Sen. Robert Menendez has put a hold on the reauthorization of the E-Verify program. As you know, E-Verify allows employers to determine the legality of their potential new hire. This program is up for reauthorization and many anti-American worker congressmen have been trying to hold the bill up.



Right now, Republican Senators are holding the line against Menendez' incredibly insensitive demands during a severe economic slow-down and soft job market.



But several of the Republicans are starting to negotiate with Menendez because he is indicating he might lift the hold if they give him only 100,000 permanent additional greencards.





All Republican Senators need to hear that they should not negotiate in any way with Menendez because Congress should not be increasing immigration by one greencard while American workers are being laid off.





The fact is that the Democratic leadership in the Senate knows that it can't kill the E-Verify program now that it has become so public. The Republican Senators should just demand that E-Verify go through as a clean bill like it did Wednesday in the House of Representatives.





There are indications that the Democratic Senate leadership wants to push the re-authorization of E-Verify through before the Senators leave town this weekend. There may be a vote tomorrow. Negotiations are furiously proceeding at the moment. We are in danger of bad decisions being made. Urge the Republicans to stay steady and hold the line. It is better to put this off until September than to rush it through and undermine America's skilled workers and the kids who are studying to become skilled workers.

Improved E-Verify Legislation Expected to Pass the House


Under mounting pressure, members of the House came to an agreement to improve the E-Verify reauthorization bill and send it to the floor. The bill, H.R.6633, is awaiting final passage, but is expected to pass the House later tonight before the House adjourns for the August recess.
The reauthorization language was not all that we wanted, but it is an improvement over language that was originally drafted. The bill that passed the House today:
  • Reauthorizes E-Verify, but for five years, not 10 years as in the original bill;
  • Includes a waiver provision that allows the Commissioner of Social Security Administration to use money on E-Verify if appropriations are delayed;
  • Requires Homeland Security to make advance payments to the Social Security Administration for the operation of E-Verify.
Thanks to your calls during the past week, the House version no longer contains language that prohibits the Social Security Administration from using any of its money - no matter how small or for how short of a time - to operate E-Verify.
We have made some progress in the House, but there remains a deadlock in the Senate. FAIR has learned that Senator Robert Menendez (D-NJ) is still placing a hold on the legislation in effort to get more visas for foreign workers. With legislative days running out and special interest groups pounding at their doors, the Senate may be tempted to pass Menendez's language. It is therefore critical that you continue to contact your Senators and tell them you want E-Verify reauthorized—NO STRINGS ATTACHED!
Please keep calling your Senators and tell them:
  • E-Verify is the most effective program available for ensuring our workforce is legal and combating illegal immigration.
  • You insist that they immediately take all steps necessary to reauthorize E-Verify for at least 10 years-- if not more.
  • You demand they reject any attempts by any members to add special interest language to the reauthorization bill.

We need a full phone blitz all this afternoon so that not a single Senator can claim to be unaware of public outrage that they are considering huge immigration increases on a day when terrible news about American jobs was announced (see below).

These are the messages from which to pick (imagine thousands of phone calls pouring in over the next few hours):

Does the Senator support re-authorizing E-Verify, without any increase in foreign-worker visas?

Don't leave town without quickly approving a CLEAN re-authorization of E-Verify. Pass the version the House passed Thursday in H.R. 6633 -- five years with no strings attached.

The nation's businesses need to know they can rely on having E-Verify there to help them prevent illegal foreign workers from taking jobs from Americans. Don't spend August back home with E-Verify's fate still uncertain.

Don't you dare give an inch to Sen. Menendez (N.J) and his efforts to link passage of E-Verify with a huge increase in importing foreign workers. His S.3414 bill is a shameful attack on American workers. NO EXTRA VISAS.

The U.S. Department of Labor announced today that nonfarm payrolls fell for the 7th straight month. How could the Senate possibly consider bringing one additional foreign worker into the country under these conditions.

Since December, 463,000 American jobs have been lost, the government announced today. How can the Senate allow Sen. Menendez to hold up E-Verify for the ransom of giving away 550,000 additional American jobs permanently to foreign workers?

