this meme compares brock turner (l) to cory batey. (source: Misee harris / facebook)

nashville, tn (wsmv) -a facebook post comparing convicted vanderbilt rapist cory batey to convicted stanford rapist brock turner is going viral.
Thousands of people have left comments talking about race and the justice system.
Former reality tv star and social activist misee harris simply asked for thoughts when she posted the internet meme. She received more than 16,000 of them, along with more than 150,000 shares.
It has caused quite the stir on social media.

they are similar rape cases, with very different outcomes.

batey, a former football player at vanderbilt university, was convicted in april of rape. Investigators said cellphone images show batey assaulting an unconscious woman in a dorm room. Batey will be sentenced in july, but the aggravated rape conviction alone carries a sentence of 15 to 25 years.
Turner, a former swimmer at stanford university, was convicted on three sexual assault charges. Investigators said cyclists saw him thrusting over an unconscious woman behind a dumpster. Turner was sentenced to six months in a county jail.
In response, harris, a tennessee native, posted a meme on facebook with batey and turner’s pictures side by side. Under both pictures it reads, “rape of an unconscious person." under turner’s picture, it reads six months. Under batey’s picture, it reads 15 to 25 years.
Some are calling it racism, while others call it a class issue. Some say it was just a bad judge.
Another notable similarity in the cases is emotional testimony from both victims.
Cnn’s ashleigh banfield read a portion of the letter written by turner's victim. In one part, the victim wrote about telling her parents about the rape.
“halfway through telling them, my mom had to hold me because i could no longer stand up,” banfield said, reading from the letter.
Batey's victim cried as she testified in court that she would never consent to what was happening in the images.
A key difference is the way the men responded.
“i’m just sorry. I never intended on hurting anybody. I was extremely intoxicated. I would like to extend a personal apology,” batey said in court.
Turner's victim said she never got an apology.
In another portion of the letter, banfield read, “you said, ‘being drunk, i just couldn't make the best decisions and neither could she. Having too much to drink was an amateur mistake i admit to, but it is not criminal.’”

Why Brock Turner is not actually a rapist

Around the world outraged headlines have referred to the 'Brock Turner rape case'

He was originally charged with rape of an intoxicated person and rape of an unconscious person. But those indictments were dropped at a preliminary hearing, reportedly after prosecutors received the results of DNA testing.

As such, the case continued on the basis of ‘lesser’ charges: assault with intent to commit rape of an intoxicated or unconscious person; penetrating an intoxicated person with a foreign object; and penetrating an unconscious person with a foreign object.

In essence, Californian state law defines rape as penetration by the penis. Since that did not occur Turner is a criminal, a sex offender – but he isn’t, according to the law, a rapist.

Under English law, Turner wouldn’t be classified as a rapist either. As in California, the offence of rape is strictly confined to a man penetrating another person with his penis in the absence of consent. That is why a woman cannot be convicted of rape except in circumstances where she assists a man to commit the crime.

Even so, Turner’s crimes could have seen him receive a maximum of 14 years in prison. Even putting aside the precise definition of his conviction, it is no wonder that his six month sentence has received such criticism.

I think the black guy at Baylor only got 6 months for his rape as well. I'm not going to use any of these cases to claim either white or rich does not have a better shot in the courtroom though. It's obvious our justice system has holes and inhernt bias.

One lawyer commenting on the Stanford case on CNN said the system worked and then the judge failed.

He won’t be sentenced until July.
