BradtheBloke, rest easy, they can't touch money you cannot get your hands on. I would find out for sure from an attorney if you have to list the trust. I doubt you have to since its not income and does not show up on your tax records. A ½ hour consultation fee with a divorce attorney should clear up all your questions. It might save you a few bucks in the long run.

Totally different - if it shows up on your tax returns they are going to see it - so I would list it but list it and explain that it is of no value and you do not control it.

Agree 100% get a lawyer and be prepared when you have to go,there is nothing wrong with supporting your child but dont let them take advantage of you at the same time.

I agree with this post.

Am paying off the back end of my own Texas-based child support from my divorce in Dallas in 1995. In my case, it's all good, but I may be the exception to the rule.

The court does not have any way to know what your assets are unless someone brings them to their attention. That could include your ex-wife and/or other interested parties (her family members, her lawyer etc).

The basic point here is she doesnt have to prove you HAVE more money to get an increase, she has to prove she NEEDS more money...Your stocks, bonds, etc mean nothing...

Thats y u need a lawyer, its not that you cant afford one its that you cant afford NOT to have 1. And dont get that fat guy at the OTB, get a proven Divorce atty....

I thought "child support" was "child support". Didn't matter if the spose made $50,000 per year or $500,000 per year to exaggerate a point.

Do you see the child /children?

yes i see the kid from time to time

Nice to know you were behind and she had to sue you to get it.

Very nice

And I was never behind. When she took me to court when the child was 8, I didn't have to pay that much in arrears as she wanted nothing to do with me. I had no problem paying the arrears and have been paying my obligated 20 percent every month for the past 3 yrs. This is a modification hearing where she wants more. And I will def be getting an attorney. Funny story about my attorney, he got mad at me because I faxed the child support office my current pay stubs. I don't see the harm in that as I don't mind paying 20percent on what I'm making. I just don't want her to know about the stocks and have to pay 20 percent of the interest earned as I get none of that money anyways. I shouldn't have to pay on money I can't even touch.

You're clueless, Pro. It doesn't matter is she needs it or not. By law, the child must be provided support by the parent not providing day to day living arrangements. In TX, it's a set percentage.

get a test to see if the kid is even yours. tell your lawyer to get it where she has to document every dollar of the child support that you give her to make sure it is child support and not just free money for her.

sorry, never heard of such a thing. So if a guy is jobless he pays $0? And if a guy has 6 kids with 6 different women what does he pay?
lets say Tony Roma makes 10 mill and has 3 kids with 3 different women , They each get 2 million a yr to raise 1 kid???????
Sounds pretty dumb to me but then again im clueless

LOL---I was wondering if it's 20% per child or some sliding scale.

George W.Bush once said "Don't mess with Texas".

He's right--any state with gas stations that have a sign outside reading: "Gas and Guns" ; I need to just say no.

Tell her you would like to just buy the kids food and clothes instead of giving her the money.
