A suburban Chicago police officer had better and safer options than to fire beanbags to subdue a confused, knife-wielding 95-year-old World War II veteran, a prosecutor told the court Tuesday at the outset of the officer's trial on a felony reckless conduct charge in the man's death.
With all of their police equipment, training and "common sense," Craig Taylor and the other Park Forest officers didn't have to storm into John Wrana's room at an assisted living center on July 26, 2013, Cook County State's Attorney Lynn McCarthy said during her opening statements. They did so, though, and Taylor ended up firing five beanbags at Wrana, including the fatal one that struck his abdomen and caused internal bleeding, she said.
Taylor's attorney, Terry Ekl, countered that Taylor did what he was trained to do to subdue a dangerous suspect who was coming at him with a knife. Wrana was determined enough that he kept coming at Taylor with a knife "over his head" until the final shot knocked it from his hand, Ekl told Judge Luciano Panici, who will decide the case.
Taylor, 43, could face up to three years in prison if he's convicted. His trial comes amid heightened scrutiny of the use of deadly force by U.S. police departments, and there was a strong show of support by Taylor's fellow officers Tuesday at the courthouse in Markham.
Unlike many criminal trials where there is a disagreement over exactly what happened, the prosecution and defense in Taylor's trial agreed on the basic facts of the case in their opening statements.
Taylor was one of several officers dispatched to the facility where Wrana lived after a staff member reported that Wrana had become combative with emergency workers.
Wrana had hit a staffer with his cane and was brandishing the cane and a 2-foot long shoehorn. After officers left the room, they soon returned, with one carrying a Taser, another carrying a shield and Taylor armed with a 12 gauge shotgun that shoots beanbags. It was then that Wrana threatened the officers and refused to obey their order to drop a knife he had picked up.
One officer fired the Taser at Wrana, but missed. When Wrana moved toward Taylor with a knife, Taylor fired his weapon five times, according to prosecutors.
All of the shots were fired from no more than 8 feet away, said McCarthy, who told Panici that the "optimum distance" of 15 to 60 feet is spelled out in training standards and reminded the judge that each "projectile struck the 5-feet-five, 150 pound Wrana at about 190 miles per hour.
Wrana died from internal bleeding, according to the Cook County Medical Examiner's office, which ruled his death a homicide.
One officer who showed to court in support of Taylor said that Taylor's arrest is confusing to other police officers.
"There's an outcry now for less lethal force in dealing with subjects and he used less lethal force," said Mitchell Davis, the police chief in the nearby suburb of Robbins who once worked as an officer in Park Forest and said he knows Taylor. Davis said that while the incident had a "tragic outcome," he believes Taylor acted properly.
As a result, he said, police officers are watching the case closely. But this case has not generated the kind of emotion that killings of unarmed black men, specifically in New York's Staten Island and in Ferguson, Mo. Though Taylor is black and Wrana was white, neither attorney suggested race played any role in the shooting. Another factor is that the case is so unusual.
"This is so far afield from other cases that I don't think it will have any wide ranging effect on police or have be any kind of deterrent to on-duty misconduct," said Craig Futterman, a University of Chicago law professor who has studied and written about police abuse.

On Sunday, President Barack Obama released an anti-oil drilling environmental video shot aboard Air Force One–an aircraft that has a 53,611 gallon fuel capacity.

The video, which shows Obama aboard Air Force One, is interspersed with scenes of arctic animals and wildlife landscapes, reports National Public Radio (NPR).

It’s all part of Obama’s ANWR (Arctic National Wildlife Refuge) newly proposed plan to ban roads, permanent structures, vehicles, drilling, and mining on 12.28 million acres in ANWR.

On Saturday, Obama flew Air Force One over 8,000+ miles to India to discuss global warming and other issues.

