A California appellate court last week issued a ruling that supports a lawsuit challenging a state law that grants illegal immigrants heavily subsidized in-state tuition at California public universities and colleges. The court found that the 2001 law conflicts with federal law.
As I read the ruling, I asked the question the judges cannot answer -- as it is a policy issue best left to elected lawmakers: Why would a state subsidize the college tuition of students who cannot work legally in the United States when they graduate?
Does California not have enough educated, angry people?
Or does the state have so few angry, educated people that it sees fit to spend more than $17,000 per year on tuition for University of California students, more than $13,000 for California State University students and $109 per credit for some 15,000 or more community college students -- so that they can be unable to get a job that requires a college degree when they graduate? From what I've seen, employers who hire college graduates aren't anxious to pay professional salaries to workers who can be deported. Thus California's in-state tuition tax break -- and those in nine other states -- pave the long, expensive road to underemployment.
The law in question, Assembly Bill 540, was signed by Gov. Gray Davis, who told me six years ago, "I believe someone who spends three years in high school and on their own merit gains admission to a California college should not be denied the opportunity to complete their education because their parents many years ago many have decided to enter the country illegally."
I feel for those kids, whose parents broke the law and got them into this situation. But is the answer to let them pay in-state tuition -- still significant at $6,769 for UC or $3,164 for CSU -- for a degree that can't help them get a job?
John Trasvina, president of the Mexican American Legal Defense and Educational Fund, believes that the in-state tuition law works because after graduation, students may be able to work legally -- thanks to "changes in the immigration law and changes in their status." If students graduate with a technical degree, Trasvina added, employers can apply for an H-1B visa to hire them.
UC attorney Christopher M. Patti told me, "I think the notion is that they're kids who will ultimately be able to regulate their status. Many have been here for many, many years."
But UC doesn't really know what happens to these graduates. They may never become citizens, or they may work illegally -- no one knows.
According to UC stats, last school year, over 1,600 students benefited from AB540. Most of the beneficiaries -- 1,184 students this year, it turns out, are U.S. citizens, permanent residents, or legal immigrants, who did not meet the old residency requirements, perhaps because they went to boarding school or attended an out-of-state college before applying to grad school. As for illegal immigrants, 271 students are dubbed "potentially undocumented," while another 162 show some documentation. UC doesn't know how many undocumented graduates later become citizens or legal residents.

Last week Senator Jeff Sessions (R-AL) attempted to bring E-Verify to the Senate floor for a vote, but, once again, Senator Robert Menendez (D-NJ) has blocked E-Verify and won't let it pass unless he is allowed to add hundreds of thousands of foreign workers to our struggling economy. E-Verify, an inexpensive, effective, and indispensable work-site enforcement tool that instantly and electronically verifies the legal work documentation of new employees, has proven its worth as an essential tool in turning off the job magnet that encourages so many to enter the country illegally. If the program is not reauthorized, advances that we have made in the state legislatures such as Arizona and Mississippi with E-Verify as a cornerstone will be destroyed. Additionally, a new rule requiring federal government contractors to use E-Verify will be rendered worthless. If Senator Menendez is successful in destroying E-Verify, the United States will have lost one of its most effective tools in thwarting illegal immigration.
In an outrageous act toward American workers, Senate Majority Leader Harry Reid (D-NV) has turned a blind eye to Senator Menendez's actions and seems content to let E-Verify die. We have to let Senator Reid know immediately that the American people will not tolerate the Senate permitting E-Verify to die, especially after the House overwhelmingly passed a five year reauthorization of E-Verify with only two members voting against it. We are calling upon you to help us make sure that this doesn't happen.
Urgent Action Items:
Please, call your Senators and Senate Majority Leader Harry Reid's office (202-224-3542) today and every day until they bring E-Verify to the Senate Floor.
Tell your Senators to insist that their leadership not allow Senator Menendez to kill E-Verify and to bring H.R. 6633 to the Senate floor.
Call Senator Reid's office and tell him you want H.R. 6633 brought to the Senate Floor immediately with no strings attached.

E-verify In Danger of Expiring

The fate of the federal immigration verification system E-verify, a keystone of the immigration package passed by South Carolina lawmakers this year, now is being negotiated by senators who must renew the program in coming weeks or see it expire.

