Is that really the ONLY way to know?

The birth announcement was even published back in 1961, that's a hell of a lot of foresight. The certification of live birth when it was produced was deemed a fraud, until people actually touched it and could disprove claims like the seal isn't raised, etc. And the officials in Hawaii have verified that his birth certificate exists and it's real.

You have to see that this is going down loonjob lane. First with the demanding of evidence, then when they get the evidence that disproves them it's either fake or they demand more evidence. Whatever the next piece of evidence is, it's always the one that will prove the whole thing right...and even if they do see, feel and examine the other birth certificate you know they'll deem it to be a clever fake as well.

It's either another vast mess of a conspiracy, or the guy was really born here.

I find it ludicrous that someone could make it that far in politics with out being an American Citizen. Are the rules and regulations in your country so lax that this could actually happen?

I mean seriously think about the repercussions of knowing the someone could defraud their way to the top of the most powerful country in the world.

It screams to the other countries around the world that you are a house of cards waiting to fall.

I gotta admit I admire the wackos behind this deal as anytime you can schuck and jive enough bucks from people sufficient to place full page ads in the Washington Post and the ChicagoTrib, you're really pouring the JuJu Juice in their coffee.

And they write a fairly peppy press release, making full use of straw man innuendo.

My two favorite parts:

**A First Amendment Petition to any official of the Government for Redress of a violation of the Constitution is substantially different from the garden-variety political petitions frequently received by government officials.

Oh really? How so?

This Petition demands it be given the highest priority for an expedited review and official Response by Mr. Obama.

Ohhhhhh....it DEMANDS highest priority....yeah, that's real different from garden variety petitions which just gently ask for friendly redress of grievances "whenver you can fit it into your busy schedule".

In fact, under Hawaiian law, a foreign born child can be registered as a naturalized (but not "natural born") U.S. citizen following application of the parents, (See, Hawaiian law provides for registration of out-of-state births under HRS 338-17.8. ). Such persons would be eligible to receive a "Certification of Live Birth" from the state, such as the document Obama has proffered. "Naturalized" citizens, such as the Governor of California, cannot hold the office of President.

This of course, does not resolve the thornier issue as to the content of Obama's birth document. Specifically the stated "place of birth" may not in fact reflect the physical location of Obama's birth (as evidenced by the "original" certificate of Live Birth claimed to be in the possession of Hawaii officials), but rather the local Hawaii residency of the U.S. parent claimed in a birth registration application such as that provided by HRS 338-17.8 (See above). In any event the document is simply a computer-created document based upon the entries in a computer database, which may have been conceivably tampered with at some point.

Hawaii law also provides for "amending" birth certificates. From the official web page: "Amended certificates of birth may be prepared and filed with the Department of Health, as provided by law, for 1) a person born in Hawaii who already has a birth certificate filed with the Department of Health or 2) a person born in a foreign country."

In short, the document proffered by Obama does not contain all the information needed to conclusively verify that he is legally eligible to hold the Office of President.

Additionally, beyond their refusal to minimally confirm that Obama was born in Hawaii, state officials also refuse to comment on the authenticity of Obama's birth document.

All these questions could be resolved by Obama by simply providing access to his original birth certificate.

A constitutional lawyer said were it to be discovered that Mr. Obama is not a natural-born U.S. citizen, it would have grave consequences for the nation.

According to the Constitution, a president must be a natural born citizen of the U.S. Mr. Obama's critics have failed to force him legally to produce his original birth certificate, and Mr. Obama has resisted any attempt to make him do so. Currently, only Hawaii Department of Health officials have access to Mr. Obama's original records.

Some of Mr. Obama's critics have said he was born in Kenya and have claimed he is a citizen of Kenya, Indonesia, or even a British subject.

Edwin Vieira, a constitutional lawyer who has practiced for 30 years and holds four degrees from Harvard, said if it were to be discovered Mr. Obama were not eligible for the presidency, it would cause many problems. They would be compounded if his ineligibility were discovered after he had been in office for a period of time.

"Let's assume he wasn't born in the U.S.," Mr. Vieira told The Bulletin. "What's the consequence? He will not be eligible. That means he cannot be elected validly. The people and the Electoral College cannot overcome this and the House of Representatives can't make him president. So what's the next step? He takes the oath of office, and assuming he's aware he's not a citizen, then it's a perjured oath."

