Obama tried to convict them in a court of law, and almost lost. The defendant was found guilty on like 1/132 counts. He almost blew it. That beyond a reasonable doubt standard is difficult to achieve in the fog of war. Very easy for a good attorney to achieve reasonable doubt. That's why military tribunals exist.

Plus I'm not sure many conspirators are being held captive, I know they're all enemy combatants. How many sat beside OBL / UBL? IDK
