With your help, Oregon's state Senate bill 742 has been defeated, closing the door this year on in-state tuition for illegal aliens! Big high five to our allies at Oregonians for Immigration Reform (OFIR) for their outstanding work against this bill.

In North Carolina, your calls and emails flooded offices as William Gheen of ALIPAC, Ron Woodard of NC Listen, and James Johnson of NCFIRE moved office to office in the NC General Assembly with about ten volunteer activists.

The results? House Bill 36 (E-verify) passed the house on second reading by a large margin of 75-43! In the Senate Judiciary II Committee, SB 205 (Stop Illegals from getting welfare) bill passed by unanimous approval and heads to the Senate floor!

We are not out of the woods yet in North Carolina as Thursday is the dreaded 'Crossover Deadline' and these bills must pass one chamber by Thursday night or they die for the year. With more great news from the US Supreme Court this week, our legislation to stop illegal alien sanctuary cities is on the move again in Texas!

Please push hard today and Thursday in North Carolina and Texas! We need ALIPAC activists from all states focused on these two.

Four More E-Verify Victories Could Push Congress Into Action

There were four more huge E-Verify victories at the state and local level this week that will continue to pressure Congress into passing a national E-Verify bill!
Two weeks ago, the Supreme Court ruled in favor of Arizona's E-Verify bill, and this week, the Court ordered the Third Circuit Court of Appeals to review its ruling that suspend Hazleton, Pennsylvania's law requiring businesses in the city to use E-Verify.
In Alabama, Gov. Bentley signed what many are calling the nation's toughest state-level immigration enforcement bill that includes a provision requiring the use of E-Verify for all employers in the state. And in Florida, Gov. Rick Scott strengthened his original E-Verify executive order by adding specific language requiring subcontractors working on state contracts use E-Verify. Finally, Yakima, Washington's city council approved a mandatory E-Verify ordinances for all employers in the city.
Three bills requiring the use of E-Verify have already been offered in Congress -- two by Democrats (Shuler and DeFazio) and one by a Republican (Carter). The three bills combined have bipartisan support from 57 Members of Congress.
With all the state level action on E-Verify, dozens of articles have popped up in local newspapers and online blogs spreading some misinformation on E-Verify. Please be careful as you read stories about E-Verify, especially on websites, blogs and other news media that you usually trust. The fact is that those who benefit from illegal immigration are spending huge sums of money to plant most of these stories to create negative impressions about E-Verify that simply aren't true.
Jeremy, our Director of the Media Standards Project, posted two blogs this week that focus on some of the misinformation. Please read these and prepare yourselves for the PR battle that will rage the next few weeks as the U.S. House of Representatives begins to move a national mandatory E-Verify bill through committees. All of these state and local E-Verify victories over the last few months and years have brought us to this cusp of finally having a big positive victory in Congress. Alabama has just passed Arizona by passing the toughest bill yet against illegal immigration.

The illegal immigration battleground is in the states, and as more and more states pass tough laws against illegal immigration, states which do not act will be magnets for illegal immigrants from other states that refuse to return to their home countries.

The State of Ohio , according to the 2009 Census Bureau estimate, spends $765 million yearly on social services for illegal immigrants including such things as education for their children, health care, and incarceration for those who have committed criminal acts. This does not even include the soft costs of illegal immigration such as the cost for welfare benefits for American citizens who have been displaced from their jobs by unfair competition from illegal immigrants.

With an unemployment rate of 10.5% in Ohio according to the June 2010 BLS estimate, it is estimated by FAIR (Federation of Americans for Immigration Reform) that there are 115,000 illegal immigrants in Ohio competing with our own citizens for what jobs are available.

Why is our Ohio legislature turning a blind eye to this situation? When will we see tough laws against illegal immigration here in Ohio? They keep saying they want to trim the state budget and give Ohio taxpayers a break. Well, here is a chance to trim $765 million!

Ohio's jobless and Ohio's taxpayers have had enough! We want tough laws against illegal immigration in Ohio!

A total of 102 people defeated the Home Secretary in the courts in 2010 on family rights grounds, including violent criminals and illegal immigrants who had no other right to be in the country.

Romanian migrants send home £500,000 each day from the UK

A total of £41million left the UK for the Eastern European country over a three-month period, said the Romanian Central Bank.


Last year alone, the Romanian economy was boosted by £2.5billion sent from abroad, it added.

The figures for the country’s UK-based nationals for January to March last year include cash transferred between banks or moved by money transfer.