Any appointments made by an ineligible president would have to be recalled, and their decisions would be invalidated.

"He may have nominated people to different positions; he may have nominated people to the judicial branch, who may have been confirmed, they may have gone out on xecutive duty and done various things," said Mr. Vieira. "The people that he's put into the judicial branch may have decided cases, and all of that needs to be unzipped."

Mr. Vieira said Obama supporters should be the ones concerned about the case, because Mr. Obama's platform would be discredited it he were forced to step down from the presidency later due to his ineligibility, were it to be discovered.

"Let's say we go a year into this process, and it all turns out to be a flim-flam," said Mr. Vieira. "What's the nation's reaction to that? What's going to be the reaction in the next U.S. election? God knows. It has almost revolutionary consequences, if you think about it."

Mr. Vieira said Mr. Obama's continued silence and avoidance in the release of his birth certificate is an ethical issue because of the dire consequences that could be caused by a possible constitutional crisis.

"If he were my client and this question came up in civil litigation, if there was some reason that his birth status was relevant and the other side wanted him to produce the thing and he said 'no,' I would tell him, 'you have about 15 minutes to produce it or sign the papers necessary to produce the document, or I'm resigning as your attorney," said Mr. Vieira. "I don't think any ethical attorney would go ahead on the basis that his client could produce an objective document in civil litigation [and refused to do so]."

Further, Mr. Vieira cited a fraud ruling in a 1977 case called U.S. v. Prudden, which he feels applies in this case.

"Silence can only be equated with fraud when there is a legal and moral duty to speak or when an inquiry left unanswered would be intentionally misleading," the ruling reads. "We cannot condone this shocking conduct ... If that is the case we hope our message is clear. This sort of deception will not be tolerated and if this is routine it should be corrected immediately."

Mr. Vieira said such an ethical question of representing a client who refused to produce such a basic document is important, even in a small civil case. The current question is concerning the man who potentially could have his finger next to the nuclear button.

"[The birth certificate], in theory, should be there," said Mr. Vieira. "What if it isn't? Who knows, aside from Mr. Obama? Does Russian intelligence know it isn't there? Does Chinese intelligence know it isn't there? Does the CIA know that it isn't there? Who is in a position to blackmail this fellow?"

Mr. Vieira explained all laws have to be submitted to the president. In the event that there is no valid president, then no laws passed by Congress in that administration would be legally null and void. Because of that, this case will probably not go away, even after Mr. Obama takes the oath of office.

"If you don't produce it, you think it's going to go away," he said. "There are all these cases challenging Mr. Obama, and some challenging secretaries of state, and they run into this doctrine called standing."

Mr. Vieira explained although legal standing is difficult to get around in Federal courts, the document could be produced in any criminal cases stemming from legislation passed in the Obama administration.

"Let's assume that an Obama administration passes some of these controversial pieces of legislation he has been promising to go for, like the FOCA (Freedom of Choice) Act," said Mr. Vieira. "I would assume that some of those surely will have some severe civil or criminal penalties attached to them for violation. You are now the criminal defendant under this statute, which was passed by an Obama Congress and signed by President Obama. Your defense is that is not a statute because Mr. Obama is not the president. You now have a right and I have never heard this challenged, to subpoena in a criminal case, anyone who has relevant evidence relating to your defenses. And you can subpoena them duces tecum, meaning 'you shall bring with you the documents.' "

Such a criminal defense would enable the defendant to subpoena any person to testify in court and any person to bring evidence in their possession to the court.

Further, records could be subpoenaed directly, in the case of a birth certificate. Once the record could be subpoenaed, the birth certificate could be examined by forensic experts, who would then be able to testify to the document's veracity as expert witnesses. Any movement by the judges to make a special exception to the president in a criminal case would hurt the legitimacy of that presidential administration.

"I can't believe I'm the only lawyer who would think of this," said Mr. Vieira. "I think any criminal lawyer defending against one of these politically charged statutes is going to come up with this. That means it will never go away until that document is laid down on the table and people say, 'yes, there it is.' And therefore they're caught. If people keep challenging this and the judges out of fear keep saying 'no, go to jail, go to jail, go to jail' then that's the end of the Obama administration's legitimacy. On the other hand if they open the file and it's not there, then that's really the end of the administration's legitimacy."