The Labor Department reported today that unemployment now stands at a four-year high. How can the Senate allow Sen. Menendez to continue to insist on importing hundreds of thousands more foreign workers?

With the average work week for Americans now down to 33.6 hours -- an all-time low -- what insanity could cause the Senate to allow Sen. Menendez to hold up E-Verify authorization because he wants to bring in 550,000 more permanent foreign workers?


Friends, the urgency is compounded by the fact that the House subcommittee on immigration just this morning passed H.R. 5882 to immediately add the 550,000 permanent foreign workers sought by Sen. Menendez -- and to increase permanent foreign workers for the future.

I am white hot with anger at the unbelievable insensitivity of so many Members of Congress to the concerns of the regular working man and woman, and their families, in this country. You can be sure that many of these same cheerleaders for high immigration will campaign throughout August about their concerns related to the softening job market.

We cannot let them leave Washington this weekend without letting them know that their concerns mean nothing if they don't stand up to the attempts to bring more foreign workers into this country.

Senate Majority Leader Reid knows he needs to re-authorize E-Verify before he gavels things down this weekend. He will do whatever he can to provide extra foreign workers to Sen. Menendez in order to get him to take his "hold" off E-Verify -- unless the switchboards light up today in protest.

Congressman Paul Broun (R-GA) thinks we should insist that these demonstrations of national unity be in English.
He has just introduced the Pledge Language is English Declaration and Government Endorsement Act of 2008. His bill bars federal funds for educational institutions that allow the Pledge of Allegiance and the National Anthem to be in languages other than English.
These are public declarations of patriotism and national unity. They were composed in English and were meant to be recited or sung exclusively in our national language. But schools in New Mexico, Arizona, and Wisconsin are permitting and sometimes requiring the Pledge of Allegiance to be recited in Spanish and other foreign languages.
Help Congressman Broun put an end to this.