If the level was maintained throughout 2010, it would mean more than £160million was sent to Romania from the UK over a year.


That would mean a rise of nearly 50 per cent on the 2009 total of £108million. But the figures do not include informal transfers and unofficial movements of money, including cash moved between friends and relatives.

This means the true total could be up to 30 per cent higher. An estimated two million Romanians work abroad, including 60,000 thought to live in the UK. Most live in North London and the South East of England. A further 25,000 each year are given work permits to enter Britain

Judiciary Chairman Lamar Smith (R-Texas) has assembled legislation that draws upon every mandatory E-Verify bill that you and we have supported through the years. For 15 years, the business lobbies have successfully fought us and prevented mandatory E-Verify.

But at the Wednesday hearing, two national business lobbies are scheduled to testify in favor of the Chairman's bill!

This introduction of a bill is not a little grab for publicity by Lamar Smith, who took over the powerful chairmanship in January.

He was chairman of the immigration subcommittee of Judiciary back in 1995-96 when he tried to move a mandatory E-Verify bill through the House. He narrowly lost that effort. If he had won in 1996, I have no doubt that millions of jobs currently held by illegal aliens would be filled by Americans who instead are unemployed.

Chairman Smith believes the times has finally come to do what every serious person acknowledges has to be done to stop most illegal immigration -- take away the jobs magnet with a mandatory electronic verification system.

Even Pres. Obama agrees. His reluctance is just that he wants to give an amnesty to current illegal aliens at the same time as turning off the jobs magnet for future illegal aliens.

According to people quoted in this article from the Tucson Citizen, there is no lightning in southern Arizona this time of year. These people believe that the wildfires could only have been started by human beings.

And is it a coincidence that the fires that are destroying Arizona's wildlands appear to have started along known drug and human smuggling routes on the border with Mexico?

It is very important that we add every state we can to the list of states cracking down on illegal immigration in 2011! Right now the states of Arizona, Indiana, South Carolina, Georgia, and Alabama have taken strong action to fight illegal immigration.

Today, we are close to adding North Carolina and Texas to that list. We must all work very hard to stop the illegal alien invasion supporters from defeating or gutting our bills.

Building this list up increases our chances of success in all states.

As many as 2,500 illegal immigrants a week are flooding into the continent from North Africa through Italy, the European Union's border protection agency has revealed.

[FONT=arial, helvetica]Alert! HR 2164, The Legal Workforce Act Will Make E-Verify Mandatory & Permanent![/FONT]The Chair of the House Judiciary Committee, Lamar Smith (R-TX) has introduced an important bill to mandate E-Verify usage by employers.

HR 2164, The Legal Workforce Act would phase in the employment verification system over three years and make it permanent. Large employers, government agencies, and government contractors would have six months to comply. The bill would increase the penalties for businesses that fail to use the system, and it explicitly protects the rights of state and local governments to revoke the business licenses of employers who refuse to comply. We will be working hard to make sure that the bill is made even stronger so that any additional states' enforcement rights are not pre-empted.

Making E-Verify mandatory and permanent is an important step in putting millions of Americans back to work and fixing our broken immigration system. It will go after those unscrupulous businesses who purposely seek to exploit illegal immigrant labor and also help to deter identify theft.

HB36 E-Verify Gutted by NC Senate Commerce Committee
The citizens have been duped

The version of HB36 E-Verify, that was passed by the NC House and sent to the Senate, was NOT the one passed by the Senate. The House version, (ver 4), applied to ALL businesses in NC that had 25 or more employees.

Members of the Senate Commerce Committee, in overnight consultations with the NC Chamber of Commerce, stripped the provision that included ALL businesses in NC. The new version, (ver 6), applies ONLY to contractors and sub-contractors doing business with State Government that have 25 or more employees.

The new Senate version omits and exempts 90% - 95% of the businesses and people that HB36 was intended to apply to.

The bill was changed so drastically that it must now go back to the House for concurrence.

NCFIRE urges everyone contact all NC House members to demand they DO NOT CONCUR. Implore them to send HB36 to a committee and replace the language of HB36 ver. 4, to include ALL businesses in NC.

Open-borders leaders in Congress this morning were in a panic saying they fear that a national mandatory E-Verify bill will become law this year.

Perhaps it was the sight of so much business lobby support for E-Verify at a hearing of the House immigration subcommittee. Yes, law-abiding businesses were begging Congress to force their competitors to stop hiring cheap foreign labor and having taxpayers subsidize them. (National Restaurant Association and National Association of Homebuilders, plus a letter of support from U.S. Chamber of Commerce -- all of these endorsing mandatory national E-Verify!)