Several court cases in the birth certificate controversy are waiting admission to the Supreme Court.

A gathering of judges will meet on Dec. 5 to decide whether or not to hear a case from New Jersey, and a decision is still pending on a case from a lawyer in Pennsylvania. Should four of the judges vote to hear the case in the Dec. 5 meeting, then it will be scheduled for hearings. Court cases from Connecticut and New York have also applied for hearings at the U.S. Supreme Court.

A document expert contends the "Certification of Live Birth" Barack Obama's campaign posted online to rebut charges the president-elect fails the Constitution's natural-born citizen requirement is criminally fraudulent.
The Obama campaign has told WND such allegations are "garbage," but Ron Polarik, who holds a Ph.D. in instructional media specializing in computer technology such as printers, scanners and digital imaging, disagrees. His analyses have been posted online in a YouTube video, which also is embedded here:

Where's the proof Barack Obama was born in the U.S. and thus a "natural born American" as required by Article 2, Section 1 of the Constitution? If you still want to see it, sign WND's petition demanding the release of his birth certificate.

In Polarik's view, there has to be a significant reason for a political candidate and campaign to go to such lengths.
"Obviously, there's something very critical to hide, or they wouldn't have spent the million dollars in legal fees to prevent the release of his original birth certificate," Polarik told WND.

"There's absolutely something to hide," he said. "If he was born in Hawaii they would have had a luau that would be continuing today.
"Not that the people who voted for him would care," he said, "but they used this forged document to convince the American voters.
"It's a scary thought to have someone who essentially begins his presidency as a criminal," he said, because the use of a faked document as identification is, in fact, a crime, he noted.
"It would be hard to perform as president from behind jail cell door at Leavenworth," he said.
The video has Polarik's face and voice disguised, and he confirmed to WND he's using an assumed name because of the threats. Independent verification of his credentials was not immediately available.

Polarik said the issue of the birth location is a "chink" in Obama's armor, but the Democrat also has declined to release information about his college years, about his selective service and about his passports, including on what nation's passport he traveled to Pakistan two decades ago when it was illegal to go there as a U.S. citizen.
Polarik describes his findings and conclusions on the video.
Polarik's conclusions were disputed, however, by another blog, the Hackerfactor.com.
Writer Neal Krawetz argues the "missing green" is a result of the compression algorithm used to generate the image. He also insists there's no validity to alarms over the border, because "we don't know the history of the actual image (was this a scan converted to JPEG, resaved as another JPEG, etc.). What we do know is that the image is at a very low quality, and JPEG loses fine details when saved at a low quality."
"I and other analysts have been unable to identify any sign of digital manipulation," the blogger wrote.
He also said Polarik is just "wrong" about the seal issue, and he addressed the second-fold dispute.
"I must admit that I do not see the second fold. However, I have scanned many pieces of folded paper and not seen folds (scanners pick up color, not texture)," Krawetz wrote.
Meanwhile, Dan Purdy of Forensic Document Examination Services Inc. told WND that the origins of the Internet images aren't known. He raised questions over whether the "original" was a photocopy, the equipment used to create the digital image and the compression processes of the various formats.
Those factors, he wrote, "make it exceedingly difficult to properly interpret fine details in the image."
WND columnist Janet Porter has written extensively about the birth certification issue.
"Look, we're not asking for the world here. Neither is the Constitution. Some pretty basic requirements like being 35 years old, having 14 years residency in the United States, and being a natural born citizen. When Senator John McCain was questioned about it, he showed his birth certificate without hesitating. When Barack Obama was asked by courts including the U.S. Supreme Court, he ducked and hid behind the right to privacy," she writes.
"Ironically, when Obama was running for the [COLOR=blue! important][COLOR=blue! important]State [COLOR=blue! important]Senate[/COLOR][/COLOR][/COLOR], he won by disqualifying every candidate who ran against him in the primary, including a guy who had been through a nasty and salacious divorce. Even though he had a small child who could be hurt by the information being made public, a court decided that the public's right to know; outweighed this poor fella's right to privacy, and he backed out. Obama clings to the 'right to privacy' regarding his own qualifications, just not his opponents."
She also noted the issue won't go away, and recommended a visit to ObamaForgery.com to review what's happening.
"These are the facts," she wrote. "The Constitution requires the president to be a natural born citizen. Obama's grandmother said she was there when [COLOR=blue! important][COLOR=blue! important]Barack[/COLOR][/COLOR] was born in Kenya. Obama refuses to release his original birth certificate. Instead of a birth certificate, Obama's campaign posted a certification given to those born abroad. Experts have called even that document an 'obvious forgery.'"
"Our Constitution still matters," she said.
Her group, Faith2Action, is working on funding for the purchase of time for a new television ad on the issue.
In the Philadelphia Bulletin, constitutional lawyer Edwin Vieira said a multitude of problems could result.
"Let's assume he wasn't born in the U.S.," Vieira told the newspaper. "What's the consequence? He will not be eligible. That means he cannot be elected validly. The people and the Electoral College cannot overcome this and the House of Representatives can't make him president. So what's the next step? He takes the oath of office, and assuming he's aware he's not a citizen, then it's a perjured oath.

