I think this is an easy question but wanted to see the numbers here.

Anyway, I saw this question on TV and that is what made me ask this.


Woman told this guy he was the father and put his name on the birth certificate and collected child support for 10 years.

A DNA test was taken and it was proven he was NOT the father. The court is still ordering him to pay child support.

I can't believe how wrong this is.

I heard this on the Leykis show. I believe in most cases that if the man is established as the emotional father figure in the family that he would be more apt to leave if he were no longer forced to support the family.

However, I believe this is also true of men who have not established to be the emotional father figure. I believe a man has a certain amount of time (something like 1 year in California) to prove he is not the father if his name is put on the birth certificate. Otherwise he is liable for child support until the child turns 18.

Gyno, there are several cases where the guy who is not the biological factor is forced to pay child support because the theory is it is in the best interests of the child because the child has lived with the guy and the guy has represented himself as the father - THIS LOGIC IS FUCKING ABSURD.

A friend of mine is going through this right now, he was with the woman for 3 years, not even married to her. She's suing for support but his lawyer said he has nothing to worry about.

Most of it is just bitterness, the woman would be be better off going for spousal support if they were together long term.

And how likely is it that he'll learn about it within one year, if ever? So much for justice huh.

I heard a stat saying that 10-20% of men aren't the biological father. I guess the lesson is to get a paternity test within 12 months.

In certain situations then Yes the guy should have to pay child support. Suppose the couple both thought the child was his. Suppose he worked all day while the mother cared for the child and home. Suppose the guy raised him like his own because he thought it was. Now suppose years later after a nasty fight the woman admits to cheating on him and the DNA test was negative. The child should not be punished and as long as the real father is not able to be located then yes the husband should pay to support the child he helped raise.

thats Absurd WVU,,,, the ANSWER is this,,,, it is MORALY fair for a Guy in YORU scenario to still keep around, and provide influence, and explain to his (non) Son how much of a whore is mom was,,,,

HOWEVER,,,

the truth is the truth,,, and if a guy murders someone and everyone thought he was innocent until DNA proved he comited a murder 10 years later,,, we should just go ahead and assume he is innocent?

I know my example is a little lame, but is still fair,,,,

the point is that this is a Moral issue, and if a GUY in this situation cant at least hang around and give respect to the kid (no forced Money) then he is as scummy as the whore woman,,, Having the COURTS LOCK a guy into slavery is disgusting,, and thats the answer.

I was legally seperated from my ex-wife when she had her first kid while she was living in the state of texas. She leaves this guy and moves back to michigan, get's into a car accident and cannot work for awhile so she decides to get on state aid for a few month's ( which she did not really want to do but had no choice). Anyway's, I was living in mich at the time also.I was not on the birth certificate, nor did the kkid have my last name either, but because we were still "legally" married and not divorced yet the state of mich came after me for child support as long as she was on state aid. I had to get her and the other guy, who she move back to texas for during all this, to get a legal notorized paper signed and dated and mail it to me claiming that I was not the dad. The prosecuting att for the state told me that he did not have to let me off the hook even with the letter because the state was wanting re-imbursment for the money they shelled out to her. But, because I took the time to do what I could and was not a hot head about the whole thing he let me go. He also said that I should hurry and get the divorce because as long as we were legally married she could keep doing this to me.Well 7 yrs later I got the divorce...lol alcohol can make you do many stupid thing's my friend's.

The child should not be punished

Neither should the husband. The child is punished as soon as the mother deceives the husband or when the husband finds outs, particularly if he then leaves. I'm starting to think that paternity tests should be compulsory.

I'll go out on a limb here and say I don't think anyone should be forced to pay child support.

That is not to say that I don't think people SHOULD pay child support, I just don't think it should be imposed absent the backing of a parental contract or something.

I guess I see it like this: if you have to go to court to get a man to support his own children, then maybe you should have taken a slightly harder look at him before you got pregnant.

That in mind, I know of a few very saintly men who have helped raised children that were not theirs. In all of those cases the relationship subsequently fell apart and each one of them remains active in these childrens' lives. My uncle is one of them. Those are good men, and their women chose them well.