ACTION: Please go to your Action Board now and send free faxes asking your U.S. Representative to co-sponsor H.R. 2164 (the Legal Workforce Act introduced yesterday by Rep. Lamar Smith, chairman of the House Judiciary Committee).

And you'll also find faxes to send to your Senators asking them to co-sponsor another bill introduced yesterday by Sen. Grassley of Iowa (S. 1196) which would even more vigorously force the hiring of American workers over illegal foreign ones.

FINALLY, WE CAN START BUILDING SUPPORT IN THE SENATE

Until this moment, it has been difficult to really hold the new Senate accountable on illegal immigration because there hasn't been a mandatory E-Verify bill to insist that they co-sponsor.

Now, you can truly know who stands with illegal workers and the outlaw businesses that hire them and who stands with U.S. workers and the law-abiding businesses.

Perhaps most interesting is that the freshman Senator from Florida, Marco Rubbio, who is being so closely watched because he is Hispanic is one of the original co-sponsors on Grassley's bill, which is probably the toughest workplace enforcement bill ever introduced.

Also already signed onto the bill are both Senators from Utah (Lee and Hatch) where the legislature passed its own amnesty bill for illegal aliens. Utah citizens apparently think illegal workers should leave rather than stay, based on what the U.S. Senators seem to know about them.

MAIN BALL IS ROLLING IN THE U.S. HOUSE -- HERE ARE THE KEY WAYS THAT THE HOUSE BILL WOULD EXPAND WORKPLACE ENFORCEMENT OVER WHAT THE STATES CURRENTLY ARE DOING

Ever since the U.S. Supreme Court ruled in favor of Arizona's mandatory E-Verify law, we at NumbersUSA have heard a modest but steady stream of comments from people questioning if it wouldn't be better to skip having a national E-Verify law and stick with state laws to push illegal aliens out of U.S. jobs.

Certainly, we have to acknowledge that we would not right now have the possibility of a national E-Verify law passing if it weren't for the valiant efforts of many state legislators across the nation who -- often with the help of attorney, and now Kansas Secretary of State, Kris Kobach -- fought tirelessly and tenaciously for years to pass E-Verify laws in states while Congress fiddled.

But the goal has always been to use state efforts to force Congress to act nationally.

After all, does anybody believe that the state governments in California, Illinois, New York and a number of other virtual sanctuary states will ever require E-Verify? The only hope for people in those states (which not coincidentally have the largest populations of illegal aliens) is a national law.

H.R. 2164 will be the primary legislative vehicle for change because it has been introduced by Rep. Lamar Smith (R-Texas) who is Chairman of the Judiciary Committee which handles immigration and because his Party is in power in the House.

The Legal Workforce Act (H.R. 2164) is not a perfect bill for us because it has been negotiated to make a few concessions to obtain the support of national business lobbies (rather than their using their considerable resources to try to defeat mandatory E-Verify as they have always done in the past).

But H.R. 2164 offers much to celebrate.



E-VERIFY FOR NEW HIRES
  • 99% of all hirings for U.S. jobs of any kind would have to be run through E-Verify within 2 years.

    (Only 6 states come close to this requirement.)

    (44 states don't require E-Verify for any private employers of any size unless they have government contracts.)
  • After 2 years, even employers of just ONE worker will have to use E-Verify, getting at the day laborers and other parts of the underground economy.

    (Only 4 states have laws as good as this -- 46 states don't.)
  • 100% of all state, county and city hirings would have to be run through E-Verify within 6 MONTHS.

    (Current state laws affect an estimated 30% of state employee hirings nationwide and 12% of local government hirings.)
  • 100% of all hirings by state government private contractors would have to be run through E-Verify within 6 MONTHS.

    (That compares with around 25% of all state contractor hirings nationally under current state laws.)
  • Would make into law the very good executive action that Pres. Obama took in 2009 mandating E-Verify for all federal contractors (added to all federal employees).
FIRING ILLEGAL ALIENS WHO ALREADY HAVE JOBS


-- 3 HUGE NEW ENFORCEMENT EFFORTS
  • States are prohibited by current federal law from requiring employers to deal with illegal aliens who are already on their payroll.


  • H.R. 2164 brings a huge increase of enforcement into the states by creating two big dragnets to identify and remove illegal aliens from their jobs.

