If there's a tie, the incoming congress breaks the tie with each state getting 1 vote based on the votes of their congressional delegation. Currently 26 states have Democratic majorities, 21 have Republican majorities, and 3 are evenly split. Since it's expected that the Dems are going to add 20+ seats, it'll be mathematically impossible for the Republicans and McCain to win that tiebreaker.