Not only does the bill mandate the end of the program on its one-year anniversary, the bipartisan bill goes further. It would also restrict any more authority to operate beyond the border zones from being doled out to Mexican motor carriers without prior approval from Congress.
The bill drew immediate support from the Owner-Operator Independent Drivers Association.
“Our members have been active in fighting this program for a long time by voicing their concerns to lawmakers and we thank them for staying involved,” said Todd Spencer, OOIDA executive vice president.
Rep. Peter DeFazio, D-OR, along with co-sponsors Rep. James Oberstar, D-MN, Rep. John J. Duncan Jr., R-TN, and Rep. John Mica, R-FL, introduced HR6630 late Tuesday, July 29.
Rod Nofziger, director of government affairs for OOIDA, said the sponsors of the bill are looking to fast track the bill to the House floor for a vote.
The House Transportation and Infrastructure Committee made short order of passing the bill during a mark-up session on Thursday, July 31.
DeFazio, along with all three of the original co-sponsors, voiced displeasure with the administration’s insistence to carry on the program despite its funding being cut.
“We’ve been over all of this before,” DeFazio said in disgust as he highlighted just a few of the problems with the cross-border program – including lack of equivalent licensing, drug testing and hours-of-service compliance in Mexico.
“These issues have not be satisfactorily addressed or resolved by the administration.”
In less than 20 minutes from introduction in committee, the bill was passed unanimously on a voice vote.
“The leadership of the House Transportation and Infrastructure Committee are looking to pass this bill out of committee and have it teed up for a vote by the full House when they return from August recess,” Nofziger said.
The bill calls for the ongoing cross-border trucking program with Mexico to end no later than Sept. 6, 2008 – one year to the day after the program was launched by the U.S. Department of Transportation.
“There is little doubt the administration will try to extend the program beyond its anniversary. They’ve consistently ignored Congressional directives to terminate it. It’s vital that this bill be passed,” Spencer said.
As a first matter of business, the bill mandates an end to the current demonstration project. But, in a move to prevent any other programs from cropping up, the bill also seeks to restrict the U.S. Department of Transportation from granting authority to any more Mexico-based motor carriers to operate beyond the commercial zone after Sept. 6.
The bill goes far beyond just seeking an end to the current program and preventing a new one from starting up, DeFazio and the co-sponsors obviously want to know the real impact of the program. The bill mandates a couple of different reports dissecting the goings-on in the program.
First, the bill reiterates the fact that the DOT’s Office of Inspector General is to complete a report reviewing complete compliance of the program as required by Section 6901 of the U.S. Troop Readiness, Veterans’ Care, Katrina Recovery and Iraq Accountability Appropriations Act of 2007.
Such OIG audits have been required since the passage of the 2002 transportation appropriations legislation Section 350. However, that legislation only required the OIG to sign off on FMCSA’s compliance on just eight provisions within Section 350 and update its audits annually. DOT officials could just certify that the department complied with the rest of Section 350.
Not so anymore with the passage of Section 6901. The Inspector General is now required by law to certify DOT’s compliance with 22 additional provisions for conducting a cross-border program with Mexico.
DeFazio’s current bill calls for the audit of the 22 additional provisions to be completed 60 days after the bill is signed into law.
HR6630 also addresses oversight of the program. The bill seeks to establish an independent review panel that is to report to Congress on a variety of aspects of the program.
The independent panel is called on to:
  • Evaluate the effects on motor carrier safety, including an analysis of any wrecks involving motor carriers participating in the demonstration project;
  • Recommend modifications to the process of granting authority to Mexico-based motor carriers to operate beyond the commercial zones; and
  • Recommend modifications needed for monitoring future operations of participating carriers.
The bill also calls for the secretary of transportation to report on a variety of details on the program in a report to Congress.
The secretary would be required by the bill to report to Congress:
  • The number and names of U.S. and Mexico-domiciled motor carriers that participated in the program and how many vehicles each one utilized;
  • The number of border crossings by each of the participating carriers, including the number of crossings that resulted in the motor carrier operating beyond the commercial zone;
  • An itemization of safety and operations violations found in pre-authorization safety audits, compliance reviews and roadside inspections along with a breakdown of the most frequent violations;
  • A cost analysis to both the federal government and the states for implementing and overseeing the cross-border program; and
  • Steps taken to terminate the authority to operate beyond commercial zones of motor carriers participating in the program after the end of the program.
The bill more than likely will not be voted on by the full House until members return from their August recess. Despite that lull in congressional action, Nofziger said it is still very important to voice your support of the bill for an impending vote on the House floor when they return.

Beyond E-Verify: Immigration Software Aids in Compliance Protection

Keeping up with immigration and work authorization information can seem like a paperwork nightmare, but several software companies have come to the rescue. These programs offer verification and management functionality not available in the free E-Verify system offered by the federal government. In most cases, these software solutions integrate directly with E-Verify, the Web-based work authorization verification software that uses data from the Department of Homeland Security (DHS) and the Social Security Administration (SSA).

Developing employee verification procedures and using compliance software are two ways to help shield your company from liability associated with unknowingly hiring illegal aliens. Given the high number of employees with foreign backgrounds that now work in the pallet and lumber industries, you could be at risk of violating immigration laws unless you verify the work status of new hires.

Additionally, President Bush recently signed an executive order requiring all federal contractors to use the E-Verify system. This directly impacts any pallet or lumber company that supplies the military, General Services Administration or other government agencies.

E-Verify uses information from the federal I-9 form that all new hires are required to file with employers. These forms can be complex because of the many different types of identification and work authorization categories. The I-9 compliance software can eliminate confusion and simplify the process. A list of leading software products is available in the sidebar on page 43.

Major benefits of I-9 software include:

• Assistance in properly completing I-9s.

• Error alerts when data is incorrectly entered.

• Sample documents aid in identifying fake documents.

• Eliminates the need for paper records, even allowing for electronic document signature.

• Assists third-party firms in auditing your I-9 records.

• Integration with other human resource and payroll software.

• Electronically tracks expiration dates and notifies the HR department of employees where action is required.

• Prohibits use of duplicate information within a company.

• Seamless interface with E-Verify.

