first, most agents are members of the local board of realtors. the board
has much better and quicker leverage in this type of situation. at worst
they will now have your complaint on file and best case something
might hapeen that will punish the agent or benefit you. file a complaint
there.

second , call or have you agent call the agents broker (assuming he is not a broker agent)
and complain aggressively about the way this transaction has proceeded.

third, contact a good real estate attorney. he might be able to file a
motion that will prevent this transaction from being completed. this will
get everyone involved in this sale's attention. your leverage
in this scenario goes up tremendously. you might get the house, they might
pay you to go away, or you might get squat. a good attorney can discuss
the merits of this case with you.


all of the agents/brokers should have E+O (malpractise) insurance.
from a legal standpoint, the agents are considered experts and you are
considered to be an idiot. this works to your advantage here.

finally, your agent is a schmuck for not insisting on getting everything in
writing ASAP. a good agent would of smelled a rat immediately and
worked aggressively and quickly to protect YOUR interests. if this
transaction isn't consumated, strongly consider changing agents.

personally, i would raise holy hell and attempt in this order
1) sue (get a REAL ESTATE attorney) these cases usually end in arbitration
where everyone gets something.
2) you and/or your agent contact the local board of realtors.
3) you and your agent contact the other agent's broker
4) contact you agents broker

i would do all of these ASAP


if the other agent had a legal issue previously,
they are probably on a conditional license.
any complaint you pursue could put their
license AND livelyhood at risk.

YOU SIR HAVE A LOT OF LEVERAGE. USE IT!!!!!!!!!

Justin, the smartest guy in the room, "AK" will tell you once the seller accepted the offer, the house was sold which we all know is not true and this example you've provided is exactly why.

My advice to you after owning several homes is to walk away from this one. There are other houses out there. Buy a house because you love it and the numbers work. Don't fall in love so much with a house that you overpay.

Also, this is just me but if me and my agent give a deadline to accept/decline an offer and that deadline hits with no answer, I tell my agent to rescind the offer and we're looking elsewhere. That's just business. We have an offer on a house right now and they have until 5 p.m. tonight. I told the agent, if we don't hear from them by 5, were are no longer interested and walking.

I'm pretty sure they have no idea they got screwed.

From their point of view there was an accepted written offer when they signed their release of first right

I agree with what you're saying. And that's exactly why I let the other people overpay. My biggest issue with this whole situation is how this man conducts business.

I'm flabbergasted by the fact he is allowed to remain in the industry after pleading guilty to fraud.

Don't takeout that big of a loan on your 1st home, you got no kids and this girl might turnout to be the next Shelly Sterling. Get more of a starter home and keep saving the difference.

If you do have kids and you are sure your gonna spend the next 70 years with her, then disregard this post.

Are you sure on the fraud part? I don't have a RE license but I know if I were pleed guilty to mortgage fraud I would lose every license I have.

He lives in Jeffersonville Indiana.Its on the Northern boarder of Louisville and Clarksville, Kentucky.

There aren't very many, but 1 of the actual perks of living in the midwest is cheap housing because land is plentiful. Take advantage of that.....Plenty of time to find your dream home.

Tell your agent how unpleased you were with what happened, have him (or you) call the listing agents broker and explain what happened and report him to The Association of Realtors in your area. Verbal contracts can be binding in some states but I always get EVERYTHING in writing. In Nevada you must respond to the offer in which the order you get it in, and this is all done with a Residential Purchase agreement that states the time and date in which the seller must answer by or the offer is void. When you sent your original offer in and the listing agent said they would accept, your agent should have said ok well send back the completed contract signed and saying they have accepted. Bottom line get everything in writing!

I know we've had our issues in the past. But we've came a long way, and I genuinely believe that to be true. Help me sort this one out.

Justo this line right here is just unnecessary. you sound so fuckin desperate for being accepted.

Stop crying about the past, stip crying about being banned at WU, stop living in the past. These are the things that make me believe you are still a fraud.

Whole heartedly agree here. Unless you are pulling in sick bank there is no reason to spend a quarter million dollars on a 2-person home in buttfuck Indiana at this juncture of your life. IMHO
