HC, I worked front lines for public education and media awareness from 1998-2010 and can assure you that blowhards like Sessions can certainly provide legitimate distraction but even in his position he is incapable of stopping the inevitable social paradigm shift on this topic.

Persons most at risk are those furthest from legal states who are careless in their cannabis-related behavior.

But with literally each passing year more states will replace Prohibition with some form of (mostly) sensibly regulated legal markets.

As long as you safely get your product into your own home and do not otherwise attract police attention to said home, it is very difficult to be legally arrested.

The vast majority of arrests occur when someone is carrying in their vehicle and they are involved in a traffic stop and for whatever reason foolishly consent to a vehicle search And/Or foolishly toke burning weed in the vehicle while carrying arrestable quantities.

you're not alone. Dr Lanquel has been speaking locally and internationally for the greater part of two decades. Fluent in English, French and Cantonese. Speaking at The University of Toronto July 18, 2018 ; The 2018 International Cannabis Symposium. Wasn't easy to get him, doesn't come cheap. 'The Chronic Cerebral Effects of Cannabis Use; Psychological Findings and Conclusions. '. Yup,.........certainly will be interesting. Looking forward to meeting the chap.

But what do you mean foolishly consent to a vehicle search? If you say no, they call the dogs and the dogs will smell it even if you have nothing in your car.

That's a different topic but I don't believe the cops play by the rules with that dog consent shit. Those dogs are amazing but almost too good to be true. Like they never make a mistake? I dno.

But back on topic, you can't refuse your car to be searched really?

Of course if you have a medical card you can carry more than enough. Like a QP I heard. 4 ounces.

But without a card. How can you turn down a search? I don't see how thats possible

Because if a cop asks to search your car, then he most likely has probable cause. I was in a fucked up situation when I was like 20. Cop didn't ask to search. Just called the dogs because he looked at my juvenile record (which I believe is illegal). Im waiting for 10 minutes due to a tag light being out and next thing you know I hear dogs barking. Weed wasn't even in the car. Had less than a gram in my pocket and a bowl.

Cops pulls me out. Conducts the search and last door the dog sits down. I was like wtf? He told that dog to sit down cuz dog wasn't smelling shit the first 3 doors.

Weed was in my pocket outside of the car. I mean I guess dog smelled the aromoa(I dont smoke that bullshit). But rear passenger door is not the drivers door. So was a bit skeptical on that. Next thing u know cop says he has consent to search lol.

And I didn't say a word no back talk, nothin.

Now please note it is also not smart to Resist a search if police decide to conduct it.

But unless they have clear PC, a non-conceded search can be contested on 4th Amendment grounds by a competent defense attorney should a case ever approach trial status.

Once you provide consent you eliminate most 4th Amendment rights protecting you from unreasonable search.

Yes, they might bring out a dog. But there are articulated limits on how long they can detain you and the dog's alleged Alert can also be challenged by a competent defense attorney.

Most all of the above becomes moot provided you do not place yourself in such spots.

Either have your product delivered to your home where extremely strong 4th Amendment protections apply or only have it in vehicle long enough to discreetly transport it to your home with a recommendation you only carry misdemeanor weight. IOW, don't buy a half pound (or here in Florida, stay below 20 grams) and don't pollute your vehicle with burning weed smoke. Keep your vehicle properly tagged, insured and respect all traffic laws while carrying contraband.

Police routinely lie as they are not legally obligated to be truthful.

If a cop truly has PC he does not need to ask for your consent.

But they are trained to always ask in hopes you will then have surrendered potential 4th Amendment defenses in the event of contraband being discovered and a subsequent arrest

Ok but the process I am familiar with goes like this....

Cop may or may not have PC, asks to search the vehicle....You say no. He says okay we will wait for dogs to see.



I guess what I am asking is.....yes it may help you down the line with a defense attorney. But there is no way out of getting your car searched at that time right? If you say no, they aren't going to just say okay bye.

In my case, the cop didn't lie. He just might have broken the law by looking at my juvenile record to search for somethin negative because I had nothing on my adult record at the time. So he didn't lie. He asked if I had been arrested before I said no. And then he said I thought you had never been arrested before? I said I was 16, are you even allowed to look at that shit? He responds with silence. No words. Then he threatens to charge me with DWI lmao. For being high on ganja.

But in general, if they have no PC. Say the weed is in a smelly proof. Shit cannot be smelled. If the cop asks to search, and you say no... dogs are coming and whatever you got in weed is about to be taken. Plus lawyer fees and court fees. Plus the ganja. Gonna be at least a $4K hit in all. So that's why if you can get out of a non PC search at the time it would be beneficial.

I never smoke and drive.

Wow, that shit was poetry level beautiful. Educational to many and a nice friendly reminder to everyone of the rights our constitution gives us. Those rights are regularly ignored and trampled over by police that only do what they are told and haven't read the constitution, but nonetheless, remain guaranteed to those of us that are US citizens. Carry on and bring more awesomeness. Maybe I should learn Cantonese before that game.

Yeah it sounds good in theory, but lacks in practical application.

Doesn't matter if a cop has true PC or not, as it can be easily manufactured. All he has to say is "I smell marijuana" or "your eyes look glassy" and BOOM he has probable cause that is effectively indisputable and will hold up in court.

His claim that he smelled marijuana is in fact "substantiated" if/when he finds something, even if he was making it up to begin with. Cop tells judge "I smelled pot, we looked, lo and behold we found it". You think a judge is gonna throw shit out because your defense attorney says "there is no way he could have smelled it, it was wrapped up really tight!"

No. Just, no.

Besides, no regular Joe is getting a lawyer and taking shit to trial to fight a misdemeanor possession charge. Not worth it.

And if he doesn't find anything? Oh, sorry for the inconvenience. Stay safe out there. What, you're gonna sue for a civil rights violation because he took 20 minutes out of your day? You're not gonna get much traction there.

Bottom line is just don't travel with a felony amount period, because it doesn't matter what your "rights" are, the police can skirt them to an extent.