These benefits help to reduce time needed to process I-9s while providing the peace of mind and management needed to keep your company from violating immigration regulations. Searches are based on the 444 million records in the SSA database and more than 60 million records in the DHS immigration databases.

E-Verify is the basis for all these programs although the government database itself is far from perfect. E-Verify does not verify the authenticity of a person’s identity for employment purposes; it only checks the identity against matching information in the Social Security and DHS databases. Furthermore, there is evidence that some employers’ application of E-Verify may actually encourage identity theft by prospective employees who want to ensure that their information runs though the system without a problem.

E-Verify is not failsafe because it relies on Social Security data, which has a 4.1% error rate. If all employers in the country were to use this system, as many as six million U.S. citizens and legal residents could be denied employment because of bureaucratic error. In addition, the error rate for legal foreign-born workers is estimated to be nearly 10%. This could lead to discrimination lawsuits unless employers follow established procedures that apply to all employees.

Due to these problems, some are leery of using E-Verify. In 2007, for example, Illinois passed a law prohibiting employers from using E-Verify. DHS countered by asking a court to declare the Illinois law illegal. The law was scheduled to take effect this year, but Illinois agreed not to enforce it until the lawsuit is resolved.

Despite E-Verify’s potential glitches, John M. Hermann, chief executive officer of Form I-9 Compliance, said that those working with I-9 compliance generally are in favor of the system because it is the best solution available.

Many state legislatures mirror this view and have passed laws in favor of E-Verify. Arizona Gov. Janet Napolitano signed the Fair and Legal Employment Act, which requires employers to use E-Verify to show that employees are legally authorized to work. The bill also includes the most aggressive penalty currently in the U.S. against employers who intentionally or knowingly hire unauthorized immigrants. Offenders could face what is known as the “business death penalty,” a permanent revocation of the employer’s license to do business in the state.

HOW TO STOP 90% OF THE BORDER CRISIS IN 90 DAYS

When I set out to make my documentary, BORDER, it was my intention to cast a spotlight on our border crisis, to bring to the attention of the American people the incredible level of danger that exists along our 2000 mile border with Mexico. I was able to expose a number of situations that have outraged people all across the country: the rape trees where drug cartel “coyotes” hung their trophies; the border ranchers who found bodies on their property, along with tons of trash and vandalism; the immigrants themselves forced into horrifying acts to survive in the border deserts; the border patrol and sheriff units who find themselves outgunned and outmanned by increasingly dangerous drug cartel narco-terrorists and politicians who are hand-cuffed by bureaucratic lethargy and corruption. However, the deeper I delved into the fates of both the legal border resident and the illegal alien, the more I realized that the American people need solutions. After a while, our citizens become anesthetized to the violence and the extreme deprivations, just as they have become anesthetized to the casualties of war.

Given the opportunity to support ideas that can work, our citizens will make the calls, send the emails, open their checkbooks and pressure for the kind of change that can turn our border from a cesspool of murder, kidnapping, rape and torture to a region where laws prevail. I find it simply mind-boggling that this story is not all over the news every day. It should be a top issue in our country and, unfortunately, it’s been swept under the carpet too many times.

In an election year where our presidential candidates have been loath to offer detailed solutions for our border crisis and the levels of illegal immigrations that exist, I came up with what I call the S.T.O.P. plan. It’s a four point border fix plan that I believe can stop 90% of the border crisis in 90 days. I have already received the enthusiastic support of a number of border sheriffs who work on the real frontline of America, but I have yet to hear from the presidential candidates who can make this plan work.

Here is what I propose:

1) Secure the border. Empower the U.S. Border Patrol and local law enforcement by giving them the needed resources to bring law and order to the border. Supply them with the money, equipment and manpower that are lacking to save American ranchers from the marauding immigrants and narco-mercenaries that are destroying their property and profiting from human and drug trade.

Give them the needed resources to end the rapes and vicious assaults on Mexican women who are crossing in the desert by:

A) Build the four layer fence in high traffic areas to work as a force multiplier for the rank and file Border Patrol agents.
B) Deploy either National Guard or Federal troops to confront and engage narco-mercenaries head-on where needed, (an already proven method as seen in the documentary BORDER) until the Border Patrol is completely prepared.
C) Enforce existing employment laws. This is the number one request of The National Border Patrol Council.