Because Congress plans an election recess by the end of the month and E-verify will expire in November unless it is renewed, Capitol Hill staffers say senators must make a decision soon on what to do with the program, which passed the House by overwhelming numbers in August.

U.S. Sen. Robert Menendez, a New Jersey Democrat who in August held up a bill to renew the program, has asked that in addition to renewing E-verify, the Senate also 'recapture' unused or unclaimed family and work-sponsored visas for the last 15 years, provisions critics say could allow up to 600,000 more immigrants and workers into the country.

'There is really only one person standing between E-verify and reauthorization and that is
Sen. Bob Menendez,' said Ira Mehlman, a spokesman for the Federation for American Immigration Reform. 'Given that our economy is losing jobs by tens of thousands every month, this is not the time to go looking for more workers to bring to the country.'

Co-sponsoring Menendez' bill are Senators Patty Murray and Maria Cantwell of Washington and Ted Kennedy of Massachussetts.


Holding up renewal of E-verify at a time when American workers need job security is unconscionable.

E-verify deserves to be reauthorized on its own merits and shouldn't be laden with all sorts of benefits for business interests. It is time to tell Sen. Menendez to step aside.

Illegal immigration is not a "victimless crime".

American lives are being disrupted or destroyed daily by the actions of “God’s children” in collusion with elected officials, business interests, media and radical ethnocentric groups. American interests are not present in amnesty or guest worker legislation. We are being taxed without representation to support this burgeoning welfare class with health care, schooling and other costs. Many of us are victims of crime from fraud and identity theft to murder. The vast majority of Americans are being sacrificed for the greed of a few.

In addition to being ignored by those elected to represent American interests, we are facing a virtual blackout in the media about the consequences of the illegal alien invasion. Horrendous crimes are in the local media for as short a time period as possible and are never part of the mainstream news. Costs and crime statistics are either not compiled or not made available to the American people.

Propaganda is spouted about the “poor undocumented illegal immigrant just trying to feed his family or looking for a better life”. Our federal government and others in the open borders coalition are banking on the complacency and compassion of the American people, but in case any dare to voice concern, groups are in place to label them ‘racists, nativists, xenophobes’ and such. Having been schooled in political correctness, this generally prevents most from speaking up for their rights as American citizens.

The American people need to hear the truth of illegal immigration. We must go on the offensive in order to change the focus from the ‘poor illegal alien’ to the rights of American citizens and their need for protection by our government from the grossly negative impact of the invasion. The best way to do this, we believe, is to change the language of the conversation on illegal immigration in this country.

The following questions and statement might be used in public forums, conversations, letters to the editor, or by any other means, to get the dialogue changed to addressing the American citizens’ rights and needs:

· Where is the compassion for the American victims of illegal immigration?

· Of what benefit to the vast majority of American citizens is legislation calling for any ‘path to citizenship’ for illegal aliens or for additional imported foreign workers? (This question truly silences aides in Congress!)

· I am always hearing about lettuce reaching $5.00 a head without illegal alien labor, yet no analysis on the cost of illegal aliens to the American tax payer has been demanded by Congress.

Senate Majority Leader Harry Reid (D-Nev.) has two honorable choices:
  • No. 1: Go around Sen.Menendez who has a "hold" on H.R. 6633, the "clean" E-Verify re-authorization bill passed by the House. Sen. Reid can bring this back-room filibuster to the Senate floor for a vote. If he does this, there easily will be the 60 votes necessary to stop Menendez and allow an overwhelming majority vote to pass H.R. 6633. (Reid reportedly doesn't want to do this because he doesn't want to force some of his Democrats to have to go on record just before the election.)
  • No. 2: Avoid a vote altogether by talking to Menendez privately, persuading him that what he is doing is threatening the reputation of the Democratic Party just before elections and get him to withdraw his "hold" on H.R. 6633. (This way, Reid could then bring H.R. 6633 to the floor in the "hot-wire" fashion which will pass by voice vote.)
Either way, the American worker and public wins. It is all about Reid doing one of those two things.
This is why we want you to put particular pressure on Democratic Senators to put an end to Menendez' shameful grandstanding. Fortunately, Senate Republicans are standing firm against Menendez.