"He may have nominated people to different positions; he may have nominated people to the judicial branch, who may have been confirmed, they may have gone out on executive duty and done various things," said Vieira. "The people that he's put into the judicial branch may have decided cases, and all of that needs to be unzipped."
"Let's say we go a year into this process, and it all turns out to be a flim-flam," he told the newspaper. "What's the nation's reaction to that? What's going to be the reaction in the next U.S. election? God knows. It has almost revolutionary consequences, if you think about it."
He continued, "[The birth certificate], in theory, should be there. What if it isn't? Who knows, aside from Mr. Obama? Does Russian intelligence know it isn't there? Does Chinese intelligence know it isn't there? Does the [COLOR=blue! important][COLOR=blue! important]CIA[/COLOR][/COLOR] know that it isn't there? Who is in a position to blackmail this fellow?"
Vieira expressed confidence Obama eventually will be forced to produce documentation.
"Let's assume that an Obama administration passes some of these controversial pieces of [COLOR=blue! important][COLOR=blue! important]legislation[/COLOR][/COLOR] he has been promising to go for, like the FOCA (Freedom of Choice) Act," he told the newspaper. "I would assume that some of those surely will have some severe civil or criminal penalties attached to them for violation. You are now the criminal defendant under this statute, which was passed by an Obama [COLOR=blue! important][COLOR=blue! important]Congress[/COLOR][/COLOR] and signed by President Obama. Your defense is that is not a statute because Mr. Obama is not the president. You now have a right and I have never heard this challenged, to subpoena in a criminal case, anyone who has relevant evidence relating to your defenses. And you can subpoena them duces tecum, meaning 'you shall bring with you the documents.'"
WND founder and editor Joseph Farah has launched a program to allow concerned voters to express their desire directly to the U.S. Supreme Court for the issue to be resolved.
A conference among the justices is scheduled Friday on a New England challenge to Obama's eligibility.
"The case is brought by Leo C. Donofrio against Nina Wells, the New Jersey [COLOR=blue! important][COLOR=blue! important]secretary [COLOR=blue! important]of [/COLOR][COLOR=blue! important]state[/COLOR][/COLOR][/COLOR], and questions whether Obama is a 'natural-born citizen' as required by Article 2, Section 1 of the Constitution," Farah reported.
"It would seem a simple matter to resolve," he said. "Barack Obama could have put this issue to rest long ago by producing a complete birth certificate from Hawaii. Instead, he has chosen to stonewall the matter, citing a website post of what can only be characterized as a partial representation of a birth certificate – one that has been criticized as a forgery.
"Meanwhile, some of Obama's own Kenyan relatives claim to have been present at his birth in Mombasa. This controversy, which some have dismissed as frivolous, is as serious as the literal meaning of the Constitution itself."
The nation's Electoral College, the process through which Obama is to be formally voted as the next president, will meet Dec. 15, and his inaugural is scheduled Jan. 20.
Meanwhile, more than 125,000 have signed WND's petition seeking full disclosure of Obama's information.
The petition cites the U.S. Constitution's requirement that no one can be sworn into office as president without being a natural born citizen. It also asserts there are questions about Obama's reported Hawaii birth, that the Democrat has refused repeated calls to document his birth, that [COLOR=blue! important][COLOR=blue! important]activist[/COLOR][/COLOR] judges have declined to require him to shed light on the issue and that Hawaii – at the time of Obama's birth – allowed parents whose children were born in other locations to register the birth there.
