Hmmm...I just thought of something....Maybe I should pay off my 44k in student loans WITH credit cards and then file for bankruptcy??? ...

With $60k in debt and $45k in income it will be hard to get approved for chapter 7 bankruptcy which would wipe your slate clean. The courts would probably approve you for Chapter 13 which is more or less a repayment plan of your debt over 3 to 5 years. But you never know what can happen, find a good bankruptcy attorney and get a consultation. Let us know what they say.

Different situation.....here is what sux....
Im 34.
Graduated with a bachelors and masters degree.
No parents, so paid it all myself via student loans.
I have $60K in student loan debt.
I work as a chemistry teacher and varsity football/track coach. My payments are near $400/month.
Cant file bankruptcy on this debt and it is killing me, saying i dont make a crapload like most you guys.

Anyone have any ideas besides the peace corps,etc. I know some of youe slick sob's can figure something out for me.

It's tougher than it used to be. The Republicans gutted the bankruptcy statutes early in Dubya's 1st term.

You will have to pay on those credit cards for up to 5 years because they probably be able to force you into a chapter 13.

Lawyer and filing fees are higher also.

Its just like a gambling debt you bunch of losers you spent what you didn't have and think its ok to just not pay it. Punter you should be ashamed with this post. What if someone stiffed you on a bet, you would be pissed. Its the samething here pay you way in life you bunch of losers. Don't do it on purpose.

Question regarding student loans.I havent made a payment on my student loan in 10 years. I have been living offshore the whole time. I checked recently and i noticed it went from 8k to 44k. Does anyone know if I could call them up and pay off the inital loan and not all the interest that has accumulated on top of it. $36k in interest is insane.

Why the F&%$ did you just not pay the damn bill? How come people think life is free and you shouldn't have to pay your bills? Honor your committment.

while i do pay all my bills and have no problem doing it let me ask this question. Shouln't at least some of the blame here go towards the mortgage people that lent money to people that had no business getting the huge loan they got. I mean I have a friend, his mortgage payment is 62% of his take home pay. Now can't we all agree that its pretty stupid of banks to have lent him that much money. While it is his fault for borrowing to much it is also the banks job to not let him barrow to much is it not? It seems to me that alot of the people looking to file bankruptcy are doing so because of their mortgage. IMO at least some of that blame goes to the banks for doing really bad business. After all, these are the people that are supposed to be the experts in the loan department not some guy that is an plumber. These banks should've known that lending 178,000 to a guy that make 32K a year probably isn't a great idea and could end badly for them.

Your medical bills are HIGHER; Your car loans are HIGHER; Your insurance is HIGHER; Getting a bank loan or mortgage is HIGHER; EVERYTHING costs more when you use a lawyer. Meanwhile these people vacation in Hawaii and own multiple homes.
Do NOT use a Lawyer for ANYTHING if at all possible!

You pay MORE for everything BECAUSE of Lawyers. Stay away from them till the LAST resort!

Well, when I work 60-80 hrs a week from august - december with teaching and tons of coaching hours, its hard to get a part time job. Also, i do get paid for coaching, but it is a mere 2K for the year. So, yes, my best bet is to get a part time job on the side. But when you are against a mountain of debt (60K)....what is small time job gonna do......I guess i should look at it like just trying to chip away as much as i can.....basically it is just deflating to say thel least

auggie don't listen to these queens... the law is there for you and it is not the cake walk people make it out to be. i know that they have changed laws to where you will have to give up some shit you don't want to lose and you are going to have to pay some of your debt...

but life is too fucking short to spend every day sweating this shit and bailing on something you love, like coaching, because of debt.

i believe their are young attorneys out there who will coach you through this stuff for as little as $500 which is a small price to pay for peace of mind.

I think you can get the bankruptcy forms for free (or a small fee) from some legal website. Try a google search).

I want to have my will done shorty, but don't want to pay an attorney to basically fill in the blanks.

Filed in Florida 5 years ago, and one of my employees is going to court next week for his bankruptcy hearing.
Basically it's this: If you have personal material worth over 1000 then they want it. So for TV's and such big item things: YOU DON'T OWN them and have a 27 inch used TV. You also will lose you car, but only and I'll say again only, if you claim it on your file. Otherwise your finance company doesn't give a shit if you file. All of your clothing and houseware is USED. It's worth next to nothing. If you make in a year what your filing for (make 40 and are 40 in debt) then the court won't blink a eye. If you make 100000 and you want to file on 40k then you'll be asked to go Chapter 11. You have ability to pay them at least at 40 cents on the dollar, then your goin to be in Chapter 11.

Note: Once you obtain a lawyer, the first phone call from a creditor, you tell them that you filed and they can never again call you.
Note: Once your case is heard and done with, check your credit report. I had 4 creditors that were cleared in Bankruptcy but they didn't report it to the credit bureau. Check it 3 months after court.
Note: In 5 years my score went from 510 to 720. I made mistakes in my younger years. I fixed it and take great pride in my score nowadays.