SEN. MENENDEZ' E-VERIFY BLACKMAIL DEAL

After we told you that some Republican Senate staffers were working with Sen. Menendez (D-N.J.) for massive increases in foreign workers, you hammered Republican offices for not holding the line for a "clean" E-Verify bill.
Your efforts really worked. By the end of this last week, Republican Senate staffs were going into negotiations with Democrats and making it clear they were united in oppositiion to a foreign-worker surge at this time of 5-year-high unemployment and financial industry collapse.
Sen. Menendez apparently is not bothered by the 5-year-high official unemployment rate -- or even by the 292,000 additional American workers who went on unemployment in August alone. He is insisting that if we keep E-Verify, then we have to add another 550,000 foreign workers next year to the 1.1 million immigrants already scheduled to come.
(AS A REMINDER: E-Verify is the central tool for taking away the job magnet from illegal immigration. The U.S. Chamber of Commerce wants to kill it so outlaw businesses will have more freedom to hire illegal workers. E-Verify is the on-line system that businesses can type into for each new hire and find out if they are an illegal alien.
(If you live in Arizona, Oklahoma, Georgia -- or any other of the places that have started mandating that businesses use E-Verify -- your efforts to combat illegal immigration will be halted. )
THE MENENDEZ/SESSIONS WRESTLING MATCH

Thursday night on the floor of the Senate, Sen. Sessions (R-Ala.) tried to "hot-wire" a Senate bill re-authorizing E-Verify. This is a procedure that if nobody is on the floor to object, you can get a bill through. It is supposed to be for non-controversial bills. Sessions' point was that it shouldn't be controversial to simply continue this proven E-Verify program.
But Sen. Menendez stood up to object, saying that H.R. 6633 (the House-passed re-authorization) was better than the Senate one Sessions was offering.
Sessions then said that was fine and that he was changing and offering H.R. 6633.
At that, Menendez suddenly turned on the bill he had been extolling and said he wouldn't allow a vote on E-Verify unless the Senate agrees to add another 550,000 permanent greencards to the 1.1 million already slated for next year! He offered his bill with that surge, and Sessions stood firm saying "NO WAY."
This is what we have known about Menendez from the backrooms for some time, but it is the first time Menendez has exposed himself so clearly and publicly.
We cannot allow the enemies of America's workers to blackmail us. Even though E-Verify is essential in the fight against illegal immigration, we still have to be willing to let it die this week rather than allow massive increases in permanent foreign workers.
No, I am not being stubborn instead of practical.
Consider that the point of E-Verify is to protect American workers -- and communities -- from too many foreign workers.
Does it make any sense to get E-Verify passed by giving away hundreds of thousands more U.S. jobs to other foreign workers?
The point of our fight is to protect American workers and communities. E-Verify is the best tool going (although Congress needs to make it mandatory for it to really start pushing millions of illegal workers to go home). But we will have accomplished nothing by re-authorizing a voluntary E-Verify while flooding American occupations with another 550,000 foreign workers through Menendez' bill.

If anyone is hesistant to call: This is really easy to take so little time to do.
Both of my Senator (WA: Murray and Cantwell) staffers said they would pass the information on. It sounded like Murray may be getting a lot of calls. There was no answer at her Bellevue office but a voice message with a Seattle number that NumbersUSA doesn't have: 206-553-5545 (and a toll free that I missed). I left a message in Bellevue and called Seattle where when I said E-verify with no strings attached, the staffer asked "is that HR 6633?"
Our future depends on it! It takes only 2 minutes to call them both. We have an initiative gathering signatures in WA and the hard work in other states that depend on this!!!
I simply said: "my name is ________ calling from ________ and I would like to ask that Senator ________ help bring E-Verify to the floor with no strings attatched." Short, simple, but at least I got my first calls in! So easy that I am moving on to the Senate leadership calls (suggested by Bay Buchanan at Team America PAC):

Roy, I think you have made the right call on this. I am a Democrat, and I am disgusted by the cynical games my party plays with immigration. It is time for Harry Reid and the party to behave responsibly. I think that is the absolute minimum expectation of a party that is asking us to let them lead the country. We send these people to Washington to serve, but once they get there a lot of them seem to think their only job is to find ways to stay in Washington. Thanks to their calculated blindness on immigration and the irresponsibility of Menendez the party is going to take a hit on this, but it is their first responsibility to do what is right for our country. Tens of millions of American workers and their families shouldn't have to take the hit in lost jobs and lower wages. It is time for elected Democrats to remember what it is to be a Democrat. Let us be proud of them again, instead of ashamed.

