That's not really true. Talking can be a crime. It's called conspiracy. If I offer you money to kill somebody, that is a crime, even if I'm arrested before money changes hands.

Now whether he actually made offers and so forth is a fine line, but it is certainly possible that talking can be a crime.

Uhm just to get you up to speed...Blago wasn't conspiring to kill anyone that I know of.

I doubt they can prove criminality...especially when he turns tables on some of these folks.
