanwhile, there's slow response times to legitimate complaints of crimes against persons and/or property.

Twice in the past officers have tried giving me a ticket for not wearing my seat belt after pulling me over, but I simply told them I did have it on but took it off after he pulled me over to the side. They couldn't prove otherwise so I didn't get them....


Absolutely the correct response to this revenue shakedown scam.

The officer is specifically trained to elicit a confession as fast as possible.

"Why weren't you wearing your seatbelt?" provokes a defense of why not, rather than an immediate claim of "I was wearing my seat belt, I don't know what you're talking about".

Other traffic stop reasons are trained in same manner.

The officer will never say, "I clocked you at xxx mph"

He will instead say, "Is there a reason why you're driving at xxx mph?" in hopes that you will offer a defense of your speeding or that you will say, "No, I was just not paying attention..." etc

All such responses are tantamount to a confession of guilt.

And anything you say out loud can then be used against you if you attempt to fight the charge in traffic court.

Ask for a trial by jury. They will almost certainly drop it.

In the year 2009 in virtually every jurisdiction, here's what it takes to receive a trial by jury (as is your right).

1) You will have to appear in person (or pay an attorney to do it for you) on the cited court date

2) You will be forced to wait until all of the NoContests and Guilty defendants have entered their pleas and had their cases (if neccesary) heard by the court judge.

3) You will then be given another court date and ordered to appear in person for the trial.

All in all, a likely three to five hour experience before you even see the trial. If that's worth $100, knock yourself out. But the OP in this thread mentioned the charge is in another state 1000+ miles from home.

Good advice B-man, you need a thread on how to respond when being stopped. A lil Q&A, seems like a lot of the guys here are getting stopped, and maybe you could help them get away with out ticket?

Where I live (akron ohio) all city works must live in the city. We bought a house in an allotment that counts for city employees, but isn't city schools. We have 5 police officers that live on my street, our kids play together, have a detective across the street, and patrol officers next door and behind me. My brother gets arrested almost weekly, so I know a lot of them. If I get pulled over, they tell me slow down and put your seat belt on. Couldn't tell you the last local ticket I got. Probably happen tonight right?

Not sure what it takes in most states. I know in FL, I pulled into a valet backwards at about 5mph on a 15mph street (the valet sign said valet on both sides).

Cop pulls up and gives me a reckless driving ticket for driving the wrong way.

I sent a letter to the courthouse with an explanation and requesting a jury trial. My reckless driving charge was reduced to improper parking and a $25 fine via mail.

Not sure about all states, but worked in FL.

The other thing I highly recommend is if you are ever pulled over, tell the officer that while you respect his rights to pull you over, that you will record the conversation. Then push some button on your sell phone or camera button. Even if it doesn't record more often than not the cop will say, sir you were driving too fast, here's a warning please slow down.

They want nothing to do with being recorded.

a) it will piss the cop off
b)it also puts him on ultra professional mode, eaning he will cross all t's and dot all I's
c) he will record the entire stop in writing.
d) that 'recording' then becomes evidence and can be subpoened by the prosecution, and you if you say,"I wasnt really recording anything." Then two things happen 1) you look like a complete asshole in front of the judge 2) the judge also labels you a liar and not credible.

trust me on this one....

also on this type of ticket you arent entitled to a jury, it's not a criminal offense but an infraction....

Plenty of officers out there who record everything themselves and the citizen doesn't even know it. The officer doesn't care, trust me. Most officers will get the license and insurance from the driver, go back to the car to write the ticket, and then have the driver sign it after going over the ticket.

wow...things are different in TX for sure...in Colorado, where I worked the streets, no jury trial on infractions...sorry each state has it's own snafu's...

So everyone who rides a motorcycle legally in Pennsylvania without a helmet has all the necessary and proper insurance limits? My point is that the two laws contradict each other. The taxpayer comment does not work in this case.