Sadly we are represented[?] by the Senator whose position on e verify is the source of the problem. His pal , Lautenberg[Sen], is on board with him. So I ask you, how effective would a fax to their offices be? I suspect it is a waste of time but I will be sending it to them if you encourage it.

Even if a Representative or Senator is unlikely to support our positions, your calls and faxes can (and often do) make them pause before committing themselves to something they know is unpopular. We are in a financial mess right now and we don't need 550,000 more foreign workers in this country to take away jobs from Americans and increase the services required for the foreign workers paid for by American taxpayers. Most white collar jobs who will be consuming these half million plus green cards already check for legal status so E_Verify does not help the American workers affected.
Essentially Menendez is asking for a real permanent giveaway for a promise of action - something that has already failed in our entire financial system as we know very well last week. The law is already on the books - E-Verify is simply one tool.
Let it die - this compromise is NOT required and NOT worth it.

To All Americans. I live in southwest Missouri where we are becomming over-run with known illegal Mexican workers with families. Most are somehow getting welfare with free doctor care and welfare. I called my two Senators this morning to talk about the House approved H.R. 6633 E-Verify Bill that is now in the Senate being held up by one Senator, New Jersy Menedez. Both staff members I talked to said they are receiving calls about this subject from the time they open till the time they close. I ask you all to not be afraid to call your Senators. Talking to a staff member is easy to do. They will listen and are requiered to report all calls and faxes, etc. If you are to shy to talk to a staff member you can call early in the morning and leave a message. They also are all heard and reportted. I at this time am watching Presidential runner McCain talk about Immigration reform. He is saying that we need these foreign workers for the good of America. But what he is not talking about is the millions of American's out of work already from the illegals here now being hired by greedy owners of factories and all businesses. Right now I need a new roof put on my home because of the tornados that hit our area. I called out to my home 5 contractors and ALL had Mexican worker crews. I asked all if they checked to see if they were leagally here to work and ALL 5 said they did not care. I was floored by this and told them all what I thought of them and of course did not hire them. We all need to do this. I need my roof fixed bad but I cannot and will not hire any foreign workers to do the job. Please use Nummbersusa's tools to fax, call, or write your Congressmen/womwn. It does matter. I have a file full of return letters from mine that I keep so I can go back on them if they do not vote for American's. P.S. I am voting For Bob Barr. Horry County Minuteman Chapter to Protest Mobile Mexican Consulate


In yet another invasion of a foreign government into the lives of the American people in general and South Carolinians in particular, the Mexican Consulate from Raleigh North Carolina has decided to come to Conway, South Carolina this Saturday September 27, 2008 to provide questionable services to Mexican nationals who reside (legally and illegally) in the area. St. James Catholic Church at 1071 Academy Drive, Conway SC has decided to serve as a Sanctuary for the Consulate and the Mexican illegal aliens that will use the services provided by this so-called “mobile” consulate.

The Horry County Chapter of the Minuteman Civil Defense Corps plans to stage a protest across the street from this sanctuary church, beginning at 7:30 AM. Chapter leader Mr. Michael Visnjic organized the protest. “One of the primary functions of this consulate is to enable illegal aliens to acquire documents that likely will result in the illegals getting a SC driver’s license, food stamps, among other services to which only legal citizens and American citizens are entitled. We cannot sit here idly and allow for this to take place. Our Horry County residents need to be made aware of what is happening right here in our own back yard. We hope the protest will awaken our fellow citizens of what is taking place,” stated Mr. Visnjic.

Mr. Visnjic went on to say, “This action by the Mexican Consulate will encourage more illegal aliens to invade our area. We already know the consequences of their invasions: crimes, document fraud, and more loss of jobs that South Carolinians desperately need. At a time when unemployment is at an all-time high, we must put a stop to this invasion.”