2) Tax: Tax wire transfers that leave the country. Last year, more than $62 billion was sent to Mexico, Central and South America and the Caribbean from the United States alone. By levying a remittance tax, funds could easily be collected wherever wire transfers of money are purchased.

3) Oil for social services: The time is now to bill Mexico for the social services incurred by undocumented Mexican immigrants, including education, incarceration and medical care. For every day a Mexican national is in a U.S. hospital, school or prison, our government should bill the Mexican government one barrel of oil per person. The business of America has always been business. We are providing services, but we aren’t billing for that service. Instead, we pass the bill to American taxpayers—taxpayers who are tired of carrying the load.

Mexico may be cash poor, but they are one of the five richest countries in natural resources on the planet. Mexico is one of our top three importers of oil and natural gas.

4) Post the Bond: Once the first three parts of the STOP program are implemented, the need to establish a reasonable and efficient guest worker program can be created.

In our plan, immigrant workers post a bond at a legal port of entry at the border. Foreign nationals seeking employment will check in at the front door. They will be issued a tamperproof id card. Any employer employing a foreign national without such card pays an automatic $10,000 fine per employee.

Such a system would enable U.S. officials to effectively track and monitor those who are entering our country. For the first time we would know who they are, why they are here, and that they are healthy and not a burden to U.S. taxpayers.

While working in the U.S., a percentage of their pay goes back to the bond/escrow account. When their work visa expires, they will have accrued a sizeable amount of money in the account. The foreign national collects that money and goes home. However, if they are even a day late in leaving, all monies in that account are forfeited to law enforcement.

Money is what drives the vast majority of people to illegally cross the border. Money is what will encourage visa compliance.

This program separates the drug dealers and criminals from the immigrants seeking honest work. This plan will work most effectively if we bid out the bonding program to a private American corporation like American Express or Visa. At any given time, Fed Ex can give us the whereabouts of our packages. Our lawmakers admittedly have lost track of 12-20 million people. Adopting such a system would put the pressure on employers who will be forced to pay an exploited foreign work force competitive American wages and related benefits.

The S.T.O.P. plan does not answer all the questions it raises, but it’s the first in hopefully a number of concrete steps we need to take to solve the border and immigration crisis. A healthy debate on the issue will hopefully lead to a discussion amongst our lawmakers as to what steps we must take to bring peace, safety and law and order to a very dangerous situation that should not continue to exist on this, the southern border of our country.

Menendez of New Jersey and Rep. Lofgren of California fought to import hundreds of thousands of additional foreign workers. This morning, Rep. Lofgren shoved her foreign worker bill through the House immigration panel, not allowing amendments to protect American workers; Sen. Menendez last night introduced his bill for 550,000 more foreign workers while continuing to hold hostage a bill to re-authorize the E-Verify system to keep illegal foreign workers from taking Americans' jobs.
Why would any politician possibly think it is good politics to increase foreign labor importation over its already unprecedented high level at the same time that the Labor Department was announcing:
  • Nonfarm payrolls fell for the 7th straight month.
  • Since December, 463,000 American jobs have been lost.
  • The official unemployment rate now stands at a four-year high.
  • The average work week for Americans is now down to 33.6 hours -- an all-time low.
What insanity could cause the Senate to allow Sen. Menendez to hold up E-Verify authorization because he wants to bring in 550,000 more permanent foreign workers?
Rep. Lofgren has a history of callous behavior toward American workers, but her actions this morning put her on some kind of Olympic level for insensitivity.
If anybody ever doubted that the immigration issue causes a lot of leaders and elites to suffer from a form of mental illness, today should make believers of us all!

Take a lesson from California. If Gov. Arnold Schwarzenegger didn't have an illegal alien problem costing Californians $10.5 billion per year, he wouldn't have to eliminate thousands of part-time and temporary positions and order that up to 200,000 state workers receive the federal minimum wage.

