I broke my left ankle on 1/27/04. Slipped and fell on ice, due to poor snow removal, at my condo. I have good photos to support my case. I'm 41, I'll never take Derek Jeter's job from him. I'll also never run again. I have a state issued lifetime handicap parking permit.

I walk funny, but could work, not that I intend to. I won't be climbing any extension ladders ever again. I can't unload tractor-trailors, and such. I'm more of a physical labor guy in my history, making 40-50 K a year.

Settlement time looms. I guess the wise choice is to refuse the first offer, my attorney gets her third, of course.

I don't expect $4,000,000, nor would I settle for $10,000. I'm thinking about $250,000, but I don't know.

I ask attorneys to respond, in particular daringly. I could work some desk job, but have that already betting sports. I could even work part-time as a bartender , or something, have experience. My doctor has somewhat over-stated my disability, but I can't be physical laborer any longer. I'm not wheel -chair bound, not really close to it, but lessened in my abilities.

Many are far worse off than , I am. I seek a just settlement. Don't break your ankle, it's bad news.

I'm assuming you pay $100/month for stuff like snow removal? Anyway... I was just curious. That's what we pay in our condo.

association fees run $168 a month for a 2-bedroom unit , realistically worth 220k or so. no pool or clubhouse, tennis courts, etc. They assess special payments every time they put a roof on a building.About 55-60 units here.

I own another condo in an approx 250-unit setting. It's very small about 735 sf, worth about 95k, fees are about $120 monthly. It has pool, tennis, clubhouse with indoor BB, jacuzzi, sauna, billiards, etc,

I rent it out for a ridiculous $750 a month, it's worth $950+. Tenant pays promptly, never calls me for anything. She knows she has a sweet deal. I have to raise that to $800 soon. I want to go back there, wife doesn't. We used to own a prime unit there, sold at a nice profit, worth more now.

That place plans ahead, doesn't assess you with extra payments when a roof is needed on a building.. I'd like to have a 2-bedroom condo there, and a hot-tub, sauna, pool table, etc at my leisure, but I'm married.

Were you 14 ? Ankle is bad . I'd choose breaking my left wrist over either ankle, since I'm a righty.

I am not a lawyer but I suspect the most you can expect in a settlement is $25k. You will probably have to go to court and prove your case and if you do DONT do anything strenuous....you never know who is watching you.

We were paying $680 for our 1500 SQft place before we moved to the West side. Now we pay more and have less space LOL.

Cost of Living in Iowa is very nice ;)

Yeh maybe 25k and and an add-on to remove the plate if if it becomes needed in the future, that's probably reality.

I wouldn't intentionally break it for a million. I'd give you a little toe for 50 million.

Insurance companies dont care that is part of the reason why they call it a "nuisance settlement."

West side of what... Davenport ? I don't mean to be rude, but isn't Iowa basically corn ? I would expect property there to be below national average.

What's in Iowa ? No ocean, no mountains to ski. "honey let's load up the station wagon and go to Davenport" What's so special about Iowa ?

The insurance company is going to give $5000 to $10,000 to get you out of their hair. Also you might want to look into who you should sue for your mental disability of putting yourself in obviously dangerous situations (walking on slippery ice) as most 12 year olds have been told 1000's of times by their mothers to "be careful walking on that ice - it is slippery! You'll fall and break a leg!"

In what state do you live, Florida? Most states have laws on the books to prevent "slipped on the ice" lawsuits.

Anyway, good luck hope you "win" a mint and that your condo fees aren't increased too much for you and your fellow residents.

West side of Des Moines.

Iowa itself is garbage. Iowa City is fun to spend SOME time in...and cedar rapids has it's moments... But other than Des Moines, Iowa has nothing really.

However... Des Moines is truely one of the all-time great cities. I realize it doesn't have a lot of what the other cities its size has but pound-for-pound it's exactly what we need.

Restaurant selection like you wouldn't believe in Des Moines. Anyone who's been here will tell you the same.

We have no children nor will we ever... But yes many kids around here can't stand Iowa and think that they're going to leave the first chance they get.

But since when should we listen to children...

my dad fell at work, slipping on a piece of sheet metal one of the employee's where he was contracted in left on the steps carelessly. the place had no railing on the steps(OSHA REQUIRED). when he fell he tore his rotator cup(i think that is what it is called)

Now after 3 sugeries, he still can barely wipe his as*. he needs help getting his jackey on and off, and can't lift over 25lbs, but then his arm will swell.

Let me mention he also has 6 herinated disc in his back that could rupture at any time.

He is not diabled. He is now out looking for work. He has done hard manual labor his whole life, and workmens comp is trying shove him anywhere. He is 52 years old, so tell me who will hire him?

Have you been declared disabled? Are you working now? I just burns me up when someone is getting over on the system, and people that truely need it get shoved to the back of the line. Not to mention I pay my taxes, and pay for people like that.***

Also, they are pursuing with a lawsuit, but the company is running from the lawyer. It is a BIG GERMAN outfit. so hopefully justice will be served

***in no way shape or form am i insisting that you are not injured. I dont even no if you work. I am just stating an opinion. I wish you the best

I pay fees to have snow removed, if the association is derelict in said duties, they have at least some percentage of responsibility. It's up to the lawyers. At least some responsibility falls upon the homeowner's associiation.

The guy that said 25k is probably right.

I'd have no case if it was a single family home, I can't sue myself.

Reserve judgement , before seeing evidence. I only ask friend , daringly for a general opinion.

I'll post pictures if I can figure out how to do so. I'm no computer geek.

I think my PIA attorney wants more than 33% of 5-10 K.

Well, first and formost, you are a scumbag. With that said, I doubt they will offer you more than $500 for a slip and fall. A $10,000 offer for a slip and fall? hahaha. $250,000 for a slip and fall - these scumbag personal injury attorneys will tell clients anything to get them on board. I am an attorney by the way. Your best bet is to go to trial or take the highest settlement you can get prior to trial. If I sat on a jury and I some pathetic piece of sh$t like you I would never award anything over expenses for a slip and fall on ice or snow. You ought to try getting a job and doing something with your life - it makes more sense than living your current life as a loser who never accomplished anything.