The protest will begin at 7:30 AM and last until the mobile Mexican consulate departs.

Two Days Left to Demand a 5 Year E-Verify Reauthorization


E-Verify is in true jeopardy right now and unless your Senators act now we are in jeopardy of losing the basic tool that helps companies determine worker's eligibility and weed out illegal aliens!
Our sources on Capitol Hill tell us that instead of responsibly reauthorizing E-Verify for the necessary full five-year term, Senators are going to pander to special interests and the Senate will only extend E-Verify for six months in a continuing resolution (CR). A CR is a stop-gap spending measure meant to keep the government from shutting down after Congress adjourns since Congress failed to pass any spending bills this session.
We understand that this agreement was meant to appease cheap labor business interests who want to kill E-Verify — especially in the states that have made it mandatory for their employers. But, because they know that the American people would not stand for Congress to kill E-Verify right before an election, they have decided to punt this political football through the next election and into the next Congress where they feel they will be in a much better position to kill it or use it as a bargaining chip in a large amnesty measure.
It is outrageous that in this turbulent economy, the Senate would bow to the cheap foreign interests and eliminate one of our most effective, efficient and accurate work-site enforcement tools designed to keep illegal aliens from displacing American workers.
Please understand that when you call, Senate offices will try to tell you that E-Verify will be on the floor this week. But what they are really talking about is their attempt to shove E-Verify into the CR with a six month only extension. We need to let them know that this is unacceptable and that E-Verify must be brought to the floor as a stand-alone bill and reauthorized for a full five year term.
Action Items:
Call your individual Senators (202-224-3121) and Senate Majority Leader Harry Reid's office today (202-224-3542) and tell them to bring H.R. 6633, the House bill that authorizes E-Verify for five years, to the Senate floor.

Continue Pressuring Senate to Pass H.R. 6633; CR Clears Congress With Short-Term E-Verify Extension

Today, the Senate cleared a Continuing Resolution (CR; H.R. 2638) that, among other things, extends the E-Verify program through March 6, 2009. However, there is still a chance for Senators to take up H.R. 6633 -- the House-passed, five-year E-Verify reauthorization bill -- before recess. If you want to avoid another debate in a different Congress with a potentially more challenging political climate, please call your Senator today (202-224-3121) and ask him/her to pressure Senate Majority Leader Harry Reid (D-Nev.) to allow a vote on H.R. 6633 this weekend or on Monday.


Congress needed to pass a CR before October 1 – the beginning of Federal fiscal year 2009 -- in order to keep the government running because it had not passed any fiscal year 2009 spending bills for Federal agencies. The inclusion of a short-term E-Verify extension in this must-pass measure is a bittersweet development.
Although E-Verify will survive for four more months, the reauthorization battle will need to be fought all over again with a new President in the White House who may or may not support the program. As such, the best outcome continues to be Senate passage of H.R. 6633, the House-passed E-Verify reauthorization bill.
There are two ways in which Majority Leader Reid can still facilitate a vote on the bill:
1. Ignore the hold Sen. Robert Menendez (D-N.J.) has placed on H.R. 6633, and allow a cloture vote on the Senate floor. If he does this, there easily will enough votes necessary to stop Menendez' filibuster and enable passage H.R. 6633; or
2. Avoid a vote altogether by talking to Menendez privately, persuading him that what he is doing is threatening the reputation of the Democratic Party just before elections and get him to withdraw his "hold" on H.R. 6633. Reid could then bring H.R. 6633 to the floor for a unanimous consent vote.
Either way, the American worker and public wins.
It is particularly important to put pressure on Democratic Senators to put an end to Menendez' grandstanding. If you call Republican Senators, please thank them for standing firm and ask them to not flinch.
Good news from the House. On September 23, the Judiciary Committee did not take up H.R. 5882, which would add an additional 550,000 permanent green cards next year, and H.R. 5924, which would add 20,000 additional foreign nurses per year for three years (plus their families). It is not known if the bill’s proponents will attempt to attach the measures to another bill destined for passage. http://numbersusa.com/actionbuffet
