FZ, what company was it that gave you 5% negligence?? That is ridiculous....I was an adjuster (liability) for 5 years and never did that ever in that situation, easy 100/0...

That was in 1988, so I'm not sure, but I think it was Allstate.

I have a very easy solution for this one. First, the accident occured on private property and there was no bodily injury so the police won't get involved. Call your insurance company and tell them you went in grocery shopping and when you came out, you noticed someone had hit your car and took off. It happens all the time. Pay your deductible and get your car fixed.

In other words, you're going to have to lie a bit.

In Canada, Police only respond to accidents with injuries.

ALWAYS have a camera in your car(cell phone etc.)
Take photos from all angles!

Very true, even the sweetest old lady will bullshit up the biggest web of lies if there's no evidence against it. An older woman nailed me in a parking lot during Christmas busy time while I was stuck between cars and she backed out without checking. 100% her fault and if it weren't for pictures and multiple witnesses I gathered at the scene her bullshit likely would have gotten her out of it.

I would guess you are at fault sadly..... you were backing out she was in the lane moving

Since the accident occurred on private property (parking lots) it doesn't matter who is at fault. Your insurance will pay for your car and her insurance will pay for her car.

Correct, since on private property, no police report. Your company will take care of your vehicle, hers will take care of hers. From there, the two companies will work out "comparative negligence", where they might come to the conclusion that you were 70% at fault because you were backing out. Without a police report or a witness, it is a he said, she said.

not really only a he said she said...points of impact would support one party more than another, for instance, if the damage was to the rear bumper of the backing vehicle but to the door or quarter panel of the other vehicle, itd be fairly obvious what happened and whom was at fault...however, comparative negligence would be discussed between the 2 companies even though sometimes that gets really shady.