LET'S BE honest: This is going to raise some eyebrows.
Vanessa Lowery Brown, the indicted Democratic state representative scheduled for a preliminary hearing in her bribery case tomorrow, contacted police on Sunday and reported that someone had broken into her West Philadelphia rowhouse and stolen several of her belongings.
Brown's state-issued laptop was among the items reportedly taken from her home, said Lt. John Walker, of Southwest Detectives.
Brown, 48, apparently noticed that something was amiss when she got home from work on Thursday night.

Her house had been "disrupted," Walker said, and a ladder was propped against the rear of her house, leading to a second-floor window.
In addition to the laptop, an iPad, a Nook tablet and some old phone records also were missing, she claimed.
Still, Brown didn't report the alleged break-in to cops until Sunday.
"We get delayed reports once in a while," Walker said. "She said she got home late [Thursday], then called some of her staffers on Friday morning and had them look at the house."
Maybe it was just a simple burglary. Then again, Watergate was just a burglary, too.
Brown and fellow Democratic state Rep. Ronald G. Waters are due in a Harrisburg courtroom tomorrow morning for their preliminary hearing on charges that they accepted money from Tyron Ali, an undercover operative posing as a lobbyist.
Assistant District Attorney Mark Gilson, who is prosecuting the duo, said his office has been informed of the alleged burglary.
"Based on her delay in reporting it, and what she was telling them, the police were skeptical," Gilson said yesterday.
"She waited [three] days to report it, supposedly called her lawyer first before she called police, then she told them one thing in a hallway, then something different on paper.
"Then, when they went to the scene, it was tampered with," Gilson said. "Those are several things that would make any police officer doubtful about the veracity of the report."
Walker said some of Brown's staffers on Friday moved the ladder that the burglar apparently had left behind.
"When they got there, there was no ladder," Gilson said of police.
Brown's attorney, Michael Diamondstein, declined to comment on whether the state-issued laptop might have contained any information pertaining to the bribery case.
"Representative Brown was the victim of a crime," Diamondstein said. "We were hopeful that the District Attorney's Office and Police Department would have treated her as such."
Walker noted that information stored on the state-owned computer likely could be retrieved electronically.
Gilson, who is not involved with the burglary investigation, said Brown's story about the laptop shifted over time, according to conversations he had with police.
"When asked what was on that computer, she went into a lot of details, then when it came time to give a statement, she said it was just emails and contact information," Gilson said.
Property records show that the allegedly burglarized house, on Fallon Street near Westminster Avenue in West Philadelphia's Mill Creek section, is owned by Brown's relatives.
The burglary tale adds another chapter to the bizarre story behind the bribery-related indictments of Brown, Waters and former Traffic Court Judge Thomasine Tynes.
The investigation into the local pols was launched in 2010 by then-Attorney General Tom Corbett, and later halted by his successor, Kathleen Kane, who cited multiple problems with the probe, including possible racial targeting. Brown is chairwoman of the Pennsylvania Legislative Black Caucus.
In what amounted to a political version of a triple-dog-dare, District Attorney Seth Williams took on the case last year, and put it in the hands of a local grand jury.
Williams said last month that both Brown and Waters admitted to the grand jury that they had accepted illegal cash payments from Ali.
Brown allegedly accepted $4,000. In one instance, she was caught on tape asking Ali, "What do you need me to do?" according to the grand jury.

Just before the Super Bowl kicked off this weekend, NBC’s Savannah Guthrie visited the White House kitchen for a few words with President Obama, only to discover that the football fan in chief is a little shaky on American history.
During the discussion with NBC, President Obama said that they are making beer in the White House kitchen.
Dressed in casual shirt with the sleeves rolled up, Obama told Guthrie, “We make beer. First president since George Washington to make some booze in the White House.”
The only problem is, as Greg Pollowitz noted, George Washington didn’t make any “booze” in the White House. In fact, not only was George Washington no longer president in the year 1800 when construction on the White House was finished, he had already been dead for a year. The first president to live in the People’s House was our second president, John Adams.
George Washington didn’t live in the White House, much less make any “booze” there.
