That's not what willfully means. The NBA will have to prove Sterling set out that day to make comments with the specific intent of hurting the NBA. That's not what happened here. He had no idea his comments would be recorded and all would hear them.

They don't have to prove he had an intent to hurt the NBA. All they have to prove is his presence as an owner hurt or would hurt the Assocation because of actions he willfully committed. Just like if he joined the KKK or said these comments publicly. He's so gone it's funny you guys are even trying. He'll be out before the start of next season.

More than likely Sterling will end up agreeing to sell on his own. If he doesn't he will quickly lose in court and Silver will effectively take ownership of the team, hire a committee to sell the team for Sterling. I highly doubt Sterling would ever want someone else selling his team.

How can a private conversation in a person's home constitute WILLFULLY hurting the NBA product? How is the NBA going to prove his private conversation WILLFULLY hurt the NBA? That is the matter at hand.

Public or private means nothing at this point because his comments are now public. The guy is done....he will not be the owner by this time next year.

Even if he took it to court I don't think he would have any case. The owners decision is final and binding and he agreed to that. And if you read the Constitution, effective immediately his ownership rights are revoked and the team will be sold by a committee that Adam Silver puts together.
