Some state laws prohibit wagers, that is what you might run afoul of. There is no national law saying wagering is a crime, only booking. The Justice Department is full of shit, there just isn't any other way to say it. There is nothing illegal about betting and its not illegal to take bets in another country. What they have and try to use is bogus, but hey find some nice judges and some sympathetic people on a jury and the law doesn't always quite matter as much as you think it does.

I mean usually I can keep it down and give a real legal answer to anything, but this one particular subject is my "sore spot" because the JD is full of it. "We take the position that offshore wagering is illegal" you will hear that from them until the end of time. Then you remember its run by a guy named Ashcroft who would never let something as simple and poorly worded as the law get in his way. If one of them says you are breaking the law laugh at them and say only a moronic judge would agree with you...

Wild Bill- I enjoy reading your views on this. Any law they try to pass won't be worth the paper it's printed on. They can pass it as "feel good" legislation but enforcing it would be next to impossible and prosecution would be non-existent. So it would be a complete sham.

I don't really care because I would find a way to bet if I was stranded on a desert island. I would bet with the monkeys and use cocoanuts to settle up. Now that would really be "offshore" betting.

I really give up on updates for now, Senate is out on break and as I said before don't know how much of a source I can be for them as my contacts are nothing there like they were in the House. What I know is what you probably are reading in the occasional story on here. Not much I can do to add to the information flow. Sorry. On a good note I get a sense that no news is good news. There really are a lot of people out there saying that there just isn't the drive to get this done. Most Senators realize there is little substance here and as some have speculated, these guys are actually listening to people instead of just trying to make the "moralistic" move to ban gambling. Bottom line is that guys (and gals) in Congress get there because they go to church, they keep their noses clean for the most part, and they have had successful businesses or careers. These aren't gamblers and will not be out to defend our rights. To go out and say "save my right to gamble" just isn't going to sell anyone on your argument. In fact I don't know what argument could work. Its almost better just to hope it quietly goes away, but at some point I feel it will come up for a vote. The longer it simmers though, the more likely it gets watered down or there is opposition holding it back.

Terry..................the wire act covers alot of ground

it prohibits gambling "businesses" from knowingly receiving or sending certain types of bets or information that assists in placing bets over interstate and international wires....


but wait just a minute..........in US vs Reeder the courts determined Reeder was guilty of violating the wire act by making interstate calls to a sports information service that provided recorded game scores...........jeez all he did was check a half-time score..........

Exactly why I say its not so much the law that says its illegal, its the friendly judge and/or jury.