    No. 1: Multiple-Workplace Notification -- Going After Identity Thieves

    (No state has a law that goes after illegal aliens who get jobs by stealing identities.)

    E-Verify's biggest weakness is that it fails to catch most illegal aliens who have paid big money to steal identities of U.S. citizens and other legal workers.

    This provision in Lamar Smith's bill goes beyond E-Verify to close this loophole and catch perhaps the worst of the illegal workers, while alerting citizens so they can recover their stolen identities.

    The bill:

    1. requires the Social Security Administration once a year to identify all matching Social Security numbers and names that are being used at multiple workplaces (some are used at dozens and even hundreds of workplaces).

    2. creates a system for the real owner of the name and SS number to contact SSA and establish ownership and where that person actually works.

    3. requires SSA to notify all employers (other than of the true owner of the name) for a process that will result in the firing of the workers falsely using that name and SS number (although experience suggests that most of those illegal aliens will stop showing up for work once they get the notification letter from SSA).

    No. 2: No-Match Notification -- Going After Fictitious Identities

    (No state has a law that achieves any comparable effect.)

    The bill requires SSA's computers to identify every payroll worker who is using:

    (a) a SS number that doesn't exist
    (b) a SS number that doesn't match the name in the system
    (c) a number that isn't a SS number
    (d) other irregularities involving the SS number and information about that worker

    After giving those workers a few days to straighten out any errors about them in the system, the employer is required to fire the ones who can't do so (in other words, fire the illegal aliens and also legal visitors who don't have the right to work).

    No. 3: Ensuring that Foreign Workers Who Lose Their Right to Work Cannot Continue Working Anyway

    (No state has a law that achieves any comparable effect.)

    The bill requires SSA to essentially deactivate the SS number of an alien whose visa expires, or who is deported or required to leave the United States, so that number cannot continue to be used to gain employment.

    The bill also requires DHS to notify employers of temporary workers when those workers' visas are about to expire, so the employer knows they must re-run those workers through E-Verify if they plan to continue their employment, thus ensuring that those whose work authorization has been extended may continue working, but others will be terminated.

    BEEFING UP ENFORCEMENT OF FEDERAL LAWS AGAINST EMPLOYING ILLEGAL ALIENS

    Chairman Smith's bill would impose big increases in penalties for businesses that continue to hire illegal aliens.

    (a) up to $25,000 fine per illegal worker

    (b) minimum prison sentences of one-year for offending employers

    I should tell you that everything great in the details above are even better in the Grassley Senate bill.

    THE COMPROMISES IN THE CHAIRMAN'S NATIONAL E-VERIFY BILL

    Obviously from the above, you can see that most of H.R. 2164 is fantastic.

    But when I said Monday that Rep. Smith's bill is the "most important" E-Verify legislation ever, I did not mean that it is the "best ever."

    Mr. Smith's bill is "most important" because it has a real chance of getting through House, Senate and the White House and becoming law THIS YEAR. It has a chance because it isn't the "best" and instead involves some compromises to remove some key opposition that could keep it from reaching the finish line.

    It is always critical to remember that a perfect bill that does NOT become law helps nobody.

    H.R. 2164 does have a couple of significant compromises that were thought to be necessary to turn the extremely powerful business lobbies from aggressive opponents into supporters of the legislation.

    Would the country be better off with this "compromise" national legislation or with having no national legislation and continue to rely solely on state laws?

    I think the description of the bill's attributes above suggest a resounding reason to support H.R. 2164 as the vehicle for the national mandate we have sought since NumbersUSA was founded in 1996.

    The bottom line is that 7 states with the toughest state workplace immigration laws would have some minuses to go with the pluses of H.R. 2164. But 43 states would have immediate and incredibly broad improvements in the reduction of illegal alien workers in their states.

The version of HB 36 that just passed in the NC Senate is NOT the version passed by the House. Behind closed doors, NC Senate GOP leaders gutted the E-verify bill that would have opened up tens of thousands of jobs for desperate American workers.

This bill was gutted by Senate President Phil Berger of Rockingham [919-733-5708], NC along with Senators Tom Apodaca of Hendersonville [919-733-5745], Bob Rucho from Charlotte [919-733-5655], and Harry Brown of Jacksonville [919-715-3034]. Other Senators may be involved and we are gathering information about that now.

Feel free to let those Senators know how you feel in a firm but peaceful way. Let them know you plan to support their removal from office in the 2012 elections.