What can cause this senator to delay such a critical component of enforcing our law? Especially in New Jersey where there have been horrendous crimes suffered by the people he supposedly respresents. Senator Menendez needs to realize just as Mayor Newsom that the hard working Americans pay his salary, not the illegals invading our country.
I wish the news reporters would ask Menendez what his reasoning is, but the news reporters are walking on egg shells around this issue too. We as Americans are going to have to ask our future senators right out how they feel about immigration, if they are pro, people of America, please do not vote for them!!! Soon no American will be able to get a decent job with decent wages and benefits. Our country and its laws are deteriorating at an alarming rate, we need to vote these senators out of office that have a grudge against hard working Americans.

The only way we are going to get a clean (no more foreign workers) E-Verify program passed, is to keep calling and faxing. Don't let up...pick it back up in September! I don't believe for one second that the pro foreign worker congress men and women have lost their minds. They know exactly what they are doing. They are transferring wealth from legal Americans to foreign workers to generate votes for themselves. Simply put, they are buying votes with our money. So keep faxing and calling. Together, we are our only hope.

Thank god for groups like NumbersUSA and FAIR that tell the truth of what is going on in Congress.

I have talked with H1B workers who have engineering and other advanced degrees that are working long hours in a gas station because their jobs were outsourced. They are now against 'bringing more in'.
What a shift! The very workers our officials are bringing in are suffering by an unlimited number of H1Bs and all the jobs are going overseas.
Immigration, be it legal or illegal has got to stop. The People will have to stop it because Washington is encouraging the invasion.

This delay could be a blessing in disguise when coupled with the negative employment report.A rational observer might be inclined to think that while there was no honorable,above board motive for Sen. I called my two Illinois Senators concerning the E-Verify fiasco of Senator Mendenz. Senator Durbin's office did not yet have an opiniion, but the employee was nice, and said he would pass on my concerns to the Senator.

There's an old expression that if you want to get legislators to see the light, make them feel the heat. FAIR is urging all its members, activists and friends interested in true immigration reform to participate in FAIR’s Lobby Days. This event will be held in conjunction with the Hold Their Feet to the Fire Radio Row. This national grassroots effort seeks to counter the push by special interest groups and the open borders lobby while supporting enforcement of our immigration laws.
FAIR's Lobby Days will be held in Washington, DC, September 8th through 11th, 2008. The four-day schedule includes an extensive Capitol Hill lobbying campaign in which hundreds of participants will visit their legislators and urge them to oppose illegal alien amnesty and support stronger border and worksite enforcement.
While our activists are up on Capitol Hill advocating for true immigration reform, the FAIR Congressional Task Force will be hosting Hold Their Feet to the Fire. This radio row event will showcase dozens of radio talk show hosts conducting live interviews with members of Congress, state and local representatives, law enforcement officials, and immigration policy experts.

California Man Arrested in H-1B Visa Scheme

Last week, a Riverside, Calif. man was arrested for allegedly filing almost 1,000 fraudulent documents with the U.S. Department of Labor and U.S. Immigration and Customs Enforcement in an effort to obtain H-1B visas for illegal aliens, according to an ICE press release. The elaborate scheme described by ICE, which is similar to the type of fraud perpetrated under the employer-based visa programs that Sen. Robert Menendez (D-N.J.) and Rep. Zoe Lofgren (D-Calif.) are trying to expand, enabled Alexander Sales Vista to make $5 million by charging illegal aliens for fraudulent work visas and employment records.


Over the course of more than 10 years, Vista allegedly sought work visas for more than 550 aliens, whom he claimed were going to work at companies he owned. Vista charged the aliens, many of whom are now being deported for overstaying their tourist visas, between $7,000 and $12,000 to file a petition.
Many of the aliens were granted work visas, but the jobs often did not exist because his “shell” companies did not conduct any real business. Vista would issue the aliens fake pay stubs showing they worked for one of his companies. In return, the aliens paid him a regular fee, which he either kept for himself or paid to the government as payroll taxes to give the illusion that they were actually working for him.
