Proving causation for murder will be tough.

imagine you’re on the jury... to convict someone of murder you have to prove intent and causation.

medical experts aren’t even sure he was killed by the knee to the neck, but you think a jury will say beyond a reasonable doubt that it was the knee and not the fatal dose of drugs? Good luck...

jurors are morons and easily swayed, see the OJ Simpson verdict, but if the jurors do the job properly, they likely will have to acquit because there is not clear cut proof of causation.

He is not charged with degree murder - he is charged with 2nd degree felony murder which gets rid of the intent element - pretty sure he will be convicted of this - don't see any way out of it - even if all the experts testify the heroin and heart disease killed him - the totality of the arrest was still a factor - that alone is enough

If the jury pool is a bunch of idiots, you could get a conviction, yes.

I can't say anything - but legally the standard that is the law and that will be read to the jury is whether or not this officer's conduct was a contributing factor in his death - I just don't see how anyone can overlook that standard
